COUNTY OF BA LDWI N
The City Council of the City of Fairhope, Alabama, met in regular
session at the City Hall, Tuesday, November 25, 1969 at 7:30 P.M.
with the following members present: mayor R. C. Macon, Councilme
James P. Nix, Robert H. Cowen, Henry G. Bishop, John A. Robertson
and Sam E. Box.
Minutes of the previous regular meeting were approved.
Motion by Councilman Robertson seconded by Councilman Box that
Ordinance No. 425, An Ordinance Amending Zoning Ordinance 295,
Section 13, District Boundaries, introduced at the regular meetinc
of November 10, 1969 be adopted as introduced. Motion carried.
Motion by Councilman Cowen seconded by Councilman Box that Or
dinance No. 426, An Ordinance Amending Zoning Ordinance No. 295,
Section 13, District Boundaries, introduced at the regular meetinc
of November 10, 1969 be adopted as introduced. Motion carried.
Motion by Councilman Bishop seconded by Councilman Cowen that Mayc
Macon be authorized to negotiate for purchase of lots for Electric
sub -station. Motion carried.

Motion by. Councilman Robertson seconded by Councilman Box that
oral bid of Westinghouse for Electric equipment not be accepted.
Motion carried.
This being date set for opening bids on Electric equipment, the
following bids were received:

Motion by Councilman Nix seconded by Councilman Robertson that
City accept low bid of Trio Electric Company, subject to Engineers
recommendation. Motion carried.
Motion by Councilman Box seconded by Councilman Robertson that
bills submitted by Mr. Ernest Bailey in the amount of $640.00 and
Mr. Richard Lacey in the amount of $930.77 be approved for pay-
ment. Motion carried.
Motion by Councilman Nix seconded by Councilman Cowen that the 13-i
Committee appointed to draw up specifications for Rescue Wagon
be authorized to get bids. Motion carried.
Motion by Councilman Box seconded by Councilman Cowen that City
accept bill for replacing floor in Snack Bar on Municipal Pier
as required by Health Department. Councilman Robertson opposed.
Motion carried.
Motion by Councilman Bishop seconded by Councilman Box that the
City join with Mobile and surrounding Cities in protest to gas
rate increase and that $350.00 be allocated as City's share of
expense. Motion carried.
Motion by Councilman Robertson seconded by Councilman Cowen that
the following Resolution be adopted and that copies be mailed to
District Engineer, Director of State Highway Department in Mont-
gomery and to the Honorable Albrewer, Governor of Alabama. Motion
carried.
RESOLUTION
WHEREAS: The State of Alabama has completed a portion
of U.S. #98 from Alabama #104 north towards Spanish Fort, and it
is in the best interests of the City of Fairhope, Alabama to pro-
vide for a future planned thoroughfare system.
THEREFORE: Be it Resolved That The City of Fairhope,
Alabama request that the Alabama State Highway Department proceed
with the proposed 4-lane extension of U.S. #98 along Greeno Road
South from Alabama #104 to Morphy Avenue.
Motion by Councilman Box that Mr. Henry Nix be nominated to fill
vacancy on Adjustment Board, motion seconded by Councilman Robert-
son. There being no further nominations, on vote the motion was
unanimously carried.
Councilman Bishop offered the following Ordinance for introductio
ORDINANCE NO. q-27
BE IT ORDAINED BY THE CITY COUNCIL of THE CITY OF
FAIRHOPE that the First National Bank of Fairhope be authorized
to honor checks drawn by the City Clerk on the City of Fairhope
General., Gas and Water account in sums of not more than FIFTY
(950.00) DOLLARS and that the City Clerk be authorized to draw
checks for sums not over FIFTY ($50.00) DOLLARS for refund for
utility deposits only, and that a copy of this Ordinance be
furnished the First National Bank of Fairhope where this account
is now kept.
Motion by Councilman Nix seconded by Councilman Robertson that
Councilman Bishop be authorized to sign checks drawn on the First
National Bank of Fairhope in the absence of mayor Macon, notion
carried.
Councilman Robertson offered the following Ordinance for intro-
duction:
GRADE ORDINANANCE NO. Y,��
AN FIORDINANCE FIXING AND ESTABLISHING THE GRADE OF A
CERTAIN PORTION OF SIMON STREET, PATLYNN DRIVE, WOODLANE COURT,
EVERGREEN STREET, NORTH `INGLESIDE AVENUE, FORSTER AVENUE, OSWALT
STREET, COLE COURT, KUMQUAT STREET, RONFORTH DRIVE, WILFRED DRIVE,
KURLANE DRIVE AND LAUREL STREET.
BE IT ORDAINED by the City Council of the City of Fairhope, Alaba
as follows:
SECTION 1 - That the grade of Simon Street, Patlynn Drive, Laurel
Street, Woodlane Court, Evergreen Street, North Ingleside Avenue,
Forster Avenue, Oswalt Street, Cole Court, Kumquat Street, Ron -
forth Drive, Wilfred Drive and Kurland Drive, be, and the same ar
hereby fixed and established as shown on the plans heretofore ex-
hibited to the City Council and now on file and open for inspecti
in the Office of the City Clerk.
SECTION 2 - That this Ordinance shall be published in the Fairhop
Courier, a newspaper published and of general circulation in the
City of Fairhope, Alabama.
ADOPTED THIS THE DAY OF 19
Letter from R. Roy Reynolds pertaining to pecan dust from Schermer
Pecan Company was read and discussed. Motion by Councilman Robert
son seconded by Councilman Bishop that letter be referred to Board
of Zoning Adjustment for action under Ordinance No. 295, Section 6
Motion by Councilman Bishop seconded by Councilman Robertson that
the following Resolution be adopted. Motion carried.
RESOLUTION
WHEREAS: The City of Fairhope, Alabama entered into an
agreement with the State of Alabama, State Highway Department on
April llth, 1968 to cooperate in the improvement of Section Street
from Fairhope Avenue north to Creek Drive and Fairhope Avenue from
Section Street to Greeno Road in the City of Fairhope.
THEREFORE: Be It ReBolved That The City of Fairhope
initiate the necessary action to complete its portion of agreed
upon work (that is make surveys and plans, acquire rights -of -way
and make necessary alterations in utilities) in -order that the
Alabama State Highway Department can proceed with advertising for
bids.
Mayor Macon then appointed Councilmen Bishop and Robertson as
committee to meet with the Mayor on above Resolution.
It was duly moved and seconded that the meeting adjourn. Motion
carried.
