HomeMy WebLinkAbout08-13-1973 Regular Meetingt n a i g � 1 STATE OF ALABAMA COUNTY OF BALDWIN i The City Council of the City of Fairhope met in regular sess- ion at the City Administration Building, Monday, August 13, 1973` with the following members present: Mayor James P. Nix, Councilmen David (Ed) Bishop, H. G. Bishop, Sam E. Boa, 011ie E. Deese and Barney L. Shull. Minutes of the previous regular meeting were approved. The application of Anderson Quaites III for Beer Permit atl "The Lucky Spot" on Twin Beech Boad was brought up for discussion. Motion by Councilman Barney Shull seconded by Councilman H. G. Bishop that permit be granted. Upon being put to vote the follow- ing vote was recorded: For: Councilmen: H. u. Bishop, yam E. Box, 011ie E. Deese and Barney L. Shull, Against: Councilman Ed Bishop Motion carried. Mayor Nix appointed Mr. Bay Gibson to the Planning and Zoning Commission to fill unexpired term of Mr. Amon Gates who has resign ed. Mr. Gibson•s term will expire May. 259 1976• Motion by Councilman Sam Boa seconded by Councilman Barney Shull that the City appropriate $150,00 for necessary repairs at the Fishing Dock. Motion carried. Councilman H. G. Bishop introduced the following Ordinance and moved its adoption:, � f 6 1 ' f 1 � r � � c ORDINANCE NO. // AN ORDINANCE ANNEXING THE WITHIN DESCRIBED PROPERTY, WHICH SAID PROPERTY IS ARTLY" WITHIN THE CORPORATE LIMITS OF THE CITY OF FAIRHQPE AND PART"BEING CONTIG- OUS TO THE LIMITS OF FAIRHQPE, ALABAMA., SUCH ANNEXATION BY PETITION OF ALL THE WNERS OF SAID PROPERTY. WHEREAS, JOHN T..THQMAS, and wife,tRACHEL M. THOMAS, BENJAMIN M. JR., and wife, CATHERINE M. TENCH, SELIG.I. GOLDIN, and wife, BETTY GOLDIN STEPHEN SH Y and wife, CAROL SHEY,,bei.ng all of the owners of the herein des- ribed property did by Petition, Petition the City of Fairhope for Annexation, Act 2228, Adopted in the 1971 Regular Session of the Legislature of the to of Alabama, and WHEREAS, a map of said property is attached to the Petition, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY FAIRHQPE, ALABAMA, do by these presents hereby annex all of the following ibed property, which is contiguous to the corporate limits of the City of 1rhope, and more particularly described as follows: Beginning at an iron pipe that is 3605.4 feet North and 386.8 feet East of the Southwest corner of Section 19, Township 6 South, Range 2 East, said iron pipe being on the West right of way of U.S. Highway No. 98 and at the Northeast corner of a parcel of land now owned by Louis S. Conover, run thence N 610 15' W, along Conover's North line, 126.2 feet to an iron pipe; thence run N-610 34' W, along Conover's North line 468.7 feet to two flat iron bars; thence continue N 61° 34''W along Conover's North line, 80 feet, more or less, to the Eastern margin of Mobile Bay; thence run Northeastwardly along theEastern margin of Mobile Bay, 297 feet, more or less; run S.72° 47' E,A.3 feet, more or less to an iron axle that is 293.8 feet and bears N 110 09' E from the two flat iron bars last described; thence continue S 720 47' E, 591.7 feet to an iron pipe on the West right-of-way of.U,S. Highway 98; thence run S 140 54' W, along said right-of-way, 181.35 feet to a concrete monument; thence run S.13o 26' 30 W, along said right-of-way.227.7 feet to a Point of Beginning; con- taining five.(5) acres, more or less, and lying within Section 19, Township 6 South, Range 2 East, and Section 24, Township 6 South, Range 1 East, Baldwin County, Alabama. BE IT FURTHER ORDAINED BY THE CITY OF FAIRHQPE, that the City hereby assent to the annexation to the City the property as hereinabove ribed. CITY OF FAIRHOPE r r 1 is Mavor i X Motion by Councilman Ed Bishop that all rules gove3dng the Council which might, unless suspended, prevent the passage and adoption of the Ordinance at this meeting, be and the same are hereby sus- pended for the purpose of permitting the said Ordinance to be finally passed and adopted at this meeting. Motion seconded by Councilman Barney Shull. The question was put before the Council and on roll call the vote was as follows: Yea: Councilmen: Ed Bishop, H. G. Bishop, Sam E. Box, 011ie E. Deese and Barney L. Shull., Nays: None. Motion adopted by unanimous vote. Councilman Barney L. Shull moved that said Ordinance No. 511 be finally pass- ed and adopted as introduced. Councilman 011ie Deese seconded the motion. The question of final passage and adoption of said Ord- inance was put to vote of the Council„and on roll call the results were as follows: Yea: Councilmen: Ed Bishop, H. G. Bishop, Sam E. Box, 011ie E. Deese and Barney �1,, zinull, hays.