HomeMy WebLinkAbout05-27-1968 Special MeetingThe undersigned Mayor and Councilmen of, the City of Fairhope, Alabama, hereby waive notice of the calling and holding of a special meeting of the Fabhope City Council to be held at the City Hall, Monday, - May 27, 1968 at P.M. for the purpose of taking necessary action on ordinances pertaining ;to the City, and agree and consent that said meeting shall be held at such time and for such purpose. STATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope, Alabama, met in special session at the City Hall, Monday, May 27, 1968 at 9:30 P.M. with the following members present: Mayor R. C. Macon, Councilmen: Spader, Reynolds, Stipes, Gaston and Stine. Each member present having signed waiver of notice and calling of special meeting, mayor Macon called the meeting to order stating that the purpose of the meeting was discussion and taking necessary action on Ordinances of the, City. Councilman Stipes introduced Ordinance No. 398 which was read at length. Councilman Stine moved that all rules governing the Coun- cil, which might, unless suspended, prevent the passage and adopt- ion of the Ordinance at this meeting, be and the same are hereby suspended for the purpose of permitting the said Ordinance to be finally passed and adopted at this meeting. Councilman Gaston seaaaded the motion. The question was put before the Council and on roll call the vote was as follows: Yea: Mayor Macon, Council- men: Spader, Reynolds, Stipes, Gaston and Stine. Nays: None. Mayor Macon then declared the motion adopted by unanimous vote of the Council. Councilman Gaston moved that Ordinance No. 398 be finally passed and adopted as,introduced. Councilman Spader seconded the motion. Mayor Macon put the question of final passage and adoption of said Ordinance to vote of the Council and on roll call the results were as follows: Yea: Mayor Macon, Counci: men: Spader, Reynolds, Stipes, Gaston and Stine. Nay: None. The Mayor announced that the vote was unanimous and declared Ordinance No. 398 finally passed and adopted. Councilman Spader introduced Ordinance No. 399 which was seconded by Councilman Stipes and read at length. Councilman Stipes moved that all rules governing the Council, which might, unless suspend- ed, prevent the passage and adoption of the Ordinance at t4is meeting, be and the same are hereby suspended for the purpose of permitting the said Ordinance to be finally passed and adopted at j this meeting. Councilman Gaston seconded the motion. The question was put before the Council and on roll call the vote was as follows: Yea: Mayor Macon, Councilmen: Spader, Reynolds, Stipes, Gaston and Stine. Nay: None. Mayor Macon then declared the motion adopted by unanimous vote of the council: Councilman Stine moved that Ordinance No. 390 be finally passed and adopted as introduced Councilman Gaston seconded the motion. Mayor Macon put the quest- ion of final passage and adoption of said Ordinance to vote of the Council and on call of the roll the results were as follows: Yea: Mayor Macon, Councilmen: Spader, Stipes, Reynolds, Gaston and Stine. Nay:414one. The Mayor announced that the vote was unanimous and declared the Ordinance finally passed and adopted. It was duly moved and seconded that the meeting adjourn. BE IT ORDAINED by the City Council of the City of Fairhope, Alabama: SECTION 1 - Whenever, in .the judgment of the Mayor, or in the event of his inability toact, the president pro tem of the Council determi.nes than an emergency exists as a result of mob action or other civil disobedience causing danger of injury t or damage to persons or property, he shall have power to impose by proclamation any or all of the following regulations necessary to preserve .the peace and order of the city: (a) To impose a curfew upon all or any portion of the city,.thereby.requiring all persons in such designated curfew areas to forthwith remove themselves from the public streets, alloys, parks or other public places; provided, however, that physicians, nurses and ambulance operators performing medical services, utili y personnel maintaining essential public services, firemen and city authorized or requested law enforcement officers and personnel ma be exempted from such curfew. (b). To order the closing of any business establishments anywhere within the city for the period of the emergency, such businesses to include, but not limited to, those selling intoxi- cating liquors, cereal malt beverages,.gasoline, firearms and ammunition. (c.) To designate any public street, thoroughfare or vehicle parking areas closed to motor. vehicles and pedestrian traffic. (d) To call upon regular and auxiliary. law enforcement agencies and organizations within or without the city to assist in preserving and keeping the peace within the city. SECTION 2 - The Proclamation of Emergency provided herein shall become effective upon its issuance and dissemination to the public by appropriate news media. SECTION 3 - Any emergency proclaimed in accordance with the