COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular session
at the City Hall, Monday, December 8, 1969 at 7:30 P.M. with
the following members present= Mayor R. C. Macon, Councilmen:
James P. Nix, Robert H. Cowen, Hdnry G. Bishop, John A.- Robertson
and Same E. Box.
Minutes of the previous regular meeting were approved.

Motion by Councilman Nix seconded by Councilman Box that Ordinance
No. 427, Authorizing signature on deposit refunds up to $50.00,
introduced at the regular meeting -of November 25, 1969, be adopt-
ed as introduced. Notion carried.
This being date set for opening bids on Rescue Wagon, only one
bid being received from Gaston Motor Co., in the amount of
$39188.86. Motion by Councilman Bishop seconded by Councilman
Nix that the City accept bid of Gaston Motor Company subject
to bid meeting specifications. Notion carried.
Motion by Councilman Bishop seconded by Councilman Cowen that
$119000,00 be transferred from Gas Gross Revenue Account to the
Beach and Pier Account to make 0509000.00 payment plus $1,781.25
interest on General Obligation Note. Notion carried.
Motion by Councilman Nix seconded by Councilman Box that City
place $150.,00 Ad with Jaycees. Motion carried.
Motion by Councilman Nix seconded by Councilman Robertson that
City Employees be given $20.00 Christmas bonus. Notion carried.
Motion by Councilm;an Robertson seconded by Councilman Nix that
the following Resolution be adopted. Motion carried.
RESOLUTION
WHEREAS, the City of Fairhope now has in existence an
agreement between the City -of Fairhope and the Highway Departmen t
of the State of Alabama for certain improvements on North Section
Street and Fairhope,Avenue in Fairhope, Alabama, and
WHEREAS, the present Mayor and Council ar now desirous
of proceeding to obtain the necessary rights -of -way on North
Section Street and Fairhope Avenue in Fairhope, Alabama, and
WHEREAS, it is expedienttD retain the services of John V.
Duck, Attorney at Law, in Fairhope, Alabama to complete his part
of obtaining the right-of-way, filing the necessary condemnations
and any and all other proceedings necessary to obtain all rights -
of -way on North Section Street and Fairhope.
NOW, THEREFORE, BE IT RESOLVED that this Mayor and. Council
retain the services of John V. Duck on an hourly basis as follows:
20.00 per hour on all productive work in his office, and
25.00 per hour on all productive work outside of his office.

Motion by Councilman Nix seconded by Councilman Box thathe City
accept low bid of Ruffles Company for heating and Air Condition-
ing Snack Bar at the Marina. Upon being put to vote the follow-
ing vote was recorded: Voting Aye: Councilmen: Nix, Box and Cowen.
Voting Nay: Councilmen: Bishopand Robertson. Motion carried.
Notion by Councilman Robertson seconded by Councilman Cowen that
the City Attorney be instructed not to defend the City in
Circuit Court in the case of Thomas E.� Dyer, Appelant vs Board of
Zoning Adjustment and Appeals of the City of Fairhope, Alabama.
Appellee,! Upon being put to vote the following vote was recorded
Voting Aye: Councilmen: Robertson, Cowen, Nix and Bishop.
Voting Nay: Councilman Box and Mayor Macon. Motion carried.'
Motion by Councilman Bishop seconded by Councilman Cowen that the
bill of Moore Engineering Company in connection with 4-Lane of
Section Street and Fairhope Avenue'in the amount of $6,216.06
be approved for payment. Motion carried.
Motion by,Councilman Nix seconded by Councilman Bishop that
Councilman Box and City Superintendent be authorized to proceed
with necessary steps to clean and paint water treatment plant
on Ingleside Avenue. Notion carried.
It was duly moved and seconded that the meeting adjourn., Notion
carried.
