OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope met in regular session at the City Hall, Monday, November 9, 1964, with the following .members present: Mayor i;acon, Councilmen: Spader, Reynolds, Stipes, Stine and Gaston. The minutes of the previous regular meeting were approved. City Attorney reported on progress of retirement for City emplo,�yees. :The Executive Assistant was authorized to secure bids on the large e give at the plant and present at the next regular meeting of the Co cil. The Executive Assistant was authorized to make a survey of the Merchants in the City in regards to their views of parking on Section Street from Magnolia to Plorphy and Fairhope from Church to Bancroft. Appointment of Civil Defense Director was tabled until next regular meeting. Notion by Councilman Stipes seconded by Councilman Gaston that the following Ordinance be introduced: Motion carried. ORDINANCE NO.3Jo An Ordinance amending Section 2-10 (a) of the Code of Ordinances of the City of Fairho e Alabama, adopted by Ordinance No. 290 under date of October 15, 1 6." BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABA ,iA, AS FOLLOWS: Section 2-10. Vacations and Sick Leave for Salaried City employees; contract provisions. (a) Salaried employees of the City who now have been, or shall hereafter have been, in continuous employment of the City for twelve (12) months or longer shall be entitled to two (2) weeks of vacation each year with pay, and shall be entitled to sick leave in accordance with the following: (1) Any employee may have one (1) day of sick leave with approval of his foreman; sick leave in excess of one (1) day shall be substantiated by a docto r•s certificate which shall be turned in to the City Clerk for filing. (2) Sick leave shall be accumulated at the rate of one half (1/21 day per month or six (6) days per year with a maximum allow- able accumulated sick leave of forty-five (45) days. The accumula- tion of sick leave time will continue while an employee is absent from work on sick leave. (3) Any employee may add his vacation time as set forth in Section 2-10 (a) herein to his accumulated sick leave when necessary. (4) At the implementation of this ordinance the following schedule shall automatically apply to City employees of the City of Fairhope in establishing amount of sick leave which any employee may have accumulated: NUMBER OF YEARS SERVICE AMOUNT OF SICK LEAVE years 6 working; ays 6 - 11 years 12 working days 11-25 years 18 working days 26 years and above 36 working days (5) Sick leave days allowed in this section are intended to be workkln� days only; Sundays and holidays shall not be applied toward the reduction of any employee's sick leave usage. 9 Mr. C. ADOPTED AUTHMICATED: CITY CLERK Motion by Councilman Gaston seconded by Councilman Stipes that a special permit be issued to Carey & Mlike Motor Co. to build temporary office building and wash rack at 509 Fairhope Avenue. Permit to be for one year subjecttDrenewal by the City Council. Miotion carried. lKotion by Councilman Stipes seconded by Councilman Reynolds that George Dyson be authorized to repair driveways in the City that are giving trouble due to resurfacing of streets. Repairs to be made for a flat fee of "'10.00 to cover cost of material. Fee to be payable in advance. Mlotion carried. Notion by Councilman Stipes seconded by Councilman Reynolds that the City pay to the Fairhope and Eastern_ Shore Chamber of Commerce the sum of ,,100.00 per month for advertising. Said nay- � ments to be on a yearly basis and retroactive to November 1, 1964. :Potion carried. Notion byy Councilman Spader seconded by Councilman Gaston that n_ George Dyso,an_d Donald -nulls, Engineer be authorized to proceed with securing bids on filter for the new well. motion carried unani- mously. Motion by Councilman Reynolds that opening of Church Street be left in hands of Eayor and Chief of Police and that the opening of Church Street be on a temporary basis. Mlotion by Councilman Gaston that the motion of Councilman Reynolds be tabled. Motion seconded by Mayor Macon. Upon being put to vote the following vote was recorded: For: Mayor Ilacon, Council- men Gaston and Spader. Against: Councilmen Reynolds, Stipes and Stine thus creating a tie. The Mayor then cast a second vote to break the tie and the motion was carried. Motion by Councilman Gaston seconded by Councilman Spader that based on reports presented at this meeting from the Mlayor and Chief of Police that Church St., with this plan in effect, be opened temporarily. Motion by Councilman Reynolds that Councilman Gaston's motion be tabled. Motion seconded by Councilman_ Stipes. Upon being Put to vote the following vote was recorded: For: Councilmen: ci Stipes and Reynolds. Against: Councilmen: Gaston_, Spader and Stine. Notion defeated. The Mayor then called for a vote on Councilman Gaston's motion with the following results: Voting for: Councilmen Gaston., Stine and Spader. Voting Against : Councilmen Stipes and Reynolds. I,Iotion carried. I110tion by Councilman Spader seconded by Councilman Stine that Councilman Stipes be elected to the Planning and Zoning Commission for one year. Motion carried.. The Mayor then reappointed Mr. Floyd Bung for a term of three years and appointed Mir. Amon Gates for a term of one year to the Planning and Zoning Commission. ITT. C. B. Niemeyer, Executive Assis- tant was appointed to Planning and Zoning Commission for this term of office. The following were reappointed to the Board of Adjustment for a period ending September 12, 1965: Fir. Clarence IticCoy, Rr. Robert Faulkinbury, iD''r. Fred Smith, and Fs. Robert Wilder. Mir. George Stejskal was appointed as new member. IIr. Marvin Berglin was reappointed for a period of one year and Mfrs. Helen Dyson .reappointed for a period of two years to the Board of Mlanagers of the School of Organic Education. Irirs. itarjorie Bridges was appointed as a new -.ember for a period of three years. I's. Richard Lacey was B. Niemeyer, Executive reappointed to the Airport Board and Assistant, was appointed to serve as I executive from the City. Motion by Councilman Stine seconded by Councilman Spader that an Industrial Development Board be established and that City Attorney be instructed to draw up the necessary papers. Motion carried. Motion by Councilman Reynolds seconded by Councilman Stine that bill of Huffman Insurance Co. be approved for payment. Motion carried. Motion byy Councilman Gaston seconded by Councilman Stipes that the bills be approved for payment. Motion carried. Request to locate trailer in residential zone was referred to the Adjustment Board. Topo map of City was tabled for further study. TYiotion by Councilman Stipes seconded by Councilman Reynolds that after due consideration Mickey Johnson be appointed as Chief of Police of the City of Fairhope effective immeaiatel Upon being put to vote the following vote was recorded: Voi: for: Councilman Sti es Stine and Reynolds. Votir_g against: councilman Gaston and ?�'ayor itacon. Councilman Spader abstained from voting. V11otion carried.
