HomeMy WebLinkAbout10-28-1963 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope met in regular session at the City Hall, Monday, October 28, 1963 at 7:30 P. M. with the following members present: Mayor Schneider, Councilmen: Boone, Gaston, Nelson, Poser and Spader. The minutes of the previous regular meeting were approved. Traffic on Mobile Avenue was discussed and the Council agreed to install Caution light. Casino license discussed, no action taken. Motion by Councilman Poser seconded by Councilman Gaston that upon the recommendation of the Police Department, the request of Herbert Williams for Dance Hall License be rejected. Motion carried. Marking parked cars in the downtown area was discussed. Motion by Councilman Poser seconded by Councilman Boone that the City request letter from Chamber of Commerce Committee stating their views on same. Motion carried. This being date set for hearing protests on Street Improve- ments on Pensacola Avenue the following protests were heard: John W. Craig, owning 440 feet, stated that improvements would not improve his property. A. L. McLendon, owning 187 feet, stated that his Lot was not worth the paving. W. P. Clemens, owning 450 feet, represented by John W. Craig, protesting that the improvements would not improve his property. Motion by Councilman Poser seconded by Councilman Boone that the following Ordinance be introduc e %2 Motion carried. ORDINANCE r An Ordinance confirming Improvement Ordinance #315, Adopted September 30, 1963. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA AS FOLLOWS: Section 1. That upon evidence presented to and considered by it, the City Council does hereby make a. finding and deter- mination of the following facts: (a) At a regular meeting of the City Council of the City of Fairhope, held on the 30th day of September, 1963, Improve- ment Ordinance No. 315 was adopted and notice of the adoption of said Ordinance was given by publication of said Ordinance in the Fairhope Courier, a newspaper published in and of general circulation in the City of Fairhope, in the issues of October 10 and October 17, 1963, which said Ordinance stated that the City Council of the City of Fairhope would meet on the 28th day of October, 1963, at 7:30 P. M. at the City Hall in the City of Fairhope to hear any objections, remonstrances or protests that might be made to said improvements or the character of the material or materials to be used, and the manner of making the same. (b) A copy of said Improvement Ordinance No. 315 was sent by registered mail, postage prepaid, to each of the persons last assessing for City taxation the property proposed to be assessed 3,�`V for said improvements at their last known addresses; said notice having been mailed on the 7th day of October, 1963s more than ten days prior to the 28th day of October, 1963. (c) The protests of John W. Craig, A. L. McLendon and W. P. Clemens to the improvements of Pensacola Avenue have been heard, considered and disallowed. (d) No other protests, objections or remonstrances against said improvements, or the character of materials to be used and the manner of making said improvements have been filed in writing with the City Clerk or in her office, or have been made at this meeting. Section 2. That Improvement Ordinance No. 315 entitled "An Ordinance to Provide for Certain Improvements on Pensacola Avenue in the City of Fairhope, Alabama" is hereby in all things ratified and confirmed. Mayor Attest: City Clerk Motion by Councilman Boone seconded by Councilman Gaston that the following Resolution be adopted. Motion carried. ,✓ RESOLUTION A RESOLUTION CONFIRMING IMPROVEMENT ORDINANCE NO. 3169 ADOPTED SEPTEMBER 30,1563. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA as follows: Section 1. That upon evidence presented to and considered by it, the City Council does hereby make a finding and deter- mination of the following facts: (a) At a regular meeting of the City Council of the City of Fairhope held on the 30th day of September, 1963, Improve- ment Ordinance No. 316 was adopted and notice of the adoption of said Ordinance was given by publication of said ordinance in the Fairhope Courier, a newspaper published in and of general circulation in the City of Fairhope in the issues of October 10 and October 17, 1963, which said ordinance stated that the City Council of the City of Fairhope would meet -)on the 28th day of October, 1963 at 7:30 P. Attest: No. 316, entitled "An Ordinance on Washington Drive West hereby in all things ratified Mayor City Clerk 3�� y L Motion by Councilman Boone seconded by Councilman Spader that Moore Engineering Company be authorized to advertise for bids for Street Improvements on Pensacola Avenue and Wash- ington Drive West. Motion carried. Mr. Harold Yates requested that the Council extend water line to the City Limits at Highway 104. Motion by Councilman Nelson seconded by councilman Poser that the City agree to proceed with extension of water main to Highway 104 at such time as the City has proof of contract with Gulf Coast Exper- imental Station. Motion carried. Per. Sam Dyson requested the Council to exclude 811, now occupied by Dyson building under party wall agreement, from the condemnation proceedings for City Hall land. Motion by Councilman Nelson seconded by Councilman Gaston that the City Attorney be instructed to exclude 8" from condemnation proceed- ings as requested by Mr. Dyson, iy'':otion carried. Motion by Councilman Poser seconded by Councilman Nelson_ that the Mayor and City Attorney be authorized to negotiate with Material Sale Company and the Fairhope Single Tax Corporation with view of getting same lease for City Hall and adjoining property and report back to the City Council. Motion carried. Robert Green met with the Council with reference to re- zoning Greeno Road. Referred to the Zoning and Planning Commission. Motion by Councilman Boone seconded by Councilman Gaston' that the following Ordinance be introduced: Motion carried. ORDINANCE # 318 AN ORDINANCE REQUIRING FIFTY FOOT SET BACK FROM PROPERTY ' LINE ON GREENO ROAD. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE that : No building shall be erected, improved, remodeled or moved so that it shall be nearer than fifty feet from the property line of Greeno load, and any person, firm or corporation who shall erect, improve, remodel or move any building in violation of this Section shall remove the same upon notice of the Mayor requiring such removal. The building inspector of the City of Fairhope shall not issue any building permit allowing a building in violation of this Section. This Section shall be effective from the date of its publication, Motion by Councilman Nelson seconded by Councilman Poser that Leo Gilheart be appointed as Chief of Police. Motion carried. Jack Kirk presented plan for future traffic control. Motion by Councilman Poser seconded by Councilman Nelson that the Fairhope Police Ambulance be used for extreme emergency cases only. Motion carried unanimously. Dr. Mullins, Chairman of the Municipal Airport Board, gave a financial report of the Board and reported on progress of the Contractor. A letter from the City's Fiscal Agent concerning the Daphne Gas Contract was read to the meeting. Motion by Councilman Poser seconded by Councilman Boone that the meeting adjourn. Motion carried.
