COUNTY OF BALDWIN
The City Council of the Cityof Fairhope met in regular session
at the City Hall Monday, January 27, 1964 at 7:30 P.M. with the
following members present: Mayor Schneider, Councilmen Boone,
Gaston, Poser , Nelson and Spader.
Minutes of the previous regular meeting were approved.
Mr. Byrne reported that Hte Municipal Airport has been completed
and license received. Mr. Lapeyrouse, Major Arnold and Mr. Deakel,
who are interested in the base operation of the Airport outlined
their proposed program.
Moore Engineering Co. reported that they had received authority
from the State Highway Department to procedd with relocation of
gas line on Highway 31 as F deral Aid Project No, F-193(10).
Motion by Councilman Poser seconded by Councilman Gaston that Moore
Engineering Co. be authorized to advertise for bids on relocation of
gas line on Highway 31 from Stapleton to the Gas Metering Station
south of Bay Minette. This project to be approximately 90%
reimbursable by the State. Bidders shall be notified that all
monthly estimates will have to he approved by the City and State which
will necessitate a certain amount of delay in payment to the
Contractor. Motion carried.
Motion by Councilman Poser seconded by Councilman Nelson that
the REsolution authorizing the Incorporation of The P+xblic Build-
ing Authority of the City of Fairhope, introduced at the regular
meeting of January 13, 1964 be adopted as introduced. Upon being put
to vote the following vote was recorded: Voting For: Mayor Schneider,
Councilmen: Nelson, Poser and Spdder. Voting Against: Councilmen
Boone and Gaston. Motion carried.
The said resolution as so intooduced on January 13, 1964, and as
finally adoapted, as aforesaid, at this meeting is in words and
figures as follows:
RESOLUTION AUTHORIZING THE
INCORPORATION OF THE PBBLIC
BUILDING AUTHORITY OF THE
CITY OF FAIRHOPE
WHEREAS, Alton E. Schermer, Wm. R. Ruffles, Jr., and
H. D. Anderson have filed with the Mayor and City Council (herein
sometimes called "the governing body") of this city an application
In writing for authority to incorporate under the provisions of Act.
No. 493, adopted at the 1955 Regular Session of the Legislature of
Alabama, as amended by Act No. 127 adopted at the 1956 First Special
Session of the Legislature of Alabama, a public corporation to be
known as The Public Building Authority of The City of Fairhope;
WHEREAS, the governing body has ascertained and found that
the said apblieants are natural persons, and are duly qualified
electors of and property owners in said city;
WHEREAS, --the governing body has examined the said applica-
tion and has found that the same is regular in all respects and
conforms with the requirements of the laws of Alabama, under which
the said corporation is proposed to be organized; and
WHEREAS, the said governing body deems it wise, expedient,
and necessary that the said corporation be foremd and that the persons
filing the said application be authorized to proceed to form the
said corporation;
NOW, THEREFORE, BE IT RESOLVED BY the Mayor and City
Council of the City of Fairhope, Alabama, as follows: ��

(1) The recitals contained in the foregoing
preambles are hereby found and declared to be true
and are hereby adopted as a part of this resolution..
(2) The said application is hereby granted
and the persons filing said application are hereby
authorized to proceed to form the said corporation
under the provisions of Act No. 493 adopted at the
1955 Regular Session of the Legislature of
Alabama, as amended.

RESOLUTION APPROVING THE FOAM
AND CONTENTS OF THE PROPOSED
CERTIFICATE OF INCORPORATION
OF THE PUBLIC BUILDING AUTHOR-
ITY OF THE CITY OF FAIAHOPE
BE IT RESOLVED by the Mayor knd. City Council (herein called
"the governing body") of the City of Fairhope, Alabama, that the
form and contents of the proposed certificate of incorporation of
a public corporation to be organized under Act No. 493 adopted at
the 1955 regular session of the Legislature of Alabama, as amended,
and to be named "The P$blic Building Authority of the City of
Fairhope," wdich have been submitted to the governing body for
their approval by the persons who have been authorized by the govern
ing body to become the incorporators of said corporation, are
found and declared to conform with the requirements of the laws of
Alabama and are herebyh approved.

Councilman Poser moved that unanimous consent be given for immediate
consideration of and action on said resolution which motion was
seconded by Councilman Nelson, and upon the motion being p t-to
vote the following vote was recordedt Yeas: Mayor Schneider,
Councilmen Nelson, Poser and Spader Nays: Councilman Boone.`
Councilman Gaston not voting., Notion for immediate consideration
defeated and now held for neat regular meeting of the City Council.
Motion by Councilman Boone seconded by Councilman Gaston that the
Public Building Authority Board be ordered to hold a referendum
giving the voters of Flairho a // an opportunity t vote on at least
three locations for the Municipal Auditorium (1� 60 acres Municipal
Park Land (2) Bed Cross Build site {) Or

provided a satisfactory negotiation on esul be worked out with the
Single Tax Corporation.' Upon being put to vote the follows vote

The committee appointed to evaluate bids on new fire truck recommended
that the low bid of Walter Kidde Sales & Be ice be accepted and
that additional equipment in the amount of 1 244.84 be purehased.�
Notion by Councilman Nelson seconded by Councilman Spader that City
accept the low bid submitted by Walter Kidde Sales and Service in
the amount of #24,969.°g0 fo fi e t ek and purchase additional.

Motion by Councilman Poser seconded by Councilman Gaston that the
Building Inspector be instructed to issue building permit to Walter
loxham on Bayview Subdivision off Gayfer Street as requested when
'%00:�00 bond required for paving has been approved.' Motion carried.
Notion by Councilman Gaston seconded by Councilman Spader that the
Lions Club be allowed to install Library Sign on Fairhope Avenue and
Summitt Street,, Sign to be approved by the Building Inspector:'
Notion carried. -
Street drainage problem at 420 White Avenue was discussed and the
City Superintendent was instructed to check on easement and cost
and report a t the next regular meeting of the Council.
The Business Administrator was instructed to get cost of street and
Parkin
g zone painting for the nexxt regular meeting of the City
Council.
Mr.' P. A. Frederick reported water erosion damage to his property
on Fly Creek.' No action taken.
Motion by Councilman Nelson seconded by Councilman Gaston that the
following Ordinance beffiIntrodueed. Motion carried.
ORDINANCE # 320
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE
that the salaries of the Councilmen for the City of Fairhope be fixxed
at the sum of $600.-00 per year, payable monthly, for the term which
commences October, 1964
Notion by Councilman Nelson seconded by Councilman Gaston that the
following Ordinance be introduced. Notion carried.
ORDINANCE #321
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE
that the salary of the Myor of the City of Fairhope be fixed at
the sum of $3,000.00 per year, payable monthly, for the term which
commences October, 19640
Letter from A.! Mil Gates pertaining to sewer line was referred to the
City Superintendent:
Motion by Councilman Nelson seconded by Poser that aletter of apology
be written to proposed Building Board members for remarks made at a
previous regular meetl!jq of the City Council. Councilman Boone said
that he did not have re erenoe to the proposed Building Board but that
he was not in favorot any Boards as they take money and authority out
of the hands of the elected officials. Councilman Gaston said that he
would have to vote no as he felt that such a letter was not necessary
as there was nothing derogatory intended toward the proposed members
of the Board. Upon being put to vote the following vote was recorded:
Voting for: Councilmen Nelson, Poser and Spader. Against: Councilman
Gaston, Councilman Boone.
Notion by Councilman Nelson seconded by Councilman Poser that the
