HomeMy WebLinkAbout08-28-1973 Regular MeetingSTATE OF ALABAK& County of Baldwin The City Council of the City of Fnirhiope, Alabama., met in re- gular session at the City Administration Building, 387 F'a.irhope Avenue, Monday, August 281, 1973 at 7s00 P.M. with the following members present: Mayor James P. Nix, Councilmen; David (EI) Bishop; 4. G.= Bishop,, Sam E. Box, 011ie E. Deese and Barney L. Shull. Minutes of the previous meeting were approved. Plat was presented showing area on S. Summitt Street that was dis.. cussed at previous meeting. Motion by Councilman Sam Box seconded by Councilman Barney Shull that no action be taken by the City Council. Motion oarried,+ Council requested letter from the Fairhope Single Tax Corporation stating amount of refund they feel -is due to them and action to be taken at a later date. - Action on Alabama Power Company contract deferred until next reg.. ulcer meeting of the Council. Lotion by Councilman H., G. Bishop seconded by Councilman Barney Shull that on the advice of the Police Department the following Resolution be adopted. RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that the following fines be set on parking and traffic violations., Double parking 5.00 Overtime Parking 5.00 Improper Parking 500 Loading zone 5.00 Restricted Area 5.00 Bus Stop 5.00 Blocking Traffic 10.00 Improper Maffler 19.00 Fire Hydrant 5.00 Improper Brakes 1900 Improper Tag , , a :. Stop Sign One Way Street Improper Passing Siren Signal Drivers License School Zone Failure to Yield Following Too Close Careless Driving This Resolution to -become effective Motion carried unanimously. 27.00 419.00 10:00 Docket Docket Docket 19.00 10.00 19.00 19.00(Title Docket Docket 19.00 19.00 Docket 36-17 & 36-1� October 1, 1973,- Councilman Shull introduced the following Ordinance; Ordinance No. �/ AN ORDINANCE AMENDING ORDINANCE NO. %% INCREASING COURT COSTS FOR MOVING VIOLATIONS FROM $8.75 to 9.00 AND ALL OTHER COURT COSTS FROM $11.75 to $12.00. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA AS FOLLOWS: SECTION I. That Ordinance No. % , setting Court Costs for the City Recorder's Court in Fairhope, Alabama be, and the same is hereby amended to read, "all moving traffic violation Court Costs hall be the sum of $9.00 per case". SECTION II. "Court Costs for all other cases shall be $12.00!, per ease". SECTION III. $0.50 per case shall be set aside for indigent defendants in the City Reoorder's Court in the City of Fairhope, to be paid to an Attorney for persons indigent and who can not afford an attorney for those cases, wherein the Supreme Court decision says that an attorney must be appointed by the City Re- corder, if the defendant can not afford an attorney." SECTION IV. "There shall be paid the sum of $5.00 for -each Court night for a Bailiff to be selected by the City Recorder to act asBailiff for the calling of witnesses and other duties to be performed as set by the City Recorder of the City of Fairhope" SECTION V. "There shall be paid $5.00 for each two men per Court night for the calling of the cases and keeping arrest cards warrants, and other papers and for the attendance of City Court, and for such other duties as set out by the City Recorder." THIS ORDINANCE SHALL TAKE EFFECT UPON ITS DUE ADOPTION AND PUBLICATION AS REQUIRED BY LAW, N ADOPTED THIS THE 27th D. Attest: City Cler Councilman Sam Box moved that all rules governing the Council which might, unless suspended, prevent the passage and adoption pf the Ordinance at this'meeting, be and the same. are hereby suspended for the purpose of permitting the said Ordinance to be finally passed and adopted at this meeting. Bishop,Sam Box, 011ie Deese and Barney Shull, Nays: None. Mot ton carried. Councilman Barney Shull moved that said Ordin- ance No, be finally passed and adopted as introduced. Ordinance finally passed and adopted as introduced. a Councilman Box introduced the following Ordinance: ORDINANCE NO. � /i AN ORDINANCE TO CREATE A MISDEMEANOR OFFENSE OF CARELESS DRIVING, WITH A FINE OF NOT LESS THAN ONE NOR MORE THAN TWO HUNDRED DOLLARS UPON CONVICTION THEREOF. Section I. Any person who shall, in the streets within the City of Fairhope or its Police Jur4sdiction, operate a motor vehicle or ride or drive any beast of burden, bicycle or vehicle of any kind or character, carelessly so as to endanger or be likely to endanger any property or the life or limb of any person, Shall be guilty of a Misdemeanor.' Section II. Any person convicted under this Section shall be fined by the Court for not less than',One nor more than Two Hundred dollars, and up to sij( months in the County Jail, or by fine or imprisonment at the discretion of the Court; Section III. This Ordinance shall become effective upon its due adoption and publication as required by law. Motion carried. Mayor Nix reported that the -City gas rate from United Gas Company ,has increased .0237 per 1000 C. N. Motion by Councilman Sam Box seconded by Councilman Barney Shull that the City accept increase of Blue Cross - Blue Shield Ins, to be effective with the Sept. 25th. billing. Motion carried. Motion by Councilman Ed Bishop seconded by Councilman 011ie Deese that the Mayor and City Clerk be authorized to sign Option For Test Well Site. Motion carried.
