met in regular session
at 7:30 P.M. with the
Councilmen: Spader, Reyno
Minutes of the previous regular meeting were corrected to read
"Boyd Aldridge $320.00" instead of "Boyd Aldridge $304.00"
Motion by Councilman Gaston seconded by Councilman Stipes that the
minutes be approved as corrected. Motion carried.
Motion by Councilman Reynolds seconded by Councilman Stipes that
the lease agreement for docking facilities at Fly Creek be tabled
until the regular meeting of August 8, 1966. Motion carried.
Motion by Councilman Stipes seconded by Councilman Stine that the
City pay Medicare insurance on employees 65 years of age and over.
Motion carried.
Motion by Councilman Gaston seconded by Councilman Spader that the
City offer Dr. Mitchell original agreement price less $7,000.00
for Colonxy_Rent,based on a ten year period, for the Casino. This
offer to be good for seven days from this date. Upon being put
to vote the following vote was recorded: Voting For: Mayor Macon,
Councilmen Gaston and Spader. Voting Against: Councilmen: Stine,
Stipes and Reynolds. The vote creating a tie, Mayor'Pla.con cast a
second vote for the motion thus breaking the tie and the motion
carried.
Councilman Reynolds moved the adoption of Ordinance #367, AN ORD-
INANCE AMENDING SECTION 2-1 OF THE "CODE OF ORDINANCES, CITY OF
FAIRHOPE" AND TO REPEAL ANY AND ALL ORDINANCES IN CONFLICT THERE-
WITH, introduced at the regular meeting of July 11, 1966. Council-
man Stine seconded the motion. Upon being put to vote the followil
vote was recorded: Voting For: Councilmen; Stine, Stipes and Reyno:
Voting Against: Mayor Macon_ and Councilmen Gaston and Spader. The
vote creating a tie, Mayor N,acon cast a second vote against the
motion breaking the tie and the motion was defeated.
Motion by Councilman Stine seconded by Councilman Reynolds that
City employees, with the exception of Department Heads, be paid
time and a half for overtime suject duo the approval of the City
Superintendent. Motion carried.
The following bids were received on removing the Red Cross Buildi
Gayle Bracy - $200.00 and material.
Norris Smith, Sr. - $ 50.00 and material.
J. Dudley Wade - Remove building for material. Work to be
accomplished within 90 days.
Motion by Councilman Reynolds seconded by Councilman Stine that
they accept low bid of J. Dudley Wade provided building is removed
within 90 calendar days. Motion carried.
Motion by Councilman Gaston seconded by Councilman Stipes that the
(following Ordinance be introduced: Motion carried.
IMPROVEMENT ORDINANCE NO. 368
AN ORDINANCE MODIFYING, AMENDING AND CONFIRMING, AS SO MODIFIED
AMENDED, IMPROVEMENT ORDINANCE NO. 364 ADOPTED the 28th day of
June, 1966.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA., as follows:
Section 1. That upon evidence presented to and considered by
it, the City Council does hereby make a finding and determination
lof the following facts:

(a) At a regular meeting of the City Courdl of the City of
Fairhope, held on the 28th day of June, 1966,
Improvement Ordinance No. 364 was adopted and notice of the
adoption of said ordinance was given by publication of said ordi-
nance in the Fairhope Courier, a newspaper published in and of
general circulation in the City of Fairhope, in the issues of
June 16th and June 23, which said ordinance stated that the City
Council of the City of Fairhope would meet on the 11th day of
July, 1966, at 7:30 P. M. at the City Hall in the City of Fairhope
to hear any objections, remonstrances or protests that might be
made to said improvements or the character of the material or
materials to be used, and the manner of making the same.
(b) A copy of said Improvement Ordinance No. 364 was sent
by registered mail, postage prepaid, to each of the persons last
assessing for City taxation the property proposed to be assessed
for said improvements at their last known addresses; said notice
having mailed on the 1st day of July, 19669 more than ten days
prior to the 11th day of July, 1966.
(c) The protests and objections of persons owning property
on Kumquat Avenue, namely, Mr. Ralph Hoffman, Constantine
Szymborski and Mrs. Oscar L. Smith were heard, considered, sus-
tained and granted, and Improvement Ordinance No. 364 amended and
modified by the elimination of the improvement of Kunquat Avenue.
(d) The protests of Emma Ladd to the improvement of south
Ingleside Avenue was heard, considered, sustained and granted and
Improvement Ordinance No. 364 amended and modified by the elimina-
tion of the improvement of South Ingleside Avenue.
(e) No other protests, objections or remonstrances again sai4
improvements, or the character of materials to be used in the
manner of making said improvements have been filed in writing with
the City Clerk in her office, or have been made at this meeting.
Section 2. That the improvement of Kumquat Street as des-
cribed in Improvement Ordinance No. 364, and the improvement of
South Ingleside Avenue, as described in Improvement Ordinance No.
364 is hereby removed, eliminated and deleted from Improvement
Ordinance No. 364 and said Improvement Ordinance No. 364 is hereby
modified and amended by the removal, elimination and deletion of
Kumquat Street and South Ingleside Avenue of said Ordinance.
Section 3. That Section 1 of Improvement Ordinance No. 364
is hereby amended to read as follows:
"Section 1. That the following described streets in the
City of Fairhope, Alabama, shall be improved as hereinafter
Provided between the respective terminal points hereinafter
set forth:
Miller Avenue from Section Street to Bon Secour.
Section 4. As herein modified and amended, Improvement Ordi-
nance No. 364, entitled "AN ORDINANCE TO PROVIDE FOR CERTAIN
IMPROVEMENTS ON MILLER AVENUE IN THE CITY OF FAIRHOPE, ALABAMA" is
hereby in all things ratified and confirmed.

Motion by Councilman Gaston seconded by Councilman Stipes that
Killer Avenue be included in paving contract with Bouler Contract
Company. Motion carried.
Motion by Councilman Reynolds seconded by Councilman Stine that
the money now in Escrow in First National Bank of Fairhop_e for
purchase of Casino be placed back in the Electric Fund. Motion
carried.
Motion by Councilman Stipes seconded by Councilman Reynolds that
all bills and salaries, including garbage contract, be presented
to the Council each month. Motion carried.
Motion by Councilman Reynolds seconded by Councilman Stipes that
the request of Wilters, Brantley & Nesbit by Harry J. Wilters, Jr.
to reinstate Percy Dale's beer license be denied. Motion carried.

AN ORDINANCE TO AMEND SECTION 2-1 OF THE "CODE OF ORDINANCES, CITY
OF FAIRHOPE" AND TO REPEAL ANY AND ALL ORDINANCES IN CONFLICT THER�
WITH.
BE IT ORDAINDED BY THE CITY COUNCIL OF.FAIRHOPE, ALABAMA,that
Section 2-1 of the "Code of Ordinances, City of Fairhope, Alabama"
be amended to read as follows:
Section 1 - The Officers of the City, in addition to
the Mayor and City Clerk, shall be a City Business Administrator
and City Superintendent, a City Attorney, a City Treasurer, a
Chief of Police and such Police Officers as the Council may,from
time to time fix and determine, and a City Recorder.
Section 2 - These Officers shall be elected by the
Mayor and Council at the first regular meeting after city elec-
tions, and shall hold office from the time of appointment until
the expiration of the term of the Mayor and City Council, by whom
appointed, unless sooner removed by a two-thirds vote of the
majority elected of the Mayor and Council.
Section 3 - All other City employees shall be employed
by a two-thirds majority vote of the Mayor and Council elected.
Section 4 - Any and all City Ordinances in conflict
herewith are hereby repealed.
Section 5 - Any and all paragraphs, sentences, clauses
and phrases of this Ordinance are severable, and if any phrase,
clause, sentence, paragraph or section of this Ordinance shall be
declared unconstitutional by the valid judgment or decree or court
of competent jurisdiction, such unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraph:
and sections of this Ordinance.
