COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
session at the City Hall, Monday, July 11, 1966 at 7:30 P. M. with
the following members present: Mayor Macon, Councilmen: Spader,
Reynolds, Stipes, Gaston and Stine.
Minutes of previous regular meeting were approved.
Motion by Councilman Reynolds seconded by Councilman Stipes that
the Executive Assistant get bids on removing the Red Cross
Building. Bids to be opened at next regular meeting of July 25,
1966, Motion carried.
This being date set for hearing protests on 1966 Paving project
the following protests were submitted:
Emma Ladd - So. Ingleside
Ralph Hoffman - Pecan & Kumquat
Yx. & Mrs. Constantine Szyiborski -Pecan & Kumquat
No ruling on protests until next regular meeting of the City
Council on July 25, 1966,
Lease agreement on docking facilities at Fly Creek was presented
and held for further study until the next meeting of July 25, 1966,
Dr. Mitchell met with the Council pertaining to the sale of the
Casino building. After general discussion, the Council agreed
to give Dr. Mitchell a definite answer at the next meeting of the
Council on July 25, 1966.
Motion by Councilman Reynolds seconded by Councilman Stine that
the following motion of minutes of January 27, 1965 be repealed:
"Motion by Councilman Reynolds seconded by Councilman Gaston
that action on Council Agenda items'be taken first. Councilmen
can present anything for discussion that is not on the agenda.
Councilmen may take action on any matters not on the agenda pro-
viding the Council unanimously elects to do so. All items to be
put on agenda for any Council meeting must be submitted to the
Executive Assistant no later than 10:00 A. M. on Thursday pre-
ceding Council meeting on Monday. Motion carried."
Upon being put to -vote the following vote was recorded: Voting
For: Councilmen Stipes, Stine, Reynolds and Spader. Voting
against: Mayor Macon and Councilman Gaston. Motion carried.
This being date set for opening bids to remove piling from beach
area the following bids were received:
Norris Smith - $ 1.78 per piling - Minimum $300.00 '
Randall Randers.- 3.50 per piling
1.5 Eugene Bosby - 0 per piling
Motion by Councilman Reynolds. seconded by Councilman Stipes that
the low bid of $ 1.50 per piling submitted by Eugene Bosby be
accepted. Motion carried.
Motion by Councilman Gaston seconded by Councilman Stine that City
Clerk be authorized to transfer Savings Certificate from Gas
Department to Airport Account. Motion carried.
Motion by Councilman Stipes seconded by Councilman Gaston that Ci
Clerk be authorized to transfer Savings Certificate from Electric
Department to 1966 Street Imppovement Account. Motion carried.
Nor. Dyson reported that the estimated cost of opening 3rd Avenue
was 0300.00. Motion by Councilman Gaston seconded by Councilman
Stine that 3rd Avenue be opened. Motion carried.

Mr. George Dyson submitted his resignation as City Superintendent
with the exception of Building Official and Inspector. Mayor
Macon then appointed Mr. Dyson as Building Inspector at a salary
of $500,00 per month. Motion by Councilman Stine seconded by
Councilman Gaston that the appointment be approved. Motion carri
Mayor Macon appointed Jack Kirk as General Superintendent of
Utilities and Street Department at a salary of $650.00 per month.
Motion by Councilman Stine seconded by Councilman Gaston that the
appointment be approved. Motion carried.
Mayor Macon appointed Pete Wiggins as Superintendent of Gas, Water
& Sewer Department at a salary of $600.00. Motion by Councilman
Stipes seconded by Councilman Reynolds that the appointment be
approved. Motion carried.
Mayor Macon appointed Leo Gilheart as Chief of Police at a salary
of $525.00 per month. Motion by Councilman Stine seconded by
Councilman Gaston that the appointment be approved. Motion
carried.
Mayor Macon appointed Bill Creamer as Electric Superintendent at a
salary of $525.00 per month. Motion by Councilman Stipes seconded
by Councilman Stine that the appointment be approved. Motion
carried.
Motion by Councilman Spader seconded by Councilman Stipes that Leo
Keller be employed as Fireman three days a week at a salary of
$200.00 per month. Motion carried.
Motion by Councilman Stine seconded by Councilman Gaston that the
following Ordinance be introduced:

