The CityCouncil of the City of Fairhope met a �ity Hall,

Monday, may 27, 1968 at 7:30 p.m., with the following members
present: mayor Macon, Councilmen: Spader, Reynolds, Stipes, Gaston
and Stine.
Minutes of previous regular meeting were approved.
Reverend Dodson, on behalf of the Jaycees, requested City to place
ad in their Water Festival Pamphlet. Motion by Councilman Stipes
seconded by Councilman Reynolds that the City take a two page ad ii
the Water Festival Pamphlet. Motion carried.
Motion by Councilman Stipes seconded by Councilman Reynolds that
the City build double boat ramp with double walk ways at the end o1
Pier Avenue and that Mr. Manders be hired to build same using city
labor where feasible. Motion carried.
Motion by Councilman Stine seconded by Councilman Reynolds that
the following Ordinance be intorduced:
ORDINANCE NO. 400
An Ordinance to amend Section 5-41 Fire Districts Established;
of the Code of Ordinances of the City of Fairhope, Alabama by re-
pealing (b) Fire District No. 2.
Be It Ordained By The City Council of the City of Fairhope,
Alabama that Section 5-4 (b) of the Code of Ordinances of the
City be repealed.
(b) Fire District No. 2, Fire District No. 2 shall comprise a]
the territory within the corporate limits of the City not embraced
in fire district Now 1.

Motion by Councilman Spader seconded by Councilman Stine that
Supt. evaluate bids and accept low bid. Motion carried.
Motion by Councilman Spader seconded by Councilman Gaston that bil
of John Duck, Attorney, and Circuit Court on Escrow money disburse
ment be approved for payment. Motion carried.
Motion by Councilman Stine seconded by Councilman Gaston that the
following Resolution be adopted: Motion carried.
RESOLUTION NO. 320
A RESOLUTION CONFIRMING IMPROVEMENT ORDINANCE NO. 395 ADOPTED
MAY 13, 1968.
BE IT RESOLVED by the City Council of the City of Fairhope,
Alabama as follows:
SECTION 1 - That upon evidence presented to and considered by
it, the City Council does hereby make a finding and determination
of the following facts:
(a) At a regular meeting of the City Council of the City of
Fairhope, Alabama held on the 13th day of May, 1968, improvement
Ordinance No. 395 was adopted and notice of the adoption of said
Ordinance was given by publication of said ordinance in the Fair -
hope Courier, a newspaper published in and of general circulation
in the City of Fairhope, Alabama in the issued of April 25 and
May 2nd, which said ordinance stated that the City Council of the
City of Fairhope, Alabama would meet on the 13th day of May, 1968
at 7s30 p.m., at the City Hall in the City of Fairhope to hear any
objections, remonstrances or protests that might be made against t
said improvements, the matter of making the same, or the character
of the materials to be used.
(b) A copy of said improvement ordinance No. 395 was sent by
registered mail, postage prepaid, to each of the persons last as-
sessing for city taxation, the property proposed to be assessed
for said improvements, at their last known addresses; said notices
having been mailed on the 2nd day of May, 1968, more than ten days
prior to the 13th day of May, 1968.
(c) The protests and objections of persons owning property on
North Section Street from Fairhope Avenue to the centerline of
North Creek Drive in the City of Fairhope, Alabama, namely Mr.
Marren, Mr. Roberts and Mr. Davis representing Art Association,
Mr. J. D. Wade, Dr. C. G. Godard, Mr. 0. A. Martens, Mr. Stanley
Kasuba, Trailway Oil Company by Mrs. Stewart, written protest of
Mrs. Austine P. Barbour and written protest by Fairhope Single
Tax Corporation were heard, considered and disallowed.
(d) No further protests, objections or remonstrances against
the said improvements, the manner of making the same, or the chara
ter of materials to be used have been filed in wirting with the
City Clerk or in her office or have been made at this meeting.

SECTION 2 - That the said Ordinance No. 395 entitled "An
Ordinance to provide certain improvements on Section Street
running from at its intersection of Fairhope Avenue north to
the centerline of North Creek Drive in the City of Fairhope,
Alabama,";, is hereby in all things ratified and confirmed.

Motion by Councilman Stine seconded by Councilman Stipes that City
Attorney be authorized to negotiate with J. Dudley Wade and other
property owners for obtaining right-of-way on Fairhope Avenue and
Section Street and further authorized to hire an appraisor on pro-
perty to be condemned for Street Improvements. motion carried.
Motion by Councilman Stipes seconded by Councilman Stine that the
money received from escrow on the Casino and any retroactive monies
received from the parks project be placed in a Pier construction
account. Be it further moved that in order to provide for a mini-
mum delay in proceeding with the pier project, payment for services
previously approved by the Council for BOR Project No. 01-000-16
be paid by the City from this construction account. motion carried
Motion by Councilman Gaston seconded by Councilman Stine that up
to $500.00 be authorized for the Fire Department fireworks display
on July 4th. motion carried.
Motion by Councilman Stipes seconded by Councilman Gaston that the
application of Charlie Allen for building permit on Section and
morphy be approved as submitted. motion carried.
It was duly moved and seconded that the me g adjourn. motion
carried.
