STATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope met in regular session at the City Hall, Monday, July 139 1964 with the following members present: Mayor Schneider, Councilmen: Boone, Gaston, Nelson, Poser and Spader. Minutes of the previous regular meeting were approved. Mot�on by Councilman Poser seconded by Councilman Gaston that Ordinance #32 introduced at the regular meeting of June 24, 1964 be brought up for final adoption. ORDINANCE # 326 AN ORDINANCE AMENDING SEC, 15-1 OF THE CODE OF ORDINANCES OF THE CITY OF FAIRHOPE, ALABAMA. BE IT ORDAINED by the City Council ofthe City of Fairhope that Sec. 1 -1 of Code of Drdinanees of the City of Fairhope be amended to read as follows: SEC. 11-1 BILLS - When Due and Payable; Delinquency Penalties A11 bi is for electric gas water, sewer and arl3age service owing to the City shall be he gas services are billed and delinquent unless paid on or before 10 days after the yy are billed and unless paid on or before delinquency there shall be added to and collected as a art of such bills to defray the additional costs to the city (es li from such delinquencies, an additional sum of five per cent 5�) ofhe amount of such bill. All bills more than thirty (30) days delinquent shall bear interest at the rate of 6% per annum which shall be collected in addition to the amount of the bill and the penalty. This Ordinance to be effective August 1, 1964. Upon being put to vote the following vote was recorded: Mayor Schneider, Councilmen: Boone, Gaston, Nelson, Poser and Spader. Motion carried unanimously. Motion by Councilman Poser that the following Ordinance be introduced: AN ORDINANCE AMENDING ZONING ORDINANCE # 231 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE: That the City Zoning Ordinance Number 2331 be amended by rezoning the property here and after described from R-1 to M-1 in accordance with recommendat on of the Fairhope Planning and Zoning Commission on June 5, 19649 said property being described. From the Southeast Corner of Section 199 Township 6 South, Range 2 East, run West 40 feet; thence run North 00?0 ' E, parallel to the Eastern boundary of said section, 1899.8 feet to a point in the approximate middle of a small gully for the Point of Beginning of the property herein described: Thence run, down said gully S 76607' W, 163.8 feet; N 71*13' W, 85,6 feet • and, S 710129 � , 63. 5 feet to a- point in the confluence off' said gully and another small gully said point being on the eastern boundary of property owned % M.O. Berglin thence continua down said gully, run N 74025' W, 353.3 feet and N 16012' W, 3�2.6 feet to the confluence of said gully with Big Head Gully; thence, up Big Head Gully, run N 48°53' E, 99.7 feet, and S 700421 E, 115.1 feet and N 7f 14' E, 103.7 feetS 870 47' E, 162.6 feet, and N 69° 30' E, 154.7 feet to a point in the middle of said gully and on the southern boundary of Lot or Block 53 in the Magnolia Beach Addition to Fairhope, Alabama, as shown by map recorded in Miscellaneous Book 1, at pages 330-3319 Probate Records, Baldwin County, Alabama; thence along said boundary of said Block 539 run S 56044' E, 258 feet more or less to a point on the Western margin of Section Street Road; thence run S 00607' W along said Section Street and r r parallel to the said eastern boundary of said section, a distance of 341.3 feet to the Point of Beginning; Lot contains 7.0 acres, more or less, and is a portion of that certain property heretofore purchased by Angelo Houston from Frank W. Walker, and lies in Lot 1, otherwise known as "The NE 1/4 of the SE 1/411, of Section 19, T6S, R2E, Baldwin County, Alabama. Motion by Councilman Gaston, seconded by Councilman Boone that bill of Woods-Steber & Associates in the amount of $7,662.20 be paid under the terms of their contract. Motion carried unanimously. Councilman Boone introduced the following Resolution: BE IT RESOLVED by the City Council of the City of Fairhope that because the voters of Fairhope have made their wishes known in the advisory referendum of July 7, 19649 it is herebyResolved that the ofi5= Bu di ngg Authority authorized at the Ciy Council meeting ry 2 , 1564 be abolished. This action to become effective upon the passage of this Resolution. Our firm hereby extends our bid price as stated above for an indefinate period of time, subject of course to soil and topographical differ- ences, and any changes In plans ;nA specifications and significant changes in labor and material costs. We are obviously content with our bid price and are hopeful that we may ultimately sign a contract with the City of Fairhope to construct its new municipal auditorium. Motion carried unanimously. Motion by Councilman Boone seconded by Councilman Poser that if the Daphne and Fairhope Attorneys fail to settle the Daphne Gas Contract before the appeal date, Fairhope's Attorneys be instructed to prepare paperseeodfor appeal. Upon being put to vote the following vote was rFor: Councilman Boone, Gaston, Poser and Spader. Councilman Nelson not voting. Motion carried. Motion by Councilman Boone seconded by Councilman Nelson that the City accept offer of Mayor Schneider to use his equipment free of charge to pave area at the Anna T. Jeanes School. Motion carried unanimously. Motion by Councilman Nelson seconded by Councilman Po er t at Fire Truck be changed over to 12 volt system at a cost of 1170,96, Motion carried unanimously.
