COUNTY OF BALDWI N
The City Council of the City of Fairhope met in regular session at
the City Hall, Monday, may 12, 1969 at 7:30 fP.M., with the follow-
ing members present: Mayor Macon, Councilmen: Bishop, Box, Cowen,
Nix and Robertson.
Minutes of the previous regular meeting were approved.
City Superintendent reported that City has a 60 foot right-of-way
on Bay View Avenue. Motion by Councilman Robertson seconded by
Councilman Cowen that whenever it is feasible the City plans to
utilize their property on Bay View Avenue and suggest that people
on either side of Bay View Avenue from Magnolia Avenue North, take
notice. Motion carried.
;Motion by Councilman Bishop seconded by Councilman Robertson that
Council accept report of Ack Moore, Engineer on disposal plant and
authorize him to send necessary diagrams to Health Department for
approval. Motion carried.
Motion by Councilman Robertson seconded by Councilman Bishop that
City approve request of St. James Church for off street paving.
(Motion carried.
Mr. Huet, Municipal Harbor Board, reported on progress being made
in dredging of Fly Creek.
This being date set for opening bids on 35 X 75 foot swimming pool,
the following bids were received:

Trojan Pools
$36,152.00
$36,250.00
Motion by Councilman Cowen seconded by Councilman Robertson that
City accept low bid of Modern Industries for 35 X 75 foot swimming
pool to be installed at Young Street Recreation Center. Motion
carried.
Motion by Councilman Box seconded by Councilman Cowen.that the
Mayor and City Attorney be authorized to negotiate with the First
(National Bank of Fairhope for a loan of $200#000.00 which will be
a General Obligation of the City and is to be used for completion

of new municipal Pier. It is further authorized to have Bond At-
torneys furnish the Lending Agent as to the validity of the loan
and to draft necessary Resolutions. Upon being put to vote the
following vote was recorded: For: Councilmen Box, Cowen, Robert-
son, and Nix. Against: None. Councilman Bishop abstained from
voting. motion carried.
This being date set for opening bids on 300 amp. Welding machine
and alternate bid on 200 amp., the following bids were received.

Motion by Councilman Robertson seconded by Councilman Box that
City accept bid ofi Welding Engineering Supply Company on 300 Amp.
Welding machine in the amount of $1,554.65. motion carried.
This being date set for opening bids on 46 treated poles and 165
treated pilings, the following bids were received:

Motion by Councilman Nix seconded by Councilman Robertson that Cit,
accept low bid of Gulfport Creosoting Co., in amount of $49844.45
for 46 treated poles and 165 treated piling. motion carried.
Motion by Councilman Robertson seconded by Councilman Bishp that
$500.00 be authorized for fireworks display for July 4th, 1969.
Motion carried.
Motion by Councilman Bishop seconded by Councilman Nix that the
following Ordinance be introduced.
ORDINANCE NO. 417
WHEREAS, there is a tendency of the Public to discard
food and drink containers when served in public places, and Where-
as glass containers which are thrown or which fall off the munici-
pal pier create a serious hazard to bathers in the vicinity of the
pier, now, therefore;
BE IT ORDAINED BY THE CITY COUNCIL OF FAIRHOPE, ALABAMA
THAT the possession of glass food or drink containers on the muni-
cipal pier is a misdemeanor and the possession of said containers
shall be a misdemeanor and any person, upon conviction thereof,
shall be punished by a fine of not more than One Hundred ($100.00)
Dollars.
This Ordinance shall go into effect on publication.
Councilman Bishop moved that all rules governing the Council which
might, unless suspended, prevent the passage and adoption of the
Ordinance at this meeting, be and the same are hereby suspended
for the purpose of permitting the said Ordinance to be finally pas.

Mayor Macon, Councilmen: Bishop, Box, Cowen, Nix and Robertson.
INay: None. Motion carried; Councilman Box moved that said Or-
dinance No. 417 be finally passed and adopted as introduced. Counc:
man Nix seconded the motion. The question of final passage and
ladoption of Ordinance No. 417 was put to vote of the Council with
the following results: Yea, Mayor Macon, Councilmen: Bishop, Box,
Cowen, Nix and Robertson, Nay: None. Mayor Macon then declared
the Ordinance finally passed and adopted.
Motion by Councilman Box seconded by Councilman Cowen that the
bills be approved for payment. Motion carried.
Motion by Councilman Robertson seconded by Councilman Cowen that
Aust-Ponder Engineering and Survey be authorized to complete plans
for the Street Improvement authorized at Council meeting of Feb. 21
1969. Upon being put to vote the following vote was recorded:
For: Councilmen Robertson and Cowen. Against: Councilmen`Bishop,
Box and Nix. motion defeated.
Councilman Nix reported that the power will be off on may 22 from
12 midnight until 4:00 A.m., to allow Alabama Power Company to
do necessary maintenance on sub -station in Foley.
It was duly moved and seconded that the meeting adjourn. motion
carried.
