HomeMy WebLinkAbout02-28-1966 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope met in regular session at the City Hall, Monday, February 289 1966 at 7:30 P.M. with the following members present: Mayor Maoon, Councilmen: Spader, Reynolds, Stipes, Stine and Gaston.. The minutes of the previous regular meeting were approved. Councilman Stine introduced the following Ordinance which was seconded by Councilman Reynolds. ORDINANCE ,#� 8- AN ORDINANCE TO REPEAL SECTION 1 - ,-PARAGRBPH (b), and SUBSTITUTE IN ITS PLACE AND STEAD ONLY CITY STANDARD METAL POSTS AND MACHINE MADE STREET MARKERS SHALL BE ERECTEDs BE IT ORDAINED -BY THE CITY COUNCIL OF FAIRHOPE94ALABAMA AS FOLLOWS Seetion'18-29`Sub-seotion'(b)'is hereby repealed. BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF FAIRHOPE, ALABAMA THAT IN ITS PLACE AND STEAD SHALL READ AS FOLLOWS: Section 18-2'of-the City Code of F irhope, Alabama(b)., STREET MARKERS. Only City standard metal posts and machine mkde street markers shall be erected. Read, adoptdd and approved this the day of 1966. R. . Maeong Mayor Attest: Marie ore, City Clerk mounalman Stipes moved that all rules governing the Council which might, unless suspended, prevent the passage and adoption of this Ordinance at this meeting, be and the same are hereby suspended for the purpose of permitting said Ordinance to be finally passed and adopted at this meeting. Councilman Stine seconded the motion. The question was put before the Council on roll call the vote was as -follows: Yea: Mayor Maoon, Councilmen: Spader, Reynolds, Stipes, Stine and Gaston.'. Nay: None. Motion adopted unanimously. Councilman Reynolds moved that said passed and adopted as introduced. motion. The Mayor then put the question of said Ordinance #349 to vote of the results were as -follows: Ordinance #349 be finally Councilman Stine seconded the final passage and adoption of Council and on roll call the Yea: Mayor Macon, Councilmen: Spader, Reynolds, Stipes, Stine and Gaston.. Nay: None. The Mayor declared that Ordinance #349 be finally passed and adopted by unanimous vote. ;` Motion by Councilman Gaston seconded by Councilman Stine that Council authorize ten cents (10¢) per mile to City Officials for use of personal car on City business. Notion carried. Notion by Councilman Stipes seconded by Councilman Gaston that $660.00 be authorized to send four firemen to Fire school. Motion carried. Notion by eCouncilman Stipes seconded by Councilman Stine that the preliminary plans of Fairhope Avenue and Section Street as submitted by Moore Engineering Company be accepted and all necessary action be taken at once to secure State and Federal Aid toward this project. Motion carried., Motion by Councilman Reynolds seconded by Councilman Stipes that Moore Engineering Company bill in the amount of $79074,25 be approved for payment. Motion carried. Notion by Councilman Qaston=seoonded by Councilman Stine that the Airport Board be authorized to negotiate for easement necessary for clear zone according to Moore Engineering Company master plan.' Motion carried., - Motion by Councilman Spader seconded by Councilman Gaston that the following Ordinance be introduced. Motion carried. ORDINANCE # r0 AN ORDINANCE TO AMEND SECTION 9-1 OF THE CODE OF THE CITY OF FAIRHOPE, ALABAMAt BE IT ORDAINED BY*THE CITY COUNIL OF FAIRHOPE, ALABAMA THAT SECTION 9-1 CAPTIONED "FIRE PREVENTION CODE ADOPTED" BE AMENDED AS FOLLOWS: There is hereby adopted,'for the purpose'of prescrib- ing regulations governing conditions hazardous to life and property from fire or explosion, that certain code known as the Fire Prevention Code, Abbreviated Elition, recommended by the National Board. of Fire -Underwriters, being particularly the 1965 edition thereof and the whole thereof, safe and except such portions as are hereinafter deleted, modified, or amended, of which code not less than three (3) copies have been and now are filed in the office of the city clerk, and the same are hereby adopted and incorporated as fully'as if set out at len#th herein. ORDINANCE NOS -351 - 17 AN ORDINANCE TO AMEND ORDINANCE NO. 348 TO EXCEPT THE SETBACK - LINE FROM BAYVIEW AVENUE TO MERSHON STREET ON FAIRHOPE AVENUE: BE IT RODAINED BY THE CITY COUNCIL OF'FAIRHOPE, ALABAMA, THAT ORDINANCE NO.,348 BE AMENDED TO READ AS.FOLLOWS: d5 'j. That upon the recommendation of the Fairhope Planning Commission, this Ordinanoe specified that any building, structure or billboard shall be set back a minimum of fifty-five (55) feet from the center line of Fairhope Avenue and Section Street Wexce t between Oak Street south th Morphy Avenue and ex;Ecept on Fair ope Avenue from Bayview Avenue running east to Mershon Street -_where the minimum setback shall be the avers a set back between any two existing structures three hundred 1300) feet or less in each direction. w Read, adopted and approved this the day of 1966. MACON, MAYOR ATTEST: Motion by Councilman Stine seconded by Councilman Reynolds that the City accept the kind and generous offer of Malbis Nursery and Mr. Emanuel Lambrakis, manager of the nursery, for shrubbery to be used in landscaping parks and that the Mayor be authorized to take steps necessary for removing plants. Macon, Mayor, City of Fairhope, Fairhope, Alabama. Dear Sir : This letter, when 'approved by the City will serve as a memorandum of agreement between the City o Fairhope and the undersigned engineer covering electrical engineering services desired by the City 'in connection with providing plans and specifications of electrical system additions necessary to acquire its power supply from the Alabama Power Co. The engineer pvoposes to furnish complete plans, specifications, and'bill of material covering the proposed new 44KV switching station to be located in the vicinity of Twin Beech Road, and the 44KV transmission line from such station to connect with the existing 44KV system of the City, and to assist the City in procuring necessary materials for this construction. The City agrees to pay the engineer for his services in connection with this project at the rate of $80.00 per diem, with the provision that the total amount paid by the City to the engineer shall not exceed the sum of $3200.00 for the engineer's services described above'for this particular job. Should the engineer be called upon to provide other services, then such are to be compensated for in accordance -with the present engineering agreement dated September 16th, 1965. The engineer's compensation covered by this agreement is to be billed and paid for by the City at the end of each calendar month. It is further understood that the engineer is to pay his own travel expanses out of the per diem rate agreed upon, as long as such are incurred within the State of Alabama, but that the engineer's travel time is to be included in that subject to remuneration.
