STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
session at the City Administration Building, 387 Fairhope Avenue,
on Monday, June 11, 1973 at 7100 P.M. with the following members
,present: Mayor James P. Nix, Councilmens David (Ed')� Bishop, San
,E. Box, H. G. Bishop, 011ie E. Deese and Barney L. Shull.
In absence of the City Clerk, Mrs. Emogene Bales acted as
Clerk of the meeting.
Minutes of the previous regular meeting were approved.
This being date set for public hearing on rezoning Schneider
property, there being no protests, Councilman Barney Shull intro-
duced the following Ordinance.
ORDINANCE NO. 507
AN ORDINANCE AMENDING SECTION 13, DISTRICT BOUND-
ARIES OF ZONING ORDINANCE NO. 295•
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAINHOPE,
ALABAMA, that Section 13, District Boundaries, of Zoning Ordin-
ance No. 295 be amended by rezoning from{-1 to B-1, Lot 2,
Schneider Subdivision.
Motion by Councilman Shull:lthat all rules governing the Coun
which might, unless suspended, prevent the passage and adoption o
the Ordinance at this meeting, be and the same are hereby suspend
ed for the purpose of permitting the said Ordinance to be finally
passed and adopted at this meeting. Councilman Sam Box seconded
the motion. The questionL:was put before the Council and on roll
call the vote was as follows: Yeas Councilmen: Ed Bishop, H. G.
Bishop, Sam E. Box, 011ie Deese and Barney Shull. Nays None.
Motion adopted by unanimous vote. Councilman Barney Shull moved
for final adoption of Ordinance No. 507, seconded by Councilman
Sam Box. The question of final passage was put before the Council

and on roll call the results were as follows: Yeas: Councilmen:
H. G. Bishop, Sam E. Box, 011ie Deeseaand Barney Shull. Nay:
Councilman Ed Bishop. Motion carried+and Ordinance,,duly adopted.

property, no protest being heard, Councilman H. G. Bishop intro-
duced the following Ordinance.
ORDINANCE N0. 508
AN ORDINANCE AMENDING SECTION 13, DISTRICT BOUNDARIES,
OF ZONING ORDINANCE NO. 295•
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA that Section 13, District Boundaries, of Zoning Ordinance
No. 295 be amended by rezoning Lots 20, 21 & 22, Block 4, Central
Park to R-5.
Councilman Sam Box mw,ved that all rules governing the Council
which might, unless suspended, prevent the passage and adoption

pended for the purpose ofpermitting said Ordinance to be finally

Sam E. Box, 011ie E. Deese and Barney Shull, Nays: None. Motion
carried and Ordinance duly adopted.
Motion by Councilman Shull seconded by Councilman Ed Bishop
that Ordinance No. 506, An Ordinance Amending Sec. 2-10(a)
Code of Ordinances of the City of Fairhope, Alabama, introduced
at the regular meeting of May 28, 1973 be adopted as introduced.
Motion carried.
Councilman H. G. Bishop introduced the following Ordinance.
ORDINANCE NO. `i 0
BE IT ORDAINED BY THE CITY OF FAIRHOPE, ALABAMA AS FOLLOWS:
A qualification fee in the amount of $50.00 is hereby
fixed and imposed upon all candidates seeking election as Mayor
or Councilman of the City of Fairhope, except as hereinafter
provided for.
Such qualification fee shall be paid to the City Clerk and
deposited to the general fund of the City, at or prior to the
time of taking out qualification papers by any such candidates.
Any person desiring to qualify who is not financially able
to pay the required fee may qualify provided such prospective
candidate furnishes the clerk with an affidavit stating that he
is financially unable to pay the required'fee fixed by this
'ordinance.
This ordinance is adopted pursuant to Act No. 1109 of the
1969 Legislature and shall be effective in all elections, both
general and special, for aforesaid offices from and after the
date of adoption.

Motion by .,,.Councilman Shull iconded by Councilman Ed Bishop
that the following Resolution be -adopted. Motion -carried.
RES7DLUTION
Be it Resolved by the City Council of Fairhope that Kenny
Hanak be authorized to sign City checks as City Clerk in the
absence of the City Clerk. Motion carried
Motion by Councilman Ed Bishop seconded by Councilman Sam
Box that City ask for bids on small bucket truck. Motion
carried.

LEGAL NOTICE
The City Council of the City of Fairhope hereby give
notice as required by Section 51.13b of the "State and
Local Fiscal Assistance Act of 1972(Title 1, Public Law
` 92-512)" that funds received under said act between
January 1, 1973 and June 30, 1973 will be used for pur-
poses as stated in the following "Planned Use Report".
