STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular session at the
City Hall, Monday, April 139 1964 at 7:30 P. M.;3K with the following
members present: Mayor Schneider, Councilmen: Boone, Nelson, Poser
and Spader.> Councilman Gaston being absent.;
Minutes of the previous regular meeting were approved.
This being the date set for public hearing on Ordinance #324, An
Ordinance amending Zoning Ordinance #2 one protest having been heard
Councilman Boone moved that Ordinance �,3114 be adopted as introduced at
the regular meeting of March 239 1964, motion seconded by Councilman
Poser.
ORDINANCE N0. 324
AN ORDINANCE AMENDING SECTION 13 OF ZONING ORDINANCE # 231.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA
That the request of Robert Nahr ang to rezone from R-1 to R-29 Section
of Fairwood Subdivision South of Gayfer St., as per plat presented
and recommended by the Fairhope Planning Commission be approved.
Motion carried unanimously.
Mrs. James E. Gaston, Sr., President of the present Library Board read
the following Resolution to the Councils
RESOLUTION
WHEREAS, The Fairhope Library and Museum Association had as
Its object the administration of the business affairs and various
activities of the library and museum of the Fairhope Single Tax Corpor-
ation, and
WHEREAS, The Fairhope Single Tax Corporation and the City, of
Fairhope have agreed to a conveyance to the City of all library
facilities, and
WHEREAS, The statutes governing the conduct of municipality
operated libraries provide that such administration shall be a library
board of five members appointed by the governing board of the munici-
pality, now
THEREFORE BE IT RESOLVED, That we, the Executive Board of
Fairhope Library and Museum Association, do concur in such conveyance
and do authorize our president to signify such concurrence by signing
such instrument of conveyance as may be executed in the accomplishment
of such conveyance.
Mrs. Bennett, Treasurer, Library Board, presented the proposed Annual

Motion by Councilman Boone seconded by Councilman Poser that the City
employ the present Library employees at the following salaries until
such time as the new Library Board is established.
Library Director $350.00 per month, Assistant Librarian $220.00
per month, Pages $-05 per hour.
Motion carried unanimously.
Motion by Councilman Poser seconded by Counoilman-Nelson that the
following Ordinance be inteoduced.
LIBRARY ORDINANCE # 325
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA,
as follows:
SECTION 1. That the City of Fairhope does hereby create and
establish a public library to be known as Fairhope Public Library,
SECTION 2. That the City of Fairhope does hereby reserve and
allocate that space in the City of Fairhope which they have received
from the Fairhope Single Tax Corporation, for the use and occupation
of said Library.
SECTION 3. That said library shall be under the management and
control of a Board of Trustees, which shall consist of five members.
The membership of said Board shall be constituted and shall hold office
until their respective terms expire as follows:
One member -- five years
One member-- Four years
One member,-- three years
One member -- two years
One member -- one year
said terms to run from the date of the passage of this ordinance, and
each of said members shall hold office until their successors shall be
elected as hereinafter provided. Upon the expiration of the term of
eabh member as hereinafter designated a successor shall be elected for
a period of five years from the date of expiration of said member's present
term, by the City Council of the City of Fairhope, Alabama, and in the
event of a members vacating the Board prior to the expiration of said
terms, such vacancy shall be filled by the City Council of the City of
Fairhope, Alabama, for the remaining portion of said term by electing
a successor to fill said axp unexpired term. No trustee shall receive
any pay or emolument for services as trustee.
SECTION 4. The Library Board (Board of Trustees) shall keep, or
cause to be kept,proper books and accurate accounts, showing the
receipts and disbursements of all funds belonging to the Fairhope Public
Library. The Library Board shall have full authority , in behalf of
the City, to take charge of, control, and manage all securities and
money.% Such Board shall have full power to invest and reinvest such
funds, and securities; provided, that only such investments are made
as are -usual and customary for trust funds of similar character and
subject to the laws of the State of Alabama governing same.
SECTION 5• All gifts, devises and bequests, or the proceeds
thereof, heretofore made, or which may in the future be made, to the
Fairhope Public Library, unless otherwise designated by the donor,
shall be considered a part of the principal of the trust fund and the
income therefrom only shall be expended by the Library Board.
SECTION 6. The Library Board shall have authority to select
asttat and employ a librarian for the Fairhope Public Library and all
other employees pertaining to the operation thereof and to fix their
compensation. The Librarian and all other employees employed under
the provisions of this section shall be subject to the control of and
replacement by the Library Board.
SECTION 7. The Library Board shall have at least four regular
meetings each year at the Fairhope Public Library., The minutes of
such meetings shall be duly and properly kept and preserved.
SECTION 8. At least once a year an audit shall be wade, by
an auditor designated by the City Council of the City of Fairhope,
Alabama, of all the records, books, accounts and transactions of the
Library Board the preceding year. A certified copy of such audit shall
be filed with the City Clerk at the City Hall in Fairhope, Alabama, and
made a part of the permanent records of the City of Fairhope, Alabama.
In addition thereto, the Library Board shall cause to be kept available
for inspection by the City Council, at all reasonable times, a full and
accurate statement of all assets and liabilities of the Fairhope Public
Library, including the receipts and expenditures, together with vouchers
for same and shall make, or cause to be made, an accurate report to the
city clerk whenever the City Council may so request.

The request of the Chamber of Commerce to activate the Industrial Board
Was held until next meeting with the request that the Chamber of Commerce
submit names to be,appointed to the Board.
Letter from David Bishop, 404 Barkley, pertaining to drainage was read
and discussed. Business Administrator instructed to write stati that
Barkley St. would be included in next paving project provided 51of
property owners aggeeable.
Request from National Services, Inca of Montgomery for ad in Official
Buyer's Guide for the State of Alabama was rejected.
Motion by Councilman Poser seconded by Councilman Boone that the regular
meeting of April 27, 1964 be suspended in lieu of the Alabama League
of Municipalities Convention in Montgomery. Motion carried.
The recommendation of the Public Building Authority that the City pay
Fred Woods, Inc. the amount of $69000.00 for preliminary plans for new
park facilities, aihount to be refunded to the City at a later date,
was tabled.
Mr. Ed Warley, Member of the Harbor Committee, requested appropriation
of dunds for engineering to develop plans for dock.
Motion by Councilman Nelson seconded by Councilman Boone that approxi-
mately $200,00 be appropriated for Claude Arnold, Engineer, under
supervision of Dd Warley, Member of the Harbor Board., to develop plans
for dock at Fly Creek. Motion carried unanimously.

The request that Church Street from Fig Street to Fairhope Avenue be
made a through Street was rejected upon the recommendation of the Chief
of Police.
Motion by Councilman Siader, seconded by Councilman Poser that the
following Resolution be adopted:
RESOLUTION
BE IT RESOLVED that the City allocate $25,000.00 from Electric
Funds and 0309000,00 from Recreation Fund to be used in construction
of swimming pool.
BE IT FURTHER RESOLVED that the Recreation Board be authorized
to proceed with the construction of a swimming pool at an approximate
cost of $559000.00. Upon being put to vote the following vote was
recorded: For: Mayor Schneider, Councilman Poser and Spader. Against:
Councilmen Boone and Nelson. Councilman Gaston being absent. Motion
carried.
Motion by Councilman Poser seconded by Councilman Spader that the
Chamber of Commerce be granted permission for carnival on beach
May 9 and 10. Motion carried.
Letter from William R. Hill pertaining to disagreeable odors from the
disposal plant was read and discussed.
Motion by Councilman Boone seconded by Councilman Nelson that the City
Superintendent be authorized to purchase mower after secu*ing bids
for same. Motion carried.
Notion -by Councilman Boone seconded by Councilman Pofrer that the City
Superintendent be authorized to purchase disc as requested. Motion
carried.
The request of Kenneth Horton to build pier was tabled for next regular
meeting of the Council.
Bill presented by Bailey - Lacey was tabled.
Notion by Councilman Poser seconded by Councilman Nelson that the
following bills be approved for payment.i Motion carried.