provisions of this .ordinance shall terminate after forty-eight (48) hours from the issuance thereof, or upon the issuance of a proclamation determining an emergency no longer exists, whichever occurs first; provided, however, that such emergency may be exten- ded for such additional periods of time as determined necessary b3 resolution of the governing body. SECTION 4 - Any person who shall willfully fail or refus( to comply with the orders of duly authorized law enforcement officers or personnel charged with the responsibility of enforcinc the Proclamation of Emergency authorized herein shall be deemed guilty of a misdemeanor, and upon conviction therefor, shall be punished by a fine of not more than One Hundred Dollars ($100.00) or by imprisonment in the city jail for a period of not to exceed six (6) months, or by both such fine and imprisonment. SECTION - This ordinance shall take effect and be in full force from and after its paccana- ADOPTED this they ;t-,�e, da ATTEST: C TY CLERK ORDINANCE NO. % AN ORDINANCE TO ESTABLISH A RESERVE POLICE FORCE WITHIN THE POLICE DEPARTMENT OF THE CITY OF FAIRHOPE, FAIRHOPE, ALABAMA: BE.IT ORDAINED by the City Council of the City of Fairhope. Fairhope, Alabama: SECTION 1 - A police reserve force, hereinafter called Reserve, is hereby established within the Police Department of the City of Fairhope. The Reserve shall consist of not more than members, each of whom shall be a male resident of the City of Fairhope, and who shall be in good physical condition; of good character and not less than 21' years of age. Appointment! to the Reserve shall be made by the Police Chief with the approva'. of the Mayor. Such appointments shall be made for a two year terr except that any member of the Reserve may be discharged without cause, and without hearing, by the Chief of Police with the ap- proval of the Mayor. SECTION:2 - All members of the Reserve shall take and subscribe to the same oath required of regular police officers of the City of Fairhope immediately upon accepting their appointment, SECTION 3 - The Reserve shall function under the immedi- ate direction of the Chief of Police, who shall provide for its organization and training. The Chief of Police is hereby author- ized and directed to establish such rules and regulations as may be necessary for the efficient operation of the Reserve. SECTION:4 - Each member of the Reserve shall be issued an identification card signed by the Chief of Police and the Mayor which he shall carry with him at all times. Whenever a member of the Reserve shall be called to active duty he shall be issued a badge and a cap which he shall wear in the manner pre- scribed by the Chief of Police at all times while on active duty. Upon the completion of each tour of active duty, members of the Reserve shall turn in their badges and caps at Police Headquarter I5, SECTION 5 - The general duties, rights, privileges and authority of each member of the Reserve shall, during his hours of active duty, be the same as those of the regular police force of the City of Fairhope. On each tour of active duty members of the Reserve shall serve for the hours and within the limits and for the purposes prescribed by the Chief of Police. Each member during his time on active duty shall have the right to carry a concealted gun about his person, to make arrests, and otherwise perform the duties of a regular police officer. SECTION 6 - Members of the Reserve shall be called to active duty by the Chief of Police with the written consent of the Mayor. SECTION 7 - No member of the Reserve shall receive com- pensation for time required by Reserve rules and regulations whil( not on active duty. Each member of the Reserve shall be paid whai ever remuneration shall be approved by the City Council on an hourly rate, if any. Members of the Reserve may be compensated for any reasonable expenses incurred in the performance of officii duties while on active duty on approval of an expense voucher by the Chief of Police, and approved by the Mayor. Each member of the Reserve may be compensated for official use of his privately - owned automobile at the rate of ten cents per mile while on active duty, which shall be approved by the Chief of Police and Mayor. All vouchers for compensation for expenses shall be sworn to by the member of the Reserve seeking reimbursement befor, it shall be considered for payment. Section 8 - It shall be a misdemeanor for any person not a member of the Reserve to wear, carry, or display a Reserve identification card, badge, or cap, or in any way to represent himself to be connected with the Reserve. Section 9 - Any person found guilty of violating the provisions of Section 8 of this ordinance shall upon conviction be fined in an amount not exceeding $1.00.00, or sentenced to dl imprisonment for not exceeding 180 days, either or both, at the discretion of the court trying the cause. SECTION 10 - This ordinance shall become effective im- mediately upon its passage. ADOPTED this '---) day ATTEST: ITY CLERK
