County of Baldwin
The City Council of the City of Fairhope met in a regular session
at the City Hall, Monday, September 25, 1961 at 7:30 P.M, with the
following members present: Mayor Schneider, Councilmen: Boone,
Gaston, Nelson, Poser and Schermer.
Motion by Councilman Schermer, seconded by Councilman Gaston that
Eloise T. Nilson be appointed acting City Clerk in the absence of
Marie Moore. Motion carried.
Motion by Councilman Boone, seconded by Councilman Poser that the
Council dispense with the reading of the minutes of the last meet.

Capt. Lawrence Blatchford appeared before the Council with informa-
tionnof a Voluntary Military Unit, State Militia, when the National
Guard moves out.

Councilman Boone reported that the property owners of Blue Island
• Avenue are agreeabld to paying the cost of clearing and grading
Blue Island Avenue. Motion by Councilman Boone seconded by Council-
0 man Poser that the following resolution be adopted.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPF,
ALABAMA that the City of Fairhope clear and grade Blue Island Avenue
o with the cost of same to be borne by the property owners. Motion
carried.
John Hulsebosch, 405 South Church Street, requested ruling on
permissibility of construction of a bomb shelter jointly with his
neighbor locating same across the common property line. Mr. Byrne
was instructed to present this problem to the Planning Board.
Motion by Councilman Boone seconded by Councilman Poser that the
following resolution be adopted.
BE IT RESOLVE? BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA that Byrd L. Moore & Co. be instructed to prepare plans and
specifications for street improvements on Orange Street between
Satsuma and Pomelo Streets, including in addition curb and gutter
and the necessary paved strip in front of J,.-Walter Huggins'
property as outlined in City letter to property owners. This work
to be done on the assessment basis. Upon being put to a vote the
following vote was recorded: Voting for: Councilmen Boone, Schermer,
Gaston,. Poser; Councilman Nelson not voting. Motion carried.
Motion by Councilman Boone, seconded by Councilman Poser that the
following resolution be adopted:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA that Byrd L� Moor'e & Co. be instructed to prepare plans
and specifications/for street improvements, including curb and
gutter, on Satsuma Street between Pier and Laurel Streets. Motion
carried.
The following resolution was moved by Councilman Poser,'seconded by
Councilman Nelson and upon being put to a vote, was duly carried:
Whereas the Mayor and Council consider it adyis7able for the
City to proceed at this time with the water works and natural gas
improvements which have been under consideration for the past
several months, and
Whereas it is considered advisable to postpone the proposed
improvements along U. S. Highway 31 from the United Gas delivery
point to the south terminus of the proposed 4 lane highway.

Therefore be it resolved,
Section 1: That the City's consulting engineer, Donald Mills,
be and he is hereby authorized to proceed immediately with the pre-
paration of plans, specifications and bidding documents covering the
proposed water works and natural gas improvements with the exception
of the portion along U. S. Highway 31 as defined above.
Section 2: That the Mayor be and he hereby is authorized to
execute the amended engineering agreement with said Donald Mills dated
September 25, 1961, and
Section 3: That the City's fiscal agent, Hugo Marx and Company
be and they are hereby authorized to proceed immediately with the
preparation of the bond issue to finance all of the contemplated
improvements plus the authorizing of an additional $500,000.00 for
possible future improvements.
In accordance with Section 2 of the above Resolution the following
Agreement was executed by Mayor Schneider and the Consulting
Engineer Donald Mills.

THIS AGREEMENT made between the City of Fairhope, Alabama and
Donald Mills, Consulting Engineer, Selma, Alabama, witnesseth that
whereas the City contemplates the construction of certain Water Works
and Natural Gas improvements and desires to engage the services of
the Engineer in connection therewith, the parties hereto agree as
follows:
THE ENGINEER
(a) will make the necessary studies, investigations and preliminary
surveys of the proposed improvements and prepare an:' engineering
report covering the same.
(b) will confer with the City regarding the recommended improvements
and will make such changes as are requested.
(c) will prepare complete plans, specifications and contract docu-
ments covering the improvements decided upon and furnish the City
with the necessary number of sets required by bidders.
(d) will assist the City in obtaining bids from contractors, will
be present at the bid opening to check the bids and recommend awards
and will prepare the necessary contract documents.
(e). will provide the necessary supervision of the construction of the
proposed elevated tank.
THE CITY
(a) will pay the Engineer for his services a fee of 5% of the cost
of the improvements as represented by the amount of the contracts
awarded, payment to be made when such awards are made.
(b) will pay the Engineer an -additional fee of 1% of the contract
price of the elevated tank only.
(c) will provide the necessary inspection and supervision of all
other work with the exception of the elevated tank.
THIS AGREEMENT is dated September 25, 1961 and shall remain in
effect until September 30, 1964.

Letter from Dr. Foster to Dr. Nelson concerning sanitation was read.
Motion by Councilman Nelson, seconded by Councilman Poser, that the
City of Fairhope appropriate $55.00 per month to the Baldwin County
Health Department, beginning October 1, 1961 and ending October 1,
1962, this appropriation in lieu of all other moneys to be paid there
by the City. Motion carried.
The following letters were read and appropriate action taken on each.
Letter from Executive Board of Theater 98 regarding their part in the
Civic Center.
Letter from Paul Strickland regarding S. Summit Street paving.
Letter from Mr. 0. R. Swanson regarding the location of a utility
pole.
Motion by Councilman Nelson seconded by Councilman Poser that the
application for beer permit of Phillip Mitchell on Greeno Blvd. be
denied. On being put to a vote the following vote was recorded:
Voting for;Councilmen Boone, Poser, Gaston, Nelson. Voting against:
Councilman Schermer. Motion carried.
Motion by Councilman Boone, seconded by Councilman Nelson that the
following resolution be adopted:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA that Byrd L. Moore & Co. be instructed to prepare plans and
specifications for street improvements, consisting of curb and gutter
and off the street parking, on the Baptist Church side of South
Section Street. Motion darried.
Motion by Councilman Poser, seconded by Councilman Boone, that the
meeting adjourn. Motion carried.