Motion by Councilman Stine seconded by Councilman Gaston that all
rules governing the Council which might, unless suspended, prevent
the passage and adoption of the Ordinance at this meeting, be and
the same are hereby suspended for the purpose of permitting the
said ordinance to be finally passed and adopted at this meeting.
Lotion carried unanimously.
Councilman Gaston moved that said Ordinance ,# 366 as introduced be
finally passed and ad ptd as introduced. Councilman Stine
seconded the motion. 7Th: Mayor put the question of final passage
and adoption of the said Ordinance to vote of the Council, and on
call of the roll the results were as follows: Yea: Mayor Macon,
Councilmen Spader, Remolds, Stipes, Gaston and Stine. The Mayor
declared the Ordinance finally passed and adopted.
Motion by Councilman Stipes seconded by Councilman Reynolds that
the Ordinance # 367 bl Introducede Upon being put to vote the
following vote was recorded: Voting No: Mayor Macon and Council-
man Gaston. Voting Yes: Councilmen: Stine, Stipes, Reynolds and
Spader. Motion carried.
ORDINANCE # 367
AN ORDINANCE TO AMENDISECTION 2-1 OF THE "CODE OF ORDINANCES, CITY
OF FAIRHOPE" AND TO REPEAL ANY AND ALL ORDINANCES IN CONFLICT
THEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF FAIRHOPE, ALABAMA that Secti
2-1 of the "Code of Ordinances, City of Fairhope, Alabama" be
amended to read as'follows:
Section 1 - The Officers of the City, in addition to the Mayor
and City Clerk, shall be a City Business Administrator and City
Superintendent, A City Attorney, a City Treasurer, a Chief of Polic
and such Police Officers as the Council may, from time to time fix
and determine, and a City Recorder.
Section 2 - These Officers shall be elected by the Mayor and
Council at the first regular meeting after city elections, and
shall hold office frog the time of appointment until the expira-
tion of the term of the Mayor and City Council, by whom appointed,
unless sooner removed by a two-thirds vote of the majority elected
of the Mayor and Council.
Section 3 - All other City employees shall be employed by a
two-thirds majority vote of the Mayor and Council elected.
Section 4 - Any and all City Ordinances in conflict herewith
are hereby repealed.
Section 5 - Any and all paragraphs, sentences, clauses and
phrases of this Ordi ce are severable, and if any phrase, clause
sentence, paragraph or section of this Ordinance shall be declared
unconstitutional by the valid judgment or decree or court of
competent jurisdictionl, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this Ordinance.

Motion by Councilman Gaston seconded by Councilman Stine that low
bid of Jack Cooke & Co., Inc.,subject to approval of Fire Depart-
ment, be accepted. Motion carried.
Motion by Councilman Stine seconded by Councilman Stipes that the
City accept offer of the 1st National Bank of Fairhope to collect
gas bills at their Daphne and Spanish Fort branches. Motion
carried unanimously.
Motion by Councilman Reynolds seconded by Councilman Stipes that
the bills be approved for payment. Motion carried.
Councilman Spader submitted his resignation from the Planning and
Zoning Commission due to his new employment which would prevent
him from attending the meetings.
The Council authorized Mr. Ed Warley to offer same price per acre
for additional land at Airport as City paid for land recently
purchased.
Motion by Councilman Gaston seconded by C oilman Reynolds that
the meeting adjourn. Motion carried.

Last Monday night the Fah lope
City Council along with Mayor
R. C. Macon met with Senator
L. W. Brannan and Representa-
tive L. D. Owen to discuss final
plans on the Fairhope to Sp;atiish
Fort four -lane highway
Brannan and Owen told the
council that the highway was
fissured and stated furtaer that
Governor Wallace and the entire
State Highway Department were
aware that this was the most
needed road in the State today.
Construction is to begin shortly.
However, the main p,17Dosc of
the meeting was centered on ac-
cess roads to Fait°hope's business
district from the present "Y"
where State 104 intersects.
Both Brannan and Owen stated
that when the Legislature con-
venes in January that they will
seek Federal assistance in com-
pleting this tie-in for the bmsi-
ness district.
The City of Fairhope has al-
ready spent over $7,000.00 on
right-of-way maps for this access
road. Representative Owen stated
that this would have a far reach-
ing effect on getting assistance
from both the State and Federal
because it shows good faith and
a progressive attitude, on the part
of the City.
