M. with the following members present: Mayor Macon, Councilmen: Reynolds, Stipes, Gaston and Stine. Councilman Spader being absent. The minutes of the previous regular meeting were approved. This being date set for receiving bids on tractor and equipment the following bids were received: Ford Machinery Sales Co., Inc. Oliver Industrial Tractor Model 550 and equipment. Kirk, Superintenden-ti for study and evaluation. Motion carried. Letter from the Harbor Board concerning recommendations on docking facilities at Fly Creek was read to the Council. After general discussion it was referred to the City Attorney. Dr. Mitchell met with the Council in reference to sale of the Casino property. Motion by Councilman Reynolds seconded by Coutncilman �S Ime that since the co dit ns of the Escrow agree - men were n et an acceptance or motion made bb Councilman Gaston at previous meeting was not accepted in th time allotted in the motion, the City isno longer obligated under either the Escrow agreement or the motion passed at the previous regular Council meeting. Upon being put to vote the following vote was recorded: For: Councilmen: Stine, Stipes, Gaston and Reynolds. Councilman Spader being absent. Motion carried. I ,t -2- Motion by Councilman Stine seconded by Councilman Stipes that T. A. Yoakum be given a one year contract at $L00.00 per month. Motion carried. Motion by Councilman Stipes seconded by Councilman Stine that Ordinance #368, An Ordinance Modifying, Amending and Confirming, As So Modified And Amended, IMPROVEMENT ORDINANCE NO. 364 Adopted the 28th day of June, 1966, introduced at the regular meeting of July 25, 1966 be adopted as introduced. Motion carri Motion by Councilman Gaston seconded by Councilman Stipes that t City donate $324.00 to the Volunteer Fire Department. Motion carried. Motion by Councilman Reynolds seconded by Councilman Stine that $25,000 from the Electric fund and $259000 from Gas fund be transferred to the General fund. Motion carried. Motion by Councilman Stipes seconded by Councilman Reynolds that the followinz Ordinance be introduced. ORDINANCE NO. 369 AN ORDINANCE AMENDING SEC. 15-1 OF THE CODE OF ORDINANCES OF THE CITY OF FAIRHOPE AS AMENDED BY ORDINANCE NO. 326, SEC. 15-1 BILLS - WHEN DUE AND PAYABLE; DELINQUENCY PENALTI All bills for electric, gas, water, sewer and garbage service owing to the City shall be due when services are billed and delinquent unless paid on or before 10 days after they are billed and unless paid on or before delinquency there shall he added to and collected as a part of such bills to defray the additional costs to the City resulting from such delinquencies, an additional sum of five per cent (5%) of the amunt of such bill, but not less than twenty five cents ($.25) for each delin- quent bill. Adopted this the 2LJday of 1966. APPROVED MAYOR ATTEST :_240,,_e-)� CITY CLERK Mr. Lipscomb met with the Council to discuss the possibility of a new Public Library for the City. The Council is unanimously in back of this and xz are looking for a site which would be accept- able to the State Library Board. Motion by Councilman Stine seconded by Councilman Reynolds that the bills be approved for payment. Motion carried. Motion by Councilman Reynolds seconded by Councilman Gaston that P�F @c;a'kgratories be employed as inspectors on 1966 St. Paving project at a cost of 2 % of total contract price. Motion carried Motion by Councilman Gaston seconded by Councilman Stipes that Bouler Contractingg Companybill in amount of $89910.36 and By�d.L. Moore & Co. bill in amount of $247.51 on 1966,Street Improvement be approved for payment. Motion carried. /X9 -3- Motion by Councilman Stipes seconded by Councilman Stine that the City Attorney find out why the money placed in Escrow in the First National Bank has not been placed back in the Electric Fund as voted by the City Council after conditions of the Escrow agreement were not met. Upon being put to vote the following vote was recorded: For: Councilmen: Stipes, Stine and Reynolds, Voting against: None., Councilman Gaston abstained from voting. Councilman Spader absent. Motion carried. Motion by Councilman Stipes seconded by Councilman Stine that the request of the Town of Daphne for assistance in repairing offices for the Community Action Program be denied and that a copy of the Resolution pertaining to Community Action Program adopted by the City Council at their regular meeting of June 27, 1966 be sent to Town of Daphne. Motion carried. Motion by Councilman Reynolds seconded by Councilman Gaston that John Duck, City Attorney, be authorized to close property trans- actions on proposed site of new sub -station. Motion carried. Motion by Councilman Reynolds seconded by Councilman Stipes that Jack Kirk, Superintendent, be authorized to purchase necessary surveyor equipment, cost not to exceed $800.00. Motion carried. Motion by Councilman Reynolds seconded by Councilman Stipes that Carl Mason be employed in street department at $1.50 per hour. Motion carried. Motion by Councilman Stine that the following Ordinance be intro- duced and adopted at this meeting. ORDINANCE NO. 370 AN ORDINANCE TO CREATE OFFICE OF ASSISTANT BUILDING INSPECTOR, APPOINTMENT AND TERM OF OFFICE. BE IT ORDAINED by the City Council of the City of Fairhope that the office of Assistant Building Inspector be created. This officei shall be appointed by the Mayor, subject to the approval of the City Council, and hold office from the time of appointment until the expiration of the term of the Mayor by whom appointed, unless sooner removed by order of the Mayor, subject to approval of the City Council. Councilman Stine moved that all rules governing the Council which might, unless suspended, prevent the passage and adoption of the ordinance at this meeting, be and the same are hereby suspended for the purpose of permitting said ordinance to be finally passed and adopted at this meeting. Councilman Gaston seconded this motion. The question was put before the Council and the vote was as follows: Yea: Councilmen Stipes, Stine, Gaston and Reynolds. Nay: None. Councilman Spader absent. The Mayor declared the motion adopted by unanimous vote of members present. Councilman Stine moved that said Ordinance # 370 be'finally passed and adopted as introduced. Councilman Gaston seconded the motion and the question of final passage and adoption of said Ordinance was put to vote of the Council with the following vote recorded. Yea; Councilmen Gaston, Stine, Stipes and Reynolds. Nay: None. ORcilman Spader absent. The Mayor declared the Ordinance final] ed and adopted. Mayor Macon appointed R. C. Yohn as Assistant Building Inspector of the City at a salary of $360.70 per month. Approved by unani- mous vote of the City Council.
