COUNTY OF BALDWIN
We, the undersigned members of the City Council of the City of
Fairhope, Alabama, hereby waive notice of the calling of a
special meeting of the Council for the purpose of reconsidering
the action taken by the Council at their regular meeting of
December 8, 1969 pertaining to the case of Thomas E. Dyer vs
Board of Zoning Adjustment and Appeals of the City of Fairhope,
Alabama, and do consent that said meeting for said purpose be
held at the City Hall in the City of Fairhope, Alabama at 5:00
P.M. on the 12th day of December, 1969.

COUNTY OF BALDWIN
The City Council of the City of Faairhope met in special session
at the City Hall, Friday, December 12, 1969 at 5:00 P.M. with
the following members present: Mayor R. C. Macon, Councilmen:
James P. Nix, Robert H. Cowen, henry G. Bishop, John A. Robertson
and Sam E. Box.
Each member present signed waiver of notice of calling and hold-
ing of the special meetings
Mayor Macon announced that the purpose of the meeting was to
reconsider the action taken at the regular meeting of December
89 1969 pertaining to the case of Thomas E. Dyer vs Board. of
Zoning Adjustment and Appeals of the City of Fairhope, Alabama,
and stated that the meeting was open for discussion.
After general discussion, Councilman Bishop moved , seconded by
Councilman Box, that the Council rescind the following motion
made at the regular meeting of December 8, 1969:
"Motion by Councilman Robertson seconded by Councilman
Cowen that the City Attorney be instructed not to
defend the City in Circuit Court in the case of Thomas
E. Dyer, Appelant vs Board of Zoning Adjustment and
Appeals of the City of Fairhope, Alabama, Appellee.
Upon „being put to vote the following vote was record-
ed: rVoting Aye: Councilmen: Robertson, Cowen, Nix and
Bishop. Voting Nay: Councilman Box and Mayor Macon.
Motion carried."
Mayor Macon then called for a vote on Councilman Bishop's motion
to rescind action of the Council with the following results:
Voting A30 Mayor Macon, Counclmen: Box and Bishop. Voting Nay:
Councilmen: Robertson, Cowen and Nix. The Mayor stated that
the vote created a tie and cast a second vote)for the motion
to break the tie and the motion was carried.
Motion by Councilman Nix seconded by Councilman Robertson that
the meeting adjourn. Motion carried.
