COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular session
at the City Administration Building, 387 Fairhope Avenue, Monday,
March 12, 1973 at 7:00 P.M. with the following members present:
Mayor James P. Nix, Councilmen: David (Ed) Bishop, H. G. Bishop,
Sam E. Box, 011ie E. Deese and Barney L. Shull.
Minutes of the previous regular meeting were approved..
Motion by Councilman Sam Box seconded by Council:man Barney Shull
that the following Resolution be adopted:
RESOLUTION
A RESOLUTION RESCINDING ALL PRIOR RESOLUTION AS TO THE FIXING OF
WATER RATES AND SEWER RATES LOCATED WITHIN THE CITY LIMITS OF
FAIRHOPE, ALABAMA AND ANY AND ALL WATER AND SEWER LINES EXTENDING
BEYOND THE CITY LIMITS OF FAIRHOPE AND:FIXING NEW WATER RATES AND
SEWER RATES LOCATED WITHIN THE CITY LIMITS AND WATER LINES EXTEND-
ING WITHOUT THE BOUNDARIES OF FAIRHOPE, ALABAMA EXCEPT AS TO THE
CITY OF FAIRHOPE CONTRACTUAL OBLIGATIONS WITH THE WEST BALDWIN
WATER AUTHORITY.
BE IT RESOLVED, by the City Council of the City of Fairhope
Alabama as follows:
SECTION 1: That all prior resolutions fixing water rates
acid sewer rates within the City Limits of Fairhope, Alabama, and
all water rates without the City Limits of Fairhope, Alabama, and
owned by the City of Fairhope, Alabama be, in the same are hereby
rescinded, except as to the contractual obligations with the
West Baldwin Water Authority which shall remain the same under
the original contracts executed by the City of Fairhope, Fairhope,
Alabama and the West Baldwin Water Authority.
SECTION 2. There -is hereby fixed the following schedule
of rates for the usage of water wi-thin' the- City Limits of Fair -
hope, Alabama as follows: ' `'
1. For the first 2,00.0 gallons'of water used per customer
$2.00 minimum per month.
2. For the next 69000 gallons $0.50 per 1,000 gallons per
month.
3. For the next 109000 gallons $0.40 per 1,000 gallons
used per month.
4. For the next 189000 gallons & over, $0.25 per 19000
.gallons per month.
SECTION III: All water rates outside the City Limits of
Fairhope except West Baldwin Water Authority shall be as follows:
1. For the first 3,000 gallons, $4.50 minimum charge per
month.
2. For the next 2,000 gallons, $1.25 per 1,000 gallons
usage per month.
3. For the next 5000 gallons, $0.90 per.19000 gallons
usage per fonth.
4. For all over 109000 gallons usage per month, $0.60
per 1,000 gallons per month.
SECTION IV: There is hereby established. for water connect
Ion fees in the City of Fairhope, the following:
1. Standard Connection fee, $125,00 for a standard 3/4"
service.

2. For services larger than 3/4119 the costs shall be the
rate for a 3/4" service plus the followings
a) 1" connection, $75.00
b) 2" connection $225.00
c) 3" and 4" connection, $585.00
d) 4" connection *i,�t.bypass, $700.00.
e) 6" connection $675.00
f) 6" connection with 4" bypass, $810.00
SECTION iTY SEWER RATES - All sewer rates within the City Limits
of Fairhope, Alabama shall be computed at a rate of 70% of the
user's water bill with a minimum Sewer Charge of $2.00 per month,
and, a maximum of $3.00 per month for the first 1009000 gal., from
100,000 to 1509000 gal# a maximum of $10.00; from 150000 gal.

'$20.00.
SECTION VI:SEWER CONNECTION FEE - There is hereby establish
ed the following Sewer Connection Fees within the City Limits of
Fairhope, Alabama:
1. The minimum sewer connection fee--$200.00 each
for all 4" domestic and commercial service connec-
tions
2. Service connections larger than 4" shall be $400.00
f each.
3. Where the subdivider subdivides•his own land and
furnishes his own sewer lines 'at his ,own expense,
a $50.00 connection fee for each connection.
SECTION VII: ENFORCEMENT - PENALTIES,: For the enforcement
of the payment of all the rates, charges, fees.and penalties
fixed herein, the following rules, regulations and penalties are

a) For using or tapping water without first having obtain
permits from the proper authority, a minimum monthly rate of
$15.00 dollars is established for each connection and, in additt
the usual rate for all water used and the amount of water used
before the installation of a meter shall be estimated by the Cit
Council of the City of Fairhope and payment made on such estimat
$uch charge commences on the date of the unlicensed connection.
b) Any person who shall connect any Sewer Lines with any
Sewer Lines of the City of Fairhope, or who shall empty sewage
Into any line of the City of Fairhope without first having obtai
ed permission from the proper authority, shall pay a monthly
sewage disposal rate of $15.00 and such charge shall be affixed
from the date of such unlicensed connection that was made within
lines of the City of Fairhope.

IIIf not paid on demand, the City of Fairhope may,immediatel
disconnect the water and/or sewer service.

SECTION VIII: DELINQUENT BILLS_ Any person, firm or
corporation who fails or refuses to pay any of the fees, charges,
or rates herein above set out, for a period of 10 days, there
shall be added a 5% penalty thereon.
SECTION IX: This resolution shall take effect on the 1st
day of April, 1973 •

Motion by Councilman Barney Shull seconded. by Councilman 011ie
Deese that the City purchase three dog traps at :a cost of $45.00
each. Motion carried.
Motion by Councilman Sam Box seconded by Councilman Ed Bishop
that the application of Fair Harbor Marina, Inc. for packaged
Beer Permit be dented. Motion carried.
Motion by Councilman Sam Box seconded. by Councilman Ed Bishop
that payment of $100.00 to Ameraport, Inc. be approved. Motion
carried.
Councilman Barney Shull, Chairman of the Stadium Ways and Means
Com&Xttee presented a report on funding and building a stadium
and facilities. Mayor Nix and Councilimembers commended the
committee on the excellent report. Councilman Sam Box moved,
seconded by Councilman Ed Bishop that the committee be authorized
to proceed with funding and building stadium as presented in the
report. Motion carried.
Mayor Nix proclaimed. March 11 through March 179 1973 as Clean -Up
Week and stated that the City dump is open for trash and. garbage
six days a week from 7:00 A.M. to 3:30 P.M. and is free to resid-
,ents-within the City Limits of Fairhope.
Motion by Councilman Sam Box seconded. by Councilman Barney Shull
that approval be given Middle Bay Land. Co. Performance Bond
as presented to the Council. Motion carried.
Motion by Councilman H. G. Bishop seconded by Councilman Sam Box
that the City Supt. be authorized to proceed in repairing well
behind police station and pump at the plant in order to get wells
in good condition for coming summer months. Motion carried.
Opening of gas pipe bids was postponed for next meeting.
Motion by Councilman H. G. Bishop seconded by Councilman Barney
Shull that the bills be approved for payment. Motion carried.
Motion by ,"Councilman Barney Shull seconded by Councilman Ed
Bishop that the Council recommend to the Planning and Zoning
Commission that they forward a brief to the City Council report-
ing their reasons for turning down a rezoning request. Motion
carried.
Motion by Councilman Ed Bishop seconded by Councilman Barney
Shull that the City repair, grade and stabalize with crushed
oyster shells the beach road north of the Municipal Pier at an
approximate cost of $19187.00. Motion carried.
Motion by Councilman Sam Box seconded by Councilman Ed. Bishop tha'
the City ask for bids on Cast Iron Pipe for next regular meeting
of the Council on March 26, 1973. Motion carried.
Motion by Councilman Sam Bog seconded. by Councilman H. G. Bishop
that the City send two representatives to Birmingham, April 10
and lath, to Gas Safety Pipe Line School. Motion carried.

City send two men to Meter School at the University of Alabama,
March 19, 1973• Motion carried.
It was duly moved, seconded and carried that the meeting adjourn.
