COUNTY OF BALDWIN
The Mayor and Ci*y Council of the City of Fairhope, Alabama, met
in regular session at the city hall in the city on the 9th day of
Maroh, 19649 at 700 o'olock, P. N. The meeting was called to
order by Joe Schneider, the Mayor, and upon roll call the following
were found to he present: Mayor Joe Schneider and the following
members of the city council: Lester I. Boone, James E. Gaston, Jr.,
Walter 0. Poser and Richard Spader. The following were found to be
absent: W. J. Nelson., The Mayor presided and Marie Moore, the City
Clerk, who was also present, acted as clerk of the meeting. The
Mayor stated that a quorum was present and declared the meeting
open for the transaction of business.
Motion by Councilman Poser seconded by Councilman Spader that the
minutes of the previous regular meeting be corrected to read
"Motion carried" instead of "Notion defeated." Corrected motion is
as follows:
Motion by Councilman Poser seconded by Councilman Spader that the
Council authorize the hiring of an individual as recommended by
the Chamber of Commerce for the purpose of o ening a Tourist
Indormation Booth for the City's benefit. Upon being put to vote
the following vote was recorded.) Voting for: Councilmen Poser
and Spader. Voting No: Councilman Boone, Councilman Gaston and
Nelson not votinngg. Motion carried. Councilmen Boone and Gaston
requested that tFie Subject a on the agenda at the neat regular
meeting of the Council with the request that the Board of Directors
of the Chamber of Commerce present plan.

B� IT RESOLVED: That with the announcement of the Baldwin County
3 hool Board at its regular meetingFebru 28 19649 regarding
the oonstruotion'of gymnasium facilities at�he Pairhope High
School, the requirements for recreational buildings in the City of
Fairhope are somewhat changed.
BE IT FURTHER RESOLVED: That, since we do not have a full council
at this important meeting, further action on the Public Building
Authority created by this Council and adopted at the regular meeting
held February 10 1964 and the proposed Civic Recreational. Facilities
planned at an estimated cost of approximately Four Hundred Thousand
Dollars (0400,000,00) be tabled pending the determination by the
Council of the most desireable means of proceeding with a Public
Civic Center Building Program under the changed eiroumstanees set
forth herein.
AND BE IT FURTHER RESOLVED: That the Resolution providing for the
election of members of the Board of Directors of the Public Building
Authority, now pending before this Council, be held under advisement
until such time as may be found to be in the best public interest.
The Mayor then called for a vote on Councilman Gaston's Resolution
with the following results: Voting for: Councilmen Gaston and
Boone. Voting against: Mayor Schneider, Councilmen Poser and
Spader. Notion defeated. Councilman Boone requested that the Mayor's
campaign issue of not voting to create a tie and using second vote
to break a tie be entered in the records of this meeting. Mayor
Schneider stated that he had been advised by the Alabama League of
Municipalities Attorney that it Was his duty to vote and further
that in this instance he was not making and breaking a tie but was
voting as a member of the Council,

A RESOLUTION PROVIDING FOR THE
ELECTION OF MEMBERS OF THE BOARD
OF 'DIRECTORS OF THE PUBLIC BUILD-
ING AUTHORITY OF THE CITY OF

BE IT RESOLVED by the Mayor and City Counoil of the City
of Fairhope, Alabama, as follows:
(1) The Mayor and City Council (herein oalled "the
governing body") of the City of Fairhope (herein called "the oity")
In the State of Alabama (herein oalled "the state") have asoertained
and hereby find and deolare the following faots to be true:
(a) Aoting pursuant to the provisions of Aot
No. 493 adopted at the 1955 Regular Session of the
Legislature of Alabama, as amended and a resolution
adopted by the governing body on tie 27th day of
January 1964, Alton E. Schermer, Wm. R. Ruffles, Jr.,
and H. h. Anderson have duly exeouted and filed in
the offioe of the Judge of Probate of Baldwin County
a certificate of inoorporation of The Public Building
Authority of the City of Fairhope, together with a
oertified copy of a resolution of the governing body
approving the form and oontents of said oertificate
of incorporation and a oertificate by the Secretary
of State of the state that the name of the oorporation
Is not identical with that of any other corporation
in the state or so nearly similar thereto as to lead
to confusion and uncertainty;
(b) Said Judge of Probate had admitted to reoord
in said office the said certificate of incorporation,
together with the said documents attached thereto, and
thereupon the said authority beoame a body corporate
and politio and political subdivision of the state;
(c) The said oertificate of incorporation provides
that the board of direotors of said corporation shall
oonsist of three (3) members to be elected by the governing
body of the city in the manner and for the terms of offioe
provided by law; and
(d) By the provisions of said Act No. 493, as
amended, under which the corporation has been incorporated,
the first term of offioe of one of the direotors shall
be two years, that of another of the direotors shall be
four years, and that of the third director shall be six
years; and thereafter the terms of offioe of each direotor
shall be six years.
(2) The governing body shall now proceed to eleot
three members of the board of direotors of the said Corporation,
the terms of offioe of each of said members to begin on the date
of the adoption of this resolution, and to oontinue, in the case
of one of said direotors, for a period of two years from said date;
In the case of another of the said direotors for a period of four
years from said date; and in the case of the remaining direotor
for a period of six years from said date.
Adopted and approved this 9th day of March, 1964.

Councilman S ader and upon the motion being put to vote

The mayor announced that nominations would be received for
election of a member of the Board of Directors of The Public '
Building Authority of the City of Fairhope for a term commencing
on this date and continuing for a period of six years thereafter.
Thereupon, the following were nominated for said office:

No other nominations were made. The vote was as follows:
Yeas: Mayor Schneider, Councilmen Poser and Spader. Nays: None. -
Councilmen Boone and Gaston not voting. Councilman Nelson being
absent.
The Mayor then announced that Alton E. Schermer had been elected
as a member of said board of directors for the said term of six
years.
The mayor then announced that nominations would be received
for election of a member of the Board of Directors of The Public
Building Authority of the City of Fairhope /for a term commencing
on this date and continuing for a period of four years thereafter.
Thereupon, the following were nominated for said office:
Wm. R. Ruffles. Jr.
No other nominations were made.

The Mayor then announced that Wm, Ro Ruffles Jr. had been elected
as a member of said board, of directors ror a said term of four
years.
The mayor then announced that nominations would be received
for election of a member of the Board of Directors of The Public
Building Authority of the City of Fairhope for a term commencing
on this date and continuing for a period of two years thereafter.
Thereupon, the following were nominated for said office:

No other nominations were made. The vote was as follows:
Yeas: Mayor Schneider and. Councilmen Poser and Spader. Nays: None.
Councilmen Boone and Gaston not voting. Councilman Nelson absent.
The Mayor then announced that H. D. Anderson had been elected
as a member of said board of directors for the said term of two
years. ,
Councilman §Rader introduced the following resolution:
A RESOLUTION CONFIRMING THE ELECTION OF
THE MEMBERS OF THE BOARD OF DIRECTORS OF
THE PUBLIC BUILDING AUTHORITY OF THE
CITY OF FAIR PE
BE IT RESOLVED by the Mayor and City Council of the City of
Fairhope, Alabama, as follows:
The election by the said council at this meeting of the
following persons as members of the Board of Directors of The
Public Building Authority of the City of Fairhope for the res-
pective terms of office hereinafter set forth is hereby ratified
and confirmed, the members so elected and their respective terms
of office being as follows:

Councilman Spader thereupon moved that the said resolution be
adopted, wh a motion was seconded by Councilman Po_s_e_r, and, upon
the motion being put to vote the following vote was recorded:

The following letter was presented to the Council and the Business
Administrator was instructed to acknowledge same:

City of Fairhope, Alabama March 6, 1964
Gentlemen:
In all the legal sparring the other night at the Board of Adjustment
hearing, it was not relevant to discuss the merits of billboard
control, but please let me remind you that it is still true that
(1) our cities surely have a right to zone their streets
for the greatest good of the most people. (Many high-
grade cities have succeeded and we can, too.)
(2) the advertising industry is being subsidized by all
of us taxpayers who pay for roads and rights of way which
the billboard people use for their own profit. (Where would
they be without our roads?)
(3) the billboard boys are taking dollars away from our local
�newspapers and radios without even paying a license. (Many
Jllboards advertise out-of-town products. They also hurt
sidenee property values in the area.)
(4) outdoor advertising is making our roads ugly,
inefficient and unsafe.
(5) Fairhope can be one of the most beautiful cities
in the South it we keep working towards that goal.
And the prime need now is billboard control.

Letter from Huffman Insurance Agency on Airport Municipality
Liability Insurance was referred to the Airport Board.
Motion by Councilman Boone seconded by Councilman Gaston that
the Mayor be authorized to purchase necessary municipal election
supplies for voting machines to be used in municipal election
on August 11, 1964. Notion carried unanimously.
Motion by Councilman Gaston seconded by Councilman Spader that
the following Resolution be adopted. Motion carried unanimously.
RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, that an election is hereby called to be held on the
11th day of August, 1964 at the Fort Riel A ou
within the City of Fairhope for the purpose o eleezing a
Mayor and five Councilmen for the City for a four year term
commencing on the first Monday in October, 1964, at which said
election all registered and qualified elector residing within
the corporate limits of the City of Fairhope may participate.,
BE It FURTHER RESOLVED that the Mayor and City Clerk are
hereby authorized and directed to give notice of said election
by publication in the Fairhope Courier, a newspaper published
in the City of Fairhope, not less than 40 days before the date
of said election.
Motion by Councilman Gaston seconded by Councilman Boone that
the business license of Fairwood Groceyy be transferred from
Lloyd Vick to R. G. Pope for year 1964. Notion carried unanimously.
The request for City to pave approximately ?5 feet in Larson lane
and repair old paving was referred to the Mayor and City Superin-
tendent.
Motion by Councilman Gaston seconded by Councilman Boone that
Business Administrator be authorized to purchase Addressograph
machine at approximate cost of $1430.00., Notion carried unanimously.
After a general discussion between the Council and Miss Archer,
Mrs. Jones and Mr. and Mrs. Culver on drainage probAhm in the alley
adjoining their property, Councilman Gaston moved that the above
mentioned problem be on the agenda for the next regular meeting of
the City Council on March 23, 1964. Motion seconded by Councilman
Spader and carried unanimously.
]lotion by Councilman Boone seconded by Councilman Gaston that the
request of Robert Green for the City to install 1200 feet of sewer
trunk line across private property be denied. Motion carried
unanimously.
Table and chairs for the Council meeting room was disoussed
and tabled for further study.
Motion by Councilman Boone seoonded by Councilman Spader that
the following bills be approved for payment., Motion carried
unanimously.
