COUNTY OF BALDWIN
The City Council of the City of Fairhope, Alabama, met in regular
session at the City Hall, Monday, June 27, 1966 at 700 P. M.
with the following members present: Mayor R. C. Macon, Council-
men: Spader, Reynolds, Stipes, Gaston and Stine.
The Mayor appointed Councilman Gaston as Acting Mayor so that he
might take his place and introduce a Resolution to clear up the
disagreements encountered at the end of the previous meeting of
June 13, 1966 with the following explanation first:
INTRODUCTION
As we are in practical agreement regarding the necessity of
pay raises, as recommended by the committee appointed to make a
study of them, but realize that the termination of jobs is
improper in view of Section 451 of Title 37, we should clear the
record so that a proper ordinance can be introduced unanimously
waiving the rules andpass it at this meeting to go into effect
the first of the month. I have, therefore, prepared a resolution
clearing the record, which reads as follows:
RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL of the City of Fairhope
that since the recommendations of the pay raise committee
exceeded their authority in recommending personnel changes and
sought to illegally terminate the employment of City officials
and the motion and second for the adoption of their recommenda-
tions and the subsequent vote from the floor were in conflict with
Section 2-1 of Article 1 of the Code of the City of Fairhope and
of Section 451 of Title 37 of the Code of the State of Alabama;
IT IS, THEREFORE, RESOLVED that that portion of the minutes
this Council showing action on the Resolution, be, and the same
are hereby deleted from the minutes of the meeting of the Council
of June 13, 1966.
Mayor then moved that the preceding Resolution be adopted. Motion
died for lack of second. The Mayor then resumed his position as
presiding officer.
Miaates of previous regular meeting were corrected to read:
Councilman Stine called for the auestion instead of "Councilman
Stine move at a vote be called on =e motion. Motion died for
lack of second."
Councilman Spader moved that the motion passed at the last regular
Council meeting of June 13, 1966 incorporating recommendations of
the committee appointed by the Mayor pertaining to pay raises be
rescinded in its entirety. Motion seconded by Councilman Reynolds
and carried.
Minutes of previous regular meeting were approved as corrected.
ilman Stipes introduced the following Ordinance and moved its

BE IT ORDAINED BY THE CITY COUNCIL 0 THE HE CITY OF FAIRHOPE, ALABAM
that Section 2-1 of the Code of Ordinances, City of Fairhope, Ala-
bama, is hereby amended to read as follows:

The officers of the city, in addition to the mayor and city
clerk, shall be a city business administrator and city superin-
tendent, a city attorney, a city treasurer, a chief of police and
such police officers as the council may, from time to time, fix
and determine, a chief of the fire department, and a city recorder
and all other city employees.
These appointments shall be made by the mayor and the city
council, and hold office from the time of appointment until the
expiration of the term of the mayor and city council, by whom
appointed, unless sooner removed by a two-thirds vote of the city
council.
This ordinance shall take preference over any other Ordinance)
that may be in conflict with it.
ADOPTED this the day of ,1966.

Mayor Maeon ruled the motion out of order due to the fact that it
is in direct conflict with the procedure adopted unanimously by
the City Council on January 25, 1965- Councilman Reynolds
requested a ruling from the Attorney General on the Mayor's ruling;
Motion by Councilman Gaston seconded by Councilman Stine that
Grade Ordinance # 3639 An Ordinance Fixing and Establishing The
Grade of a Certain Portion of Miller Avenue, Kumquat Avenue and
South Ingleside Avenue, introduced at the regular meeting of June
139 1966 be adopted as introduced. Motion carried unanimously.'
Motion by Councilman Stipes seconded by Councilman Reynolds that
Improvement Ordinance # 364, An Ordinance To Provide For Certain
Improvements on Miller Avenue, Kumquat Avenue and South Ingleside
Avenue, introduced at the regular meeting of June 13, 1966 be
adopted as introduced. Motion carried unanimously.
Motion by Councilman Spader seconded by Councilman Gaston that
Ordinance # 365, An Ordinance To Amend Section 5-4 Of The Code Of
Ordinances, City of Fairhope, Alabama, Of The Establishing Of Fire
Districts In the City of Fairhope, Alabama, introduced at the
regular meeting of the City Council on June 13, 1966 be adopted as
introduced. Motion carried unanimously.
Councilman Stipes introduced the following Resolution and moved
its adoption, Councilman Stine seconded the motion.
RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA IN REGULAR SESSION THIS 27th DAY OF JUKE, 19669 THAT:
The Council expresses its thanks to Miss Mary Grice for her
lucid and informative presentation of the Community Action Progr
as it might apply to the City of Fairhope, and that such written
material as she wishes to leave with us be placed on file.
BE IT FURTHER RESOLVED that the Council is not at this time
in favor of City participation in this program, or of any similar
program otherwise sponsored.in this area, for the following reason :