- none. Motion carried unanimously and Qrdinanoe finally passed and adopted as introduced. Motion by Councilman Sam Box seconded by Councilman Ed Bi that the following Resolution be adopted. Motion carried. RESOLUTION WHEREAS, Fairhope, Alabama, recognizes,the need to insure ' a i its proper and orderly growth'and to prevent further development of undesirable conditions; and, r Y WHEREAS, community planning is recognized to be of primary importanbe for the growth and development of Flairhope; and, WHEREAS, the financial resources of Fairhope are not adequate to finance the necessary and desirable program of community planning; and, WHEREAS, the Alabama Development Offloe, State Planning Div- ision, can assist in obtaining Federal Urban Assistance Elands to aid in defraying the cost of a planning program and aid in pro- viding qualified personnel to perform the required planning work. NOW, THEREFORE, BE IT RESOLVED: That the City of Fairhope, Alabama, requests the Alabama Development Office, State Planning Division, to arrange the following services; Land Use Analysis Update band Use Plan Update Major Street Plan • Update Community Facilities a and to obtaiAV,Federal Urban Planning Assistance Funds in the jamount of $3,000,00 to aid in defraying the costs of the work specified above. BE IT FURTHER RESOLVED: That Fhirhope will make available the total sum of $1,500.00 be matched by federal funds and to pay those costs not covered under the Urban Planning Assistance Progr which sum will be paid to the Alabama Development Office, State Planning Division, in accordance to the terms of a contract bo be negotiated between Fairhope and the Alabama Development Office, State Planning Division. Motion by Councilman Barney Shull seconded by Councilman Sam Box that the City accept official application for utilities, name Electric, Water & Sewer and possibly Gas, at Point Clear Villa, Ino, provided they are in agreement as to costs and regdirements for these services. Motion carried. Motion by Councilman Sam Box seconded by Councilman Barney Shull that the request of E.tL.-Gudmundsen to sell packaged beer only at Fair Harbor Marina, Inc. be approved. Upon being put to vote the following vote was recorded: For: Councilmen: H. G. Bisho, Sam E. Boa, 011ie E. Deese and Barney L. Shull, Against: Council- .. 4 C man Ed Bishop. Motion carried. Mr. Dan Isherwood , Attorney Richard Lacey and Mr. Wilson Hall met with Council pertaining to S. Summit Street. After gen- eral discussion, Councilman Sam Bog moved, seconded by Councilman Ed Bishop that the discussion be tabled and plat be,presented at next meeting. Motion carried. Motion by Councilman Sam Box seconded by Councilman 011ie Deese that the City take 1/4 page ad in the Fhirhope Courier for Thomas Hospital 13th Anniversary issue. Motion carried. Motion by Councilman Ed Bishop seconded by Councilman Barney Shull that the City accept transfer of lease from Wallace Milham to David Wood and Bob Pope,on Marina and Yardarm Restaurant. Motion carried. Motion by Councilmen Sam Box seconded by Councilman Barney Shull that the following Resolution be adopted: Motion carried. RESOLUTION BE 'IT RESOLVED by the City ,,Council that. the City of Fairhope go on record as opposing Senate Bill 214 and House Bill 694 now pending in the Legislature. These bills propose a`constitutional amendment to revise our judicial set-up in•the State and the City Council is concerned that the change will place the functions of the City's Hec�'orders Court in a District Court to be established in each County.. BE IT FURTHER RESOLVED that a copy of this Resolution be mailed to Hon. L. D. Owen, Jr., State Senate and Hon. Daniel L. Kinsey and Hon. Thomas H. Benton, State House of Representatives. Motion by Councilmen H..G. Bishop seconded by Councilman Sam Box that the bills be approved for payment. Motion carried. Councilmen 011ie Deese requested that the Council consider another StreetImprovement program in the near future. Motion by. Courioilman- H. '7G;' Bishop seconded -'by `Councilman Barney: L. Shull that the City donate balance of $684.00 due on ,r Christmas Decorations to the Chamber of Commerce. Motion carried. It was duly moved, seconded and carried that the meeting adjourn, Attest:-
