COUNTY OF BALDWIN
The City Council of the ,City of Fairhope 'met {in regular
session at the City Administration Building, 387 Fairhope Avenue,
Monday, May 14, 1973 at,7e00 P.M. with the following members pres
Mayor James P. Nix, Councilmen: David (Ed) Bishop, H. G. Bishop,
Sam E. Box and Barney L. Shull. Councilman 011ie'E. Deese being
absent..
Minutes of the previous regular meeting were approved.
This being date set for public hearing on rezoning �eene
property in Volanta, there being no protests, Councilman Shull
introduced the following Ordinance:
ORDINANCE NO. ^a
AN ORDINANCE AMENDING SECTION 139 DISTRICT
BOUNDARIES, OF ZONING ORDINANCE NO. 295
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
'ALABAMA, that Section 13, District Boundaries, of Zoning Ordinance
No. 295 be amended by rezoning the following described property fr
from B-3 to R-2s
Lots 8 through 179 Block 1 and Lots 1 through 7.
Block 6, Volanta Subdivision.
The application of Bernice Brazile for Beer Permit at Skip's
Place was held for the next regular meeting of the Council.
Motion by Councilman H. G. Bishop seconded by Councilman
Barney Shull that the following Resolution be adopted,
RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL of the City of Fairhope,
Alabama that the Merchants National Bank of Mobile as Trustee for
the Water and Sewer Revenue Bonds, be authorized to invest moneys
in the Water and Sewer Surplus Fund in Government Bonds. Motion
carried.
Motion by Councilman Sam Box seconded by Councilman Barney
Shull that the City -advertise for public hearing on rezoning
Lots 20, 21 & 22, Block 40 Central Park Addition, to R-5. Motion
carried.

Motion by Councilman Sam Box seconded by Councilman Barney
Shull that the City advertise for public hearing on rezoning from
R-2 to B-19 Lot 29 Schneider Subdivision. Motion carried.
The Planning Commission recommended that the City Council
consider revising the "Grandfather Claude', Art, 1, Sec. 14 of
the Zoning Ordinance to make it possible to expand nonconforming
uses in a controlled and proper way. After general discussion,
Councilman Sam Box moved, seconded by Councilman Barney Shull that
Mr.' Bob Green be referred to the Adjustment Board with his problem,
Motion carried.

Motion by Councilman Ed Bishop seconded by Councilman Sam Box that
City accept low bid of Electric -Aire provided bid meets specifica-
tions. Motion carried.
Only one bid was received on 3 - 500 KVA Transformers.
Councilman Ed Bishop moved, seconded by Councilman Barney Shull
that the bid be rejected. Motion carried.

Motion by Councilman Ed Bishop seconded by Councilman Said Box
that Superintendent analyze bids and accept low bid provided it
meets specifications and the needs of the City. Motion carried.
Motion by Councilman H. G. Bishop seconded by Councilman
Barney Shull that the following Ordinance be introduceds

AN ORDINANCE AMENDING CHAPTER 20, TAXATION,
CODE OF ORDINANCES OF THE CITY -OF FAIRHOPE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
XLABAMA that Chapter 209 Taxation, Code of Ordifances of the City
of Fairhope, Alabama be amended by deleting Section 20-9 - Area
exempt from AdValorem Taxes.
Adopted this the 21;!'-day of 1973•
Motion by Councilman H.-G. Bishop seconded by Councilman Sam
Box that the purchase of boring machine at a cost of $2700,60 be
confirmed. Motion carried.
Motion by Councilman Sam Box seconded by Councilman H. G.
Bishop that the City place 2 page Ad -in Business Women's Magazine
at a cost of $60.00. Motion carried.
Motion by Councilman Barney Shull seconded by Councilman Sam
Box that the Jaycees be given permission to use beach for July
4th celebrations under same conditions as previous year. Motion
carried.,

Motion by Councilman Ed Bishop seconded by Councilman Barney
Shull that City take a one page ad for July 4th celebration.
Motion carried.
Letter from Mr. Richard Jafolla requesting 2 hour parking
signs be put up and enforced was read, discussed and taken under,
advisement until the next regular meeting of the Council. 1Motion
carried.
Motion by Councilman Barney Shull seconded by Councilman H. G
Bishop that the City Attorney be authorized to proceed with the
necessary proceedings for vacation of a portion of Gayfer Court as'.
requested by Mr. Sage Normand. Motion carried.

that City accept low bid of Truck Equipment Sales if bid meets
specifications. Motion carried.

A group of business men met with Council requesting that the
City reconsider the electric rate and presented petition signed
by approximatley 57 business men. After a lengthy discussion,
Councilman Sam Box moved, seconded by Councilman Barney Shull
that the City get rates from other municipalities that own and
operate their own utility systems and publish them for comparison.
Motion carried.
Council agreed to hire a policeman for the summer months
for the pier and beach area.
Motion by Councilman H. G. Bishop seconded by Councilman Sam
Box that the bills be approved for payment. Motion carried.
It was duly moved, seconded and carried that the meeting ad-
journ.
