COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular session
at the City Hall, Monday, November 14, 1966 at 7:30 P.M. with the
following members present: Mayor Macon, Councilmen: Spader,
Reynolds, Stipes, Gaston and Stine.
The minutes of the previous regular meeting were approved.
Motion by Councilman Stipes seconded by Councilman Reynolds that
Ordinance #370, An Ordinance Amending Section 13 of Zoning Ordinanc
No. 295, be adopted as recommended by the Planning and Zoning
Commission and introduced at the regular meeting of October, 10
1966. Motion carried.
Motion by Councilman Reynolds seconded by Councilman Gaston that
the City hold referendum as follows:
Are you in favor of the City allocating $20,000
to make the swimming pool usable and open the pool?
Upon being put to vote the following vote was recoded: For:
Councilmen: Reynolds, Gaston, Spader and Stipes. Against: None.
Councilman Stine abstained from voting. Motinn carried.
The following bids were received on new Police Radio:
General Electric $ 745.00
Motorola 754.00
Motion by Councilman Stine seconded by Councilman Stipes that the
City accept low bid of General Electric. Motion carried.
Motion by Councilman Gaston seconded by Councilman Spader that
Mrs. Helen Dyson be reappointed to the Board of Managers of the
School of Organic Education for a three year period. Motion
carried.
Motion by Councilman Stine seconded by Councilman Stipes that
Mr. Richard Lacey be reappointed to the Airport Board for a two
year term. Motion carried.
Motion by Councilman Stipes seconded by Councilman Stine that
Mr. Shell be employed in the Water and Sewer Deparment at a
salary of $1.45 per hour. Motion carried.
Motion by Councilman Stine seconded by Councilman Reynolds that
Jack Kirk, City Superintendent, be authorized to hire truck driver
for Electric line truck at a salary of $1.45 per hour. Motion
carried.
Motion. by. Councilman Gaston seconded by Councilman Stine that the
bills be approved for payment. Motion carried.
Motion by Councilman Reynolds seconded by Councilman Gaston that
George Dyson and Martin Nelson be authorized to attend meeting
of Alabama Water and Pollution Control and the State Health
Department in Montgomery. Motion carried.
Motion by Councilman Spader seconded by Councilman Gaston that
bill of Dixie Laboratories, Byrd L. Moore and Company and Bouler
Contracting Company on 1966 Street Improvement Program be approved
for payment. Motion carried.

5,000.00 be transferred from the Electric Department to the
1966 Street Improvement Fund. Motion carried.
Motion by Councilman Stipes seconded by Councilman Stine that the
City look into the feasibility of setting up a budget for the
various departments of the City and that the Mayor appoint a
committee to work out the budget. Motion carried. The Mayor
then appointed Councilmen: Gaston, Spader and Stipes, Mr. John
Duck, City Attorney and C. B. Niemeyer, Exiecutive Assistant
Motion by Councilman Reynolds seconded by Councilman Stipes that
the following Resolution be adopted. Motion carried.

R E S O L U T I O N
WHEREAS, the City Council of the City of
Fairho is desirous of having certain improvements
made on FAS'Rt. 1269 in accordance with plans prepared
by the State Highway Department and designated as Project FAS-
106+03.63 Main Line
635(4) from station 82+00 Spur , and described as
extending from State Road Number 101
120+O9 Main Line
to the point of ending at station1O5+45•Sour for a total distance
1405.37 - Main Line 0.266 Main Line
of 2345 - Spur feet or 0.444 SpAiles.
WHEREAS, the State Highway Department of Alabama is desirous
of receiving Federal Aid for improvement of said highway; and
WHEREAS, the Bureau of Public Roads, an agency of the United
States of America will not participate in the construction of said,
project until and unless the City of Fairhope will agree
to refrain from permitting encroachments upon the right of way and
from passing ordinances or laws fixing a speed limit on said above
mentioned project contrary to those limits indicated in Title 36,
Code of Alabama 1940, as amended and until and unless the City of
Fairhope will agree to refrain from placing or
permitting the placing of any informational, regulatory, or warning
signs, signals, median crossovers, curb and pavement or other markings
and traffic signals without written approval of the State Highway
Department and the Bureau of Public Roads of the location, form and
character of such installations, and until and unless the City of
P irhope agrees to.: Adopt, under the authority of
Title 36, Section 48, Code of Alabama 1940, as amended by Section
48 of Act No. 517, General Acts of Alabama 1949, such traffic control
devices as deemed necessary to promote the safe and efficient
utilization of the highway and to enforce the same under the provi-
sions of Section 58(36) and Section 51, Code of Alabama 1940, as
amended by Act. No. 517, General Acts of Alabama 1949.

NOW, THEREFORE, be it resolved by the City Council
of the City of Fairhope , that for and in consideration of
the Alabama State Highway Department and the Bureau of Public
Roads, an Agency of the United States of America, constructing said
Highway and routing traffic along the same through the City of
Fairhope over said Project, it hereby agrees with the
Alabama State Highway Department and the Bureau of Public Roads, an
Agency of the United States of America, that on the above mentioned
project it will not in the future permit encroachments upon the right
of way; nor will it pass any ordinances or laws fixing a speed limit
contrary to those limits provided for in Title 36, Code of Alabama
1940, as amended; nor permit other than parallel parking in areas
where parking is permitted; nor will it allow the placing of any
informational, regulatory, or warning signs, signals, median crossovers,
curb and pavement or other markings, and traffic signals without written
approval of the State Highway Department and the Bureau of Public. Roads
of the location, form and character of such installations. The traffic
control devices installed upon completion of this project, as indi-
cated on the traffic control diagram which is incorporated in the
plans assembly for said project and which is made a part of this
agreement, Shall be in accordance with current accepted standards
adopted by the Highway Department of the State of Alabama and by
the Bureau of Public Roads. Subsequent traffic control devices
deemed necessary by the City to promote the safe and efficient
installation of the highway under the authority of Title 36, Section
48, Code of Alabama 1940 as amended by Act No. 517, General Acts of
Alabama 1945, shall have the approval of the Highway Department of
the State of Alabama and of the Bureau of Public Roads, and the
City further agrees that it will enforce the same under the provisions
of Title 36, Section 58(36) and 51, Code of Alabama 1940 as amended
by Act No. 517, General Acts of Alabama 1949.
It is understood and agreed that no changes in this agreement
shall in the future be made without having obtained the prior approval
of the Bureau of Public Roads.

the said project and intersecting streets for as long as necessary
while the said project is being graded, drained, paved and otherwise
improved.
The City Council

or pass such legally effective ordinances and/or laws as will

and to permanently deny or limit access and parking at certain
locations along said improvements, all of which are more specifi-

The Cityoins5'oi` further agrees for and on behalf of the
City of Falrbope to indemnify the State of Alabama,
the State Highway Director, the State Highway Department, its agents,
servants and employees from and against all manner of suits, claims,
actions, and/or causes in equity whatsoever that may arise or are
alleged to have arisen as a result of the grading, draining, paving,
and otherwise improving and constructing and barricading of said
project and intersecting streets while the State Highway Department
is grading, draining, paving and otherwise constructing same,
provided the State of Alabama, the State Highway Director and the
State Highway Department shall require any general contractor
grading, draining, paving or otherwise improving, constructing or
barricading said project or any intersecting streets to post a
good and sufficient bond of indemnity naming the City of
pa irtope
as one of the parties indemnified against
any wilful, wanton or negligent act of said general contractor,
his agents, servants, employees or subcontractors, or such
subcontractors' agents, servants or employees in and about the
constructing or barricading of said project or any intersecting
streets in said city.
