HomeMy WebLinkAbout09-30-1963 Adjourned Regular MeetingN STATE OF ALABAMA COUNTY OF BALDWIN The Mayor and City Council of the City of Fairhope, Alabama, met in adjourned regular session at the City Hall in the city on September 30, 1963, at 7:30 o'clock, P. M., pursuant to adjournment of the regular meeting held on September 23, 1963. The meeting was called to order by Joe Schneider, the Mayor, and upon roll call the following were found,to be present: Mayor Joe Schneider and,the following members of the City Council: Lester I. Boone, James E. Gaston, Jr., William J. Nelson, Walter 0. Poser and Richard J. Spader. The following were found to be absent: None. The Mayor presided and Marie Moore, the City Clerk, who was also present, acted as clerk of the meeting. The Mayor stated that aquorum was present and declared the meeting open for the -,transaction of business. Y Ms. Lacey, representing the Chamber of Commerce, outlined work of the Chamber in securing a Junior College in Fairhope. After a general discussion Councilman Gaston moved that the following Resolution be adopted. Poser. Motion seconded by Councilman BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE that the City is desirous of locating a Junior College within the City of Fairhope. The City is willing to procure a desired site, after due consideration is given to the site by the Planning and Zoning Commission, should it be decided to locate the college in the City. Motion carried unanimously. Upon recommendation by the Building Committee Councilman Poser introduced the following resolution which was read to the meeting: BE IT RESOLVED by the Mayor and City Council (herein called "the council") of the City of Fairhope (herein called "the city") in the State of Alabama, as follows: (1) The council hereby finds, determines and declares as follows: in order effectively to carry on the governmental and 0 3 Q- WOO public functions of the city, it is necessary and desirable that a new building or buildings for use as a city hall and jail be constructed in the city; it is necessary and desirablelin the best interests of the city and its inhabitants that a city aud- itorium to be used for municipal meetings and functions involving large numbers of people, other public meetings, concerts, art exhibits, other exhibitions, athletic contests, and other purposes for which auditoriums are customarily used; it is also necessary and desirable and in the best interests of the city and its inhab- itants that public grounds in the city be improved for use as a public park, the said improvements to include a public bath or public swimming pool and other public recreational facilities appropriate as part of a municipal park; the city has recently acquired at a cost of approximately $64,000 a tract of land in the city containing sixty acres more or less, a portion of which will be appropriate for construction thereon of a city auditorium and a portion of which willl be appropriate for use as a municipal park; preliminary investigations by the council have disclosed that a proper means of securing the necessary funds to construct the said city hall and jail building or buildings would be the issuance of general obligation bonds of the city in the approxi- mate amount of $100,000 for the purpose of financing the construc- tion thereof and that it is desirable that an election on the issuance of such bonds be held in the city in the month of December, 1963, on the same date on which statewide elections will be held on certain constitutional amendments proposed at the 1963 Legis- lature, and the said bonds to run over a period of 20 years, to mature in the approximate principal amount of $5,000 on February 1 of each year and to be secured by a pledge of the five mill tax that the city is presently levying and that it is authorized by amendment VIII to the Alabama Constitution to levy for the purpose of paying the principal of and interest on bonds; that an appro- priate procedure with respect to the proposed city auditorium would be for the city to approve the incorporation of a Public Building Authority under Act No., 493 adopted at the 1'955 Regular Session of the Legislature of Alabama, as amended, it being con- templated that the Public Building Authority would issue its bonds in the approximate principal amount of 42,50,000 for the purpose of financing construction of the auditorium, that the city would lease the auditorium and appurtenant ground from the Authority by a lease for one year with option of the city to renew for succes- sive years, and with rental payments by the city in amounts suffi- cient to enable the Authority to retire its bonds, and that the city sell approximately thirty acres of said tract of land td the Authority for approximately $329000 for construction thereon of the auditorium; and it is desirable and in the best interests of the city and its inhabitants that the city would develop the re- maining thirty acres as a public park with public grounds, with a public bath and other recreational park facilities as aforesaid, and other additional uses that may be determined by the City, it' being contemplated that the city will finance the development of the said park and public grounds as a cost estimated at approx- imately 075,000 with funds that it presently has on hand and with the sum of $32,000 that it would receive from the sale of the said real estate. (2) The Mayor of the city is hereby authorized and directed to proceed with further study and investigation of the matters referred to in the foregoing paragraph (1)9 including consulta- tions and negotiations with fiscal agents, architects, attorneys and others and to inform the council as to the appropriate time or times for formal action to be taken in connection with the fore- going matters. Adopted and approved this 30th day of September, 1963. The. Mayor thereupon announced that the motion for adoption of said resolution had been unani- mously carried and he then signed the resolution. Motion by Councilman Boone, seconded by Councilman Nelson that Ordinance #315 be introduced and request unanimous consent for immediate adoption. IMPROVEMENT ORDINANCE NO. 315 An ORDINANCE TO PROVIDE FOR CERTAIN IMPROVEMENTS ON PENSACOLA AVE.IN THE CITY OF FAIRHOPE, ALABAMA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, Alabama, as follows: Section 1. That the following described street in the City of Fairhope, Alabama, shall be improved as hereinafter