(1) The small number of persons in actual poverty, (within
the ordinary meaning of the word) are at present receiving or
can receive assistance from the several long established programs
under local or State supervision;
(2) There has for some time been a noticeable lack of
applicants for jobs open, locally and in our neighboring city of
Mobile, in unskilled, semi -skilled and skilled classifications
and it is our opinion that any program purporting to give traini:
in higher skills will have the effect of attracting persons who
otherwise accept employment now available to them.
(3) We are aware that our Country is at present engaged in
war -like situation in Asia, the cost of which cannot at present
be measured and that the military demands upon the Government
must of necessity limit at some point the funds available for
domestic social projects. This being the case, we feel that all
available funds under the Community Action Program should be
applied in the areas of greatest need, of which we are not one;
and,
BE IT FINALLY RESOLVED that this Council will, by RESOLUTI
(The Mayor concurring) inform Miss Grice's office of any future
change in local conditions which might make our participation in
a program advisable.
Motion carried.
Dr. Mitchell met with the Council pertaining to the Casino Buildin�.
Tabled until the next regular meeting of the City Council. II
A petition for leasing docking facilities at Fly Creek was pre-
sented and referred to the City Attorney for next regular meeting
of the City Council.
The Council requested the Executive Assistant to call for bids --on
all Insurance policies of the City expiring at this time.
Motion by Councilman Reynolds seconded by Councilman Gaston that
the bill of Moore En ineering Co. on 1966 Street Improvements in
the amount of $ 59786.83 be approved for payment. Motion carried.
Motion by Councilman Reynolds seconded by Councilman Spader that
the Kiwanis Club be granted permit to operate refreshment stand
on beach from Thursday, June 30th through July 4th. The Kiwanis
Club to pay for all utilities used. Motion carried.
Motion by Councilman Gaston seconded by Councilman Spader that
$400.00 be allocated for fireworks for July 4th. Motion carried.
Mayor Macon reappointed Mr. Cecil Pitman' to the Planninngg and Zonin
Commission for a six (6) year term beginning May 25, 1966.
The following bids were received -on repairs to the 955 Caterpillar
Burford Equip. Co. $ 871.50
Hardy•L. Couch
. Tractor Service Co. 821.29
Motion by Councilman Stine seconded by Councilman Gaston that the
City accept low bid of Hardy L. Couch Tractor Service Company.
Motion carried.
Motion by Councilman Stine seconded by Councilman Spader that the
CityClerk be authorized to cash Recreation Board Savings Certifi-
cates when authorized by the Recreation Board. Motion carried.

With the approval of the City Council the Mayor appointed a
committee of Mr. James Lipscomb, Mr. Barney Shull, Dr. R. H.
Johnson and Mr. Charley Belew to work with him to bring one of
the Senior Bowl Teams to Fairhope for practice sessions before
the Senior Bowl Game.
Motion by Councilman Reynolds seconded by Councilman Stine that
Jack Kirk be authorized to urchase 3 banks of capacitors at
�z an approximate cost of 1100.00. Motion carried.
Motion by Councilman Stipes seconded by Councilman Stine that Mr.
Randall Manders and two helpers be employed temporarily for
installing bulkhead from Pier South to first property line. Mr.
Manders is to be paid $4.00 per hour and the helpers $2.00 per
hour out of funds previously allocated for this project. Motion
carried.
Motion by Councilman Stine seconded by Councilman Re nolds that
Ernest Tate be hired as part time police officer at 1.50 per
hour. Motion Carried.
Motion by Councilman Gaston seconded by Councilman Stine that
City renew their page ad in Gulf States. Motion carried.
Motion by Councilman Stipes seconded by Councilman Gaston that
the request of the U. S. Coast Guard Auziliary to use the Council
Room on the 3rd Tuesday of each month for their business meeting
be granted. Motion carried.
Motion by Councilman Reynolds seconded by Councilman Stine that
the City accept low bid of H. G. Sandoz in the amount of $196.50
for new roof on City Jail. Motion carried.
Miss Helen Call presented a summary of the park lands deeded to
the City of Fairhope by the Fairhope Single Tax Corporation.over,.,
a period of years.
Motion by Councilman Gaston seconded by Co ilman Reynolds that
the meeting adjourn. Motion carried.

Re: 1966 Street Improvements
Gentlemen:
We have reviewed the bids received for
construction of the above referenced project
and find that Bouler Contracting Company of
Chickasaw, Alabama is successful low bidder,
having submitted a Proposal amounting to
$98,463.82.
It is therefore our recommendation that
the City of Fairhope accept the proposal of
and award the contract to Bouler Contracting
Company.
When we receive authorization from the
City, we will issue Formal Notice of Award
of Contract to the contractor.
