County of Baldwin
The City Council of the City of Fairhope met in regular
session at the City Hall, Monday, January 13, 1960 at 7:30 P. M.
with the following members present: Mayor Schneider, Councilmen:
Boone, Gaston, Nelson, Poser & Spader.'
Motion by Councilman Poser seconded by Councilman Nelson
that the minutes of the previous regular meeting and special meeting
of January 6, 1964 be approved.• Motion carried✓
Motion by Councilman Nelson seconded by Councilman Gaston
v that the City purchase a new Addressograph machine and equipment
at a cost of $802.05 with trade in of old machine. Motion carried.
The mayor announced that an application in writing had
been filed with the board applying for authority to incorporate a

public corporation under the provisions of Act No. 493 adopted at
the 1955 Regular Session of the Legislature of Alabama, as amended;
that the said application had been signed by Alton E: Schermer,
William R` Ruffles, Jr., and H. D: Anderson, each of whom is a
qualified elector of and property owner in the city; and that said
application was accompanied by a copy of the proposed form of the
certificate of incorporation for the said corporation and a copy of
certificate of the Secretary of State to the effect that the name
proposed for the corporation is not identical with that of any other
corporation in this state or so nearly similar thereto as to lead to
confusion or uncertainty, which application, proposed form of eerti-
fieate of incorporation and copy of certificate of the Secretary of
State are in words and figures as follows:

to the provisions of Act No. 4939 adopted at the 1955 Regular
Session of the Legislature of Alabama, as amended by Act No.- 127
adopted at the 1956 First Special Session of the Legislature of
Alabama, for the purpose of providing buildings for lease to and
use by the said municipality, the United States, a and any other
public corporation or public entity to which property may be leased
under the said Act No.� 4939 as amended; and we do hereby request
that said application be granted and that a proper resolution be
adopted by you authorizing the incorporation of such a public
corporation.

of -a, proposed certificate of incorporation of such corporation
together with a copy of the certificate of the Secretary of State
of Alabama to the effect that the name proposed for such corporation
is not identical with that of any other corporation in this state
or so nearly similar thereto as to lead to confusion and uncertainty, -
It is contemplated that,if this application is granted by you
before the said certificate of incorporation is filed there will
also be attached thereto a certified copy of whatever resolution 1s
made by you approving the form and contents of said certificate of
incorporation.

The undersigned,
desiring and having been authorized by the governing body of the City
of Fairhope in said county to organize a body corporate under Act
No., 493 adopted at the 1955 Regular Session of the Legislature of
Alabama, as amended, and being all of the incorporators of the
corporation hereby organized, do make, sign and file this certificate
of incorporation as followst
(1) The names of the persons forming the corporation are
as follows
Each of the said persons resides
in the said City of Fairhope in the State of Alabama. The residence
addresses of'the said persons are as followst
Each of said persons is over the age of twenty-one years and is a
duly qualified elector of and property owner in said municipality.,
(2) The name of the corporation is and shall be The Public
Building Authority of the City of Fairhope.
(3) The location of the principal office of the corporation
shall be in the City of Fairhope in the State of Alabama.
(4( The corporate power shall be exercised by a board of
directors, which shall consist of three members, who shall be resi-
dents of the said munioipality and shall be elected by the governing
body of the said munieipality.' None of the members of the said
board of directors shall be an officer of the State of Alabama of
of the said munioipality.• The members of the board of directors shall
be elected in the manner and hold office for the terms as provided
by law.
(5) The duration of the existence of the corporation
shall be perpetual, unless it shall be sooner dissolved pursuant to
Section 21 of said Act No: 493, as amended:

(6) The corporation shall have all peters conferred on
corporations of like nature by said act of the Legislature of
Alabama under which the corporation is organized and any amendment
thereof heretofore or hereafter made, and all other powers conferred
upon corporations generally by the laws of Alabama not in conflict
therewith:

city an application in writing for authority to incorporate under
the provisions of Act No• 493s adopted atX the 1955 Regular Session
of the Legislature of Alabama, as amended by Act No' 127 adopted at
the 1956 First Special Session of the Legislature of Alabama, a
Public corporation to be known as the Public Building Authority of
the City of Fairhope;
WHEREAS, the governing body has ascertained and found
that the said applicants are natural persons,' and are duly qualified
electors of and property owners in said city;
WHEREAS, the governing body has examined the said applioa-
tion and has found that the same is regular in all respects and
conforms with the requirements of the laws of Alabama under which the
said corporation is proposed to be organized; and
WHEREtiAS, the said governing body deems it wise, expedient,
and necessary thALt the said corporation be formed and that the
persons filing the said application be authorized to proceed to form
the said corporation;
NOW, THEE isFORE, BE IT RESOLVED by the Mayor and City Council
of the City of Fairhope, Alabama, as follows
(1) The recitals contained in the foregoing
preambles are hereby found and declared to be
true and are hereby adopted as a part of this
resolution:'
(2) The said application is hereby granted
and the persons filing said application are
hereby authorized to proceed to form the said
corporation under the provisions of Act No.
4939 adopted at the 1955 Regular Session of
the Legislature of Alabama, as amended.

Councilman Poser moved that unanimous consent be given for immediate
consideration of and action on said Resolutinn which motion was
seoonded by Councilman Nelson and upon the motion being put to vote
the following vote was recorded: Yeast Mayor Schneider and Council-
men Nelson, Poser and Spadere Nays: Councilmen Boone and Gaston.

Councilman Poser thereupon moved that said Resolution be introduced
which motion was seconded by Councilman Nelson and upon the motion
being put to vote the following vote was recorded: Yeas: Mayor
Schneider, Councilmen Boone, Gaston, Nelson, Poser and_Spader-
Notion carried.
Representatives for March of Dimes requested roadblock
for their project:` Motion by Councilman Poser seomd.ed by Councilman
Nelson that permission be granted for roadblock under the supervision
of the Chief of Police.' Motion parried.
This being date set for opening bids on new fire truck,
the following bids were received and read to the meeting:

Motion by Councilman Poser, seconded by Councilman Boone
that the committee check bids and report to the next regular meeting
of the Council.- Lotion carried,,'
Motion by Councilmen Boone seconded by Councilman Poser
that $300 00 be authorized for culvert on Mershon Street to open
Mershon from Nichols to Middle Street. Motion carried.
Notion by Councilman Nelson seconded by Councilman Boone
that the city purchase 2 additional Plectron Units for Fire Depart-
ment. Notion carried. -
Petition from Residents on Greeno Road for Water line was
presented to the Council. Council requested that approximate cost
of line be presented to Council.
Notion by Councilman Boone seconded by Councilman Gaston
the contract of United Gas Pipe Line Co., be tabled for present time.
Notion carried.,
Contract with Mr: Fred Woods, Arehiteet,was held for next
meeting of the Council.
Claude Arnold representing Sinclair Oil Co requested
approval by the Council of Rezoning Lot 13-149 Oswalt Subdivision
from R-1 to B-1. Motion by Councilman Boone seconded by Councilman
Poser that if the Planning Board records show that Lot 13-14, Oswalt

Subdivision was rezoned from A-1 to B-1 that Council approve the
rezoning from 8-1 to B-19 the City Attorney to check the records.`
Notion carried:
A petition from property owners on Azalea Street requesting
Street paving was presented. Notion by $ouncilman Boone seconded
by Councilman Poser that if 51% of the property owners on Azalea
Street from Dogwood to Nichols request paving, that'it-be included
in the next paving venture and that a copy of this motion be
mailed to the City engineer: Notion carried.
Dr, Mallins, Chairman of the Municipal Airport Board,
reported that the Airport has been completed and final inspection
has been delayed to insure that there will be sufficient grass on
the graded area to conform to specifications. Motion by Councilman
Boone seconded by Councilman Nelson that the Chairman and members
of the Airport Board be commended on outstanding job in completing
the Airport within the funds allotted: Notion carried.

Gaston that the Council is in favor of obtaining a National Guard
Aircraft Military Unit for operation at the Municipal Airport.

Gaston that bill of Williams & Bouler and Byrd L.' Moore Co: on
1963 Street Improvement be approved for payment.` Notion carried:

We, the undersigned natural persons, each
of whom is a duly qualified elector of and owner of
property in the said municipality, do hereby file
with you as the governing body of said municipality
