County of Baldwin
The City Council of the City of Fairhope met in regular session at the
City Hall, Monday, May 6, 1961 INO at 7230 P.M. with the following
members presentr Mayor Joe Schneider, Councilmens: Boone, