COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular session
at the City Hall, Monday, April 89 1968 at 7:30 p.m., with the
following members present: Mayor Macon, Councilmen: Spader, Rey-
nolds, Stipes, Gaston and Stine.
Minutes of previous regular meeting were approved.
This being date set for public hearing on rezoning property on
N. E. Corner of Greeno and Morphy, the following protests were
heard: Mr. David V. Stroop and residents of Ingleside Heights
with Mr. Stroop as spokesman and Mrs. Flo Schneider, resident
of Greeno Road directly North of property to be rezoned. Mr.
Walter Wilson was spokesman in favor of rezoning.
Motion by Councilman Stine seconded by Councilman Reynolds that
the following Ordinance be adopted.
ORDINANCE NO.__.9./__
An Ordinance Amending Section 13 of Zoning Ordinance No.
295 By Rezoning the following described property from B-1 to B-2
as recommended by the Planning and Zoning Commission.
Be It Ordained by the City Council, of the City of Fairhope,l
Alabama, that Ordinance No. 2959 Section 13, District Boundaries,
be amended as recommended by the Planning and.Zoning Commission by,
rezoning the following described property from B-1 to B-2.
The South 208 feet of the West 466 feet
of the remainder of the NW j of the SW
of Section 16, Range 2 East after allow-
ing 20 feet on the South from Morphy Ave.,
and 40 feet on the Kest for Greeno Road.
This provides a net of 208 feet on Greeno
and 11 466 feet net on Morphy.
Councilman Stine moved that all rules governing the Council which
might, unless suspended, prevent the passage and adoption of the
Ordinance at this meeting, be and the same are hereby suspended.
Councilman Reynolds seconded the motion. Upon roll call, the
following vote was recorded: For: Councilmen: Spader, Reynolds,
Stipes, Gaston and Stine. Against: None. Councilman Stine then
moved that Ordinance No. 3q 1be finally passed and adopted as
introduced. Councilman Reynolds seconded the motion. Upon roll
call the following vote was recorded. Voting For: Councilmen:
Spader, Reynolds, Stipes, Gaston and Stine. Against: None. The
Mayor then declared the Ordinance finally passed and adopted.
The request of Preston Foy to build fence was tabled for next
meeting of the Council.
Motion by Councilman Reynolds seconded by Councilman Stipes that
City Superintendent check possibility of repairing present Chev-
rolet police car, if not possible, the City will advertise for
bids on new Police Car. Bids to be opened at next regular meeting)
of the City Council to be held on April 220 1968. Motion carried.'
Motion by Councilman Gaston, seconded by Councilman Stine that
request of Phillip Mitchell to sell packaged beer at Quic-Pic-
Grocery on Greeno Road be approved. Upon being put to vote, the
following vote was recordeds For: Councilmen Gaston, Stine and
Stipes. Against: Councilmen Reynolds and Spader. Motion carried.
Lotion by Councilman Reynolds seconded by Councilman Stipes that
City approve request for sealer at ramps at Municipal Airport
at an.approximate cost of $486.00 as requested by the Airport
Board. Motion carried:
Claim of Steve Rada was presented to the Council for action.
Motion by Councilman Gaston seconded by Councilman Stipes that
the claim of Steve Rada be denied and that the City Attorney be
authorized to write Mr. Rada's attorney stating that the claim
was denied by the City Council. Motion carried.
Motion by Councilman Reynolds seconded by Councilman Stine that
the claim of Mrs. Edith C. Bennett be denied. Motion carried.
Motion by Councilman Spader seconded by Councilman Stine that
the City approve $25.00 ad in Daphne May Day Association program.
Motion carried.
Motion by Councilman Spader seconded by Councilman Stine that the
bills be approved for payment. Motion carried.
Motion by Councilman Stine seconded by Councilman Gaston that
John Duck, City Attorney, be authorized to furnish legal infor-
mation to the Department of Housing and Urban Development to sup-
port application of the City. Motion carried.
Motion by Councilman Gaston seconded by Councilman Stipes that
City Attorney be authorized to proceed with obtaining right-of-
way for four -land, sidewalks, curb and gutter on Section Street
and Fairhope Avenue and to take whatever steps are necessary to
acquire right -'of -way. Motion carried.
Motion by Councilman Reynolds seconded by Councilman Spader that
the City Attorney, Mr. John Duck, be authorized to proceed with
assessing program for four -lane sidewalks, curb and gutter on
Section Street and Fairhope Avenue. Motion carried.
Motion by Councilman Spader seconded by Councilman Gaston that
the meeting adjourn. Motion carried.
