Fairhope waive notice of the calling and holding of a special
meeting of the City Council to be held at the City Hall at
7:30 P.M., May 49, 1964, for the purpose of Appointing
Library Board, Accepting Budget and Conveyance of Library
Property, and for the taking of '..such necessary and proper
action thereon, and agree and consent that said meeting shall
be held at such time for such purpose.

consideration of the CITY OF FAIRHOPE'S establishing a library
board to operate a public library, the FAIRHOPE SINGLE TAX
CORPORATION does hereby GRANT$ BARGAIN, SELL and CONVEY unto
the CITY OF FAIRHOPE, a municipal Corporations all the hooks,
furniture, fixtures and items within the Fairhop* Library
Building on the following described property, to -wits
The North 173 feet of the nest 1102 feet of Block
Eight (8), Division One (1) of the lands of the
Fairhope Single Tax Corporation as per plat thereof
recorded September 139 1911, in Miscellaneous Book
One (1) Pages 320-.21, of the records in this Probates
Court of Baldwin Zounty, Alabama,
TO HAVE AND TO HOLD unto the said CITY OF FAIRHOPE,
its heirs and assigns forever.
The FAIRHOPE SINGLE TAX CORPORATIo13 does further hereby
lease to the CITY OF FAIRHOPE for the initial term of five (5)
years, begiminig on the day of i , 190 the
Library Building situated on the above descri land for an
annual rent of a sum equal to the rental of said land as fixed
by the FAIRHOPE S114GLE TAX CORPORATION in the usual way, to
be payable in semi-annual payments on the lst day of January
and the lst day of July of each year, the payment for the lst half
of such 1964 rent to be pro rated as of the date of the execution
of this instrument.
The CITY OF PAIRHOPE further agrees to maintain in-
surance for fire and extended coverage on the building it the
name of the FAIRHOPE SINGLE TAX CORPORATION as its interest
may appears and. they City agrees to maintain said building and
grounds during the term of this lease.
Said lease may be terminated by the CITY OF FAIMOPE
should it provide its own building for occupancy by the library
before the end of the initial term.

In the event no library building has been provided
at the end of the five (5) year term, the FAIRHOPE SINGLE TAX
CORPORATION does hereby agree to renew said lease for an ex-
tended term, and upon such conditions as may be mutually agreed
to.
The FAIRHOPE SINGLE TAX CORPORATIC7 + further agrees to
sell the building and improvements on said property to the CITY
OF FAIRUiOPE if the City so desire to purchase same during this
lease, and issue to the CITY OF FAIRHOPE the FAIRHOPE SINGLE
TAX CORPORATIONS # REGULAR ninety -•nine (99 ) year lease to the
land, the sales price of said building to be determined by an
appraisal of said building, and, should the parties be unable
to agree on the value of said building, the value shall be
determined by three disinterested persons to be selected as
follows: The Fairhope Single Tax Corporation and The City of
Fairhope each choosing one of the three persons, named by the
other, and the third to be sol ted by the two. Should either
party fail to name his arbitrator within thirty (30) days
after written notice, by Registered Mail to do so, the other
party may name an arbitrator for him.
This conveyance and lease is consented to by the
FAIRHOP& LIBRARY AND MUSEUM ASSOCIATION, and is executed
by the parties in accordance with a resolution passed by the
City Council of the City of Fairhope at a meeting held on the
23rd day of March, 1964; and by the Fairhope single Tax
Corporation, by a resolution passed on the 19th day of March
1964; and it is further made under authority of referendum election h
held by the members of the Fairhope Single Tax Corporation on the
2nd day of April, 1964.

COUNTY OF BALDWIN
The City Council of the City of Fairhope, Alabama met
in special session at the City Hall, Monday, May 49 1964
at 7:30 P.M. Each member of the Council having proper notice
of the special meeting, the Mayor called the meeting to order
and on roll call the following were found to be present:
Mayor Schneider, Councilmen: Gaston, Nelson, Poser and Spader.
The following were found to be absent: Councilman Boone,
The Mayor stated that a quorum was present and declared the
meeting open for the transaction of business.
Motion by Councilman Gaston seconded by Councilman Poser
that the Library Ordinance #3259 introduced at the regular
meeting of the City Council on April 139 1964, be adopted
as introduced. Upon being put to vote the following vote was
recorded: For: Mayor Schneider, Councilmen: Gaston, Nelson,
Poser and Spader. Against: None. Councilmen Boone absent.
Motion carried.
Motion by Councilman Poser seconded by Councilman Spader that
the following Resolution be adopted:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA that the Mayor and City Clerk be authorized to sign
agreement of conveyance by the Fairhope Single Tag Corporation
for all the books, furniture, fixtures and items within the
Fairhope Library Building,
BE IT FURTHER RESOLVED that the Mayor and City Clerk be
authorized to sign lease agreement for the Library land for
the initial term of five years. Copy on file in City Hall.
Upon being put to vote the following vote was recorded: Voting
For: Mayor Schneider, Councilmen: Gaston, Nelson, Poser and
Spader. Against: None. Councilman Boone absent. Motion carried.
The Mayor stated that the next order of business qas the
appointment of the members of the Library Board. The following
names were submitted:
Mrs. James E. Gaston,Sr. One Year
Mrs, Celia Brazael Two Years
Mrs. Mamie Ruffles McNulty Three Years
Mr. James Lipscomb Four Years
Mr. C. A. Gaston Five Years
There being no further nominations the Mayor called for a vote
with the following vote recorded: Voting For: Mayor Schneider,
Councilmen: Gaston, Nelson, Poser and Spader. Against: None,
Councilman Boone Absent. Motion carried.
MOion by Councilman Poser seconded by Councilman Nelson that
the Meeting adjourn. Motion carried.
