HomeMy WebLinkAbout02-26-1973 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN - The City Council of the City of Fairhope met in regular session at the City Administration Building, 387 Fairhope Avenue, Monday;, February 26, 1973 at 7:00 P.M. with the following members present: Mayor James P. Nix, Councilmen: David (Ed) Bishop, H. G. Bishop, Sam E. Box, 011ie E. Deese and Barney L. Shull. Minutes of the previous regular meeting were approved. Motion by Councilman H. G. Bishop seconded by Councilman Sam Box that the City Advertise for public hearing on rezoning from R-1 and R..2 to B-29 land lying in the SEJ of the SWJ and. the SW4 of the SE4 of Section 59 T6S9 R2E, and containing 14.1 acres of land, more or less, Also, from R-1 to B-3, land in the SWJ of the SEJ and NWJ of SEJ of Section 59 T6S9 R2E, and containing 19.0 acres, more or less. Both parcels are part of triangle of land bound by U. S. Hwy. 98, Alabama Hwy. 104 and U.,S. Hwy. 98 Bus- iness Route. Motion carried. Motion by Barney Shull seconded by Councilman 011ie Deese that the City advertise for public hearing $o rezone from R-1 to R-39 Parcel B. Niemeyer Subdivision, SEJ of the NEJ of Section 179 T6S, R2E, Baldwin County, Alabama, of the lands of the Fairhope Single Tax Corporation, in the City of Fairhope, Alabama,Property located on the north side of Fairhope Avenue between Ingleside Avenue and Greeno Road.. Motion carried. Motion by Councilman Sam Box seconded -by Councilman Barney Shull that the City pave parking area at the end of Orange and -Pier Streets and pave for boat ramp at the end of Pier Street at an approximate cost of $500.00. Motion carried.. This being date set for opening bids on Transformers, the Poll bids were received: Trio Electric Company, Pensacola $ 89,700,00 ea Turner Supply Company, Mobile 90,885*00 ea McGraw -.Edison, Gulf Breeze, Fla. 92,000,00 ea Moore -Handley, Mobile 95,461,00 ea RTE-ASEA Corp., Waukesha, Wise. 57,173.00 ea Motion by Councilman Ed Bishop seconded by Councilman Barney Shul: that City accept low bid, subject to bid. meeting specifications as reviewed by Mr. St, John, Engineer. Motion carried. Motion by Councilman Ed'Bishop seconded by Councilman H. G. Bishol that the Mayor be authorized to sign petition to Federal Power Commission as recommended by Engineer. Motion -,carried, Councilman H. G. Bishop introduced the following Ordinance No. 502 as amended: ORDINANCE NO. 502 AN ORDINANCE ESTABLISHING MINIMUM METER DEPOSITS FOR GAS AND WATER SERVICE, PRIOR TO THE TIME THE SERVICES ARE INSTALLED BY THE CITY OF FAIRHOPE, ALABAMA, AND AN ORDINANCE REQUIRING A $25.00 DEPOSIT FOR TEMPORARY HOOK-UPS FOR CONTRACTORS, AND AN ORDINANCE REPEALING ANY AND ALL ORDINANCES IN CONFLICT HEREWITH. �h BE IT ORDAINED BY THE CITY' COUI ?C IL OF THE CITY OF FAIKHOPE, ALABAMA AS FOLLOWS: SECTION 1. There is hereby established a 610.00 meter dep- osit for any and all gas'met'ers installed by the City of Fairhope, Alabama prior to the connection of any gas service. T SECTION 2. There is hereby established a 10.00 meter dep- osit for all water meters installed by the City of Fairhope prior to the connecting for water service. SECTION 3. There is hereby established a $15,00 service charge for restoration of service when the service hasbeen dis- connected for nonpayment of account, and this penalty is in add- ition to the customer paying the full payment of any past due accounts and penalties. eeSECTION 4. There is hereby established a 025.00 connection de�gSs�� for temporary service for any temporary, service ,installed. by the City of Fairhope, Alabama SECTION 5• All ordinances in conflict herewith, be, and the same are hereby repealed. ADOPTED THIS THE 26th day Attest : City Clerk Councilman H. G. Bishop moved that all rules governing the ;Council which might, unless suspended, prevent. the passage and adoption of the ordinance at this meeting, be and the same are hereby suspended for the purpose of permittin4 the said ordin- ance to be finally passed and adopted at this meeting. Councilman Sam E. Box seconded the motion. The question was put before the council and on roll call the vote was as follows: Yea: Councilmen ,Ed Bishop, H. G. Bishop, Sam E. Box, 011ie E. Deese and Barney L. Shull. Nays: None. Motion adopted by unanimous vote of the council, Councilman H. G. Bishop moved that said Ordinance No. 502 be finally passed and adopted as introduced. Councilman Sam E,• Box seconded the motion.The question of final passage and adoption of said ordinance was put to vote of the council with the following results: Aye: Councilmen: Ed Bishop, H. G. Bishop, Sam E. Box, 011ie E. Deese and Barney L, Shull. Nay: None. Motion carried and Ordinance IJo, 502 adopted. Ivbtion by Councilman H. G. Bishop seconded by Councilman Barney L, Shull that the City set up Savings Accounts for all meter deposit; collected from this date. Notion carried, Notion by Councilman Box seconded by Councilman Shull that the Resolution authorizing paying ambulance fees to a private busines for services rendered to indigent patients who live within the corporate limits of the City of Fairhope, Albama, introduced at the regular meeting of February 129 1973 be adopted as introduced Notion carried. Notion by Councilman H. G. Bishop seconded by Councilman Ed Bi that Barney Shull be reappointed to the Recreation Board for a five (5 ) year term ending March, 1978.. Motion carried.i ?.I :i 'r Mayor James P. Nix recommended the reappointment of Mr. Payton Walker to the Fairhope Medical Board and upon motion by JCouncil- man Sam Box seconded by Councilman Barney Shull, Mr. Walker was unanimously reappointed. Motion by Councilman Barney Shull seconded by Councilman Sam Box that the City release grant funds granted to the City for the purpose of defraying part of the costs of constructing a Municipal Golf Course on property tentatively offered to the City by Mr. Radcliff which offer has now been withdrawn and fundsca.nnot be used on any other property or for any other purpose. Notion carried. This being date set for opening bids on Tractor -Mower, the follow- ing bids were received: 4 Foley Tractor Co., $39998.50 Carl Grant Tractor Co. 39672.00 Motion by Councilman Barney Shull seconded by Councilman Ed Bishop that the City accept low bid provided bid meets specifica- tions. Motion carried. Motion by Councilman Barney Shull seconded by Councilman 011ie Deese that the City place a full page color ad in the Fairhope Courier for ,Arts and Craft week. Motion carried. Motion by Councilman Sam Box seconded by Councilman Ed Bishop that the City accept low bids of Carloss Well Suppl Company, 111 North Parkway, Memphis, Tenn, in the amount of il659090-00 for Division I and Smith and Overstreet, P. 0. Box 68, Satsuma, Alabama in the amount of 01679705.,08 for Division II for Water System Expansion, WS-ALA-149. Motion carried. Request for donation to the Ameraport Corporation was held for next regular meeting of the Council., M Motion by Councilman Barney Shull seconded by Councilman Sam Box that the City accept proposal of Middle Bay Land Company for sewer collection system for proposed subdivision adjacent to and north of Park Terrace Subdivision within the City Limits of Fairhope.