provided between the respective terminal points hereinafter set forth: (a) PENSACOLA AVENUE shall be improved from the east edge of the proposed pavement on Tensaw Avenue to the north edge of proposed pavement on Seminole Avenue, a distance of 450 linear feet, as follows: Both edges of a 20 foot roadway, the center line of which shall be approximately 16.5 feet southwest of the centerline of the above described portion of said street, shall be graded, paved, drained and concrete curb and gutter constructed along each edge of the pavement; that the pavement shall be one and one-half inch compacted Plant Mix Bituminous Wearing Course composed of mineral aggregate and asphalt cement on a six inch sand clay base; that the curb and gutter shall be constructed of Portland Cement concrete along each edge of the pavement on said roadway. Section 2. That the full details, drawings, plans, specifi- cations and surveys of the above described work and estimates which have been prepared by BYRD L. MOORE & CO., who has been duly designated and appointed City Engineer by this Council, for this purpose, have been fully considered and studied by this Council and hereby are adopted. Said details, drawings, plans, specifications, surveys and estimates shall be immediately placed -5- on file in the office of the City Clerk where property owners who may be affected by such improvements may see and examine the same. Section 3. That the improvements hereinabove described shall be made in accordance with the grades shorn in the plans and specifications heretofore established and now on file in the City Hall. Section 4. That the cost of constructing said improvements shall be assessed against the property abutting on the portions of the streets so improved, provided: (a) That the cost of improving any intersection or any part thereof shall be assessed against the lots or parcels of land abutting on each of the streets, avenues, alleys or other highways so intersecting for a half block in each direction there- from; provided that for the purpose of computing assessments, no block shall be considered as extending more than 1,000 feet from any intersection so improved.' (b) That no assessment shall exceed the cost of the im- provements or the increased value of such property by reason of the special benefits derived from such improvements. Section L. That the City Council shall meet on the 28th day of October, 1963, at 7:30 o'clock, P. M. at the City Hall in the City of Fairhope, Alabama, to hear any objections, remon- strances or protests that may be made against said improvements, the manner of making the same or the character of materials to be used. Section 6. This ordinance shall be published once a week for two consecutive weeks in the Fairhope Courier, a newspaper published and of general circulation in the City of Fairhope, Alabama, the date of the first publication to be not less than two weeks before the 28th day of October, 1963. Section 7. A copy of this ordinance shall be sent by regis- tered mail, postage prepaid, to the persons last assessing for City taxation the property which may be assessed for said improve- ments, at their last known addresses, said notices to be so mailed by the City Clerk not less than ten days prior to the 28th day of October, 1963. -6- Upon being put to a vote the following vote was recorded: For: Mayor Joe Schneider, Councilmen Boone, Gaston, Nelson, Poser, and Spader.` Against: None. Motion carried. Motion by Councilman Boone seconded by Councilman Poser that Ordinance #316 be introduced and request unanimous consent for immediate adoption. IMPROVEMENT ORDINANCE NO. 316 AN ORDINANCE TO PROVIDE FOR CERTAIN IMPROVEMENTS ON WASHINGTON DRIVE WEST IN THE CITY OF FAIRHOPE, ALABAMA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, as. follows: Section 1. That the following described street in the City - of Fa:bhope, Alabama, shall be improved as hereinafter provided between the respective terminal points hereinafter set forth: (a) WASHINGTON DRIVE WEST shall be improved from the west edge of the existing pavement on Washington Drive thence westerly to the east boundary of the proposed Right -of -Way of Bon Secour Avenue, a distance of 400 linear feet, as follows: Both edges of a 20 foot roadway, the centerline of which shall be located in the center of the dedicated street, shall be graded, paved, drained, and concrete curb and gutter constructed along wach edge of the pavement; that the pavement shall be one and one-half inch compacted Plant Mix Bituminous Wearing Course composed of mineral aggregate and asphalt cement on a six inch sand clay base; that the curb and gutter shall be constructed of Portland Cement concrete along each edge of the pavement on said roadway." Motion carried. 114 Motion by Councilman Nelson, seconded by Councilman Spader that the City appropriate $150.'00 each for four firemen to attend Arson School in Montgomery, Alabama, during the week of October 21, 1963- Motion carried. Motion by Councilman Poser seconded by Councilman Gaston that the City appropriate up to $250.00 for Business Administrator J to attend American Public Power Association's Ninth Annual Accounting and Finance Workshop in Washington, D. C., October 23s25, 1963. Motion carried. The following committee was appointed to meet with Daphne on Gas System: Mayor Schneider, Councilman Gaston, Business Administrator Peter J. THE ENGINEER (a) will, prepare construction plans and specifications for a new deep well water supply and corrective water treatment plant. (b) will submit these documents to the State Department of Health for approval and will furnish the City with an approved set. (c) will furnish prospective bidders with copies of the plans and speci- fications, will tabulate and check the proposals submitted and will recommend an award of contract. (d) after the contract has been awarded, will review and approve the shop drawings and equipment schedules submitted by the contractor, and will visit the project for consultations during the construction period if so requested by the City. 2,. THE CITY (a) will pay the engineer for the above enumerated services a fee of 50 of the final construction cost of the improvements payable as follows: (1) 5% of the cost of the improvements upon award of each construct- ion contract. (2) upon completion of the construction work an amount which added to the other payments will equal 5J% of the final construction cost.
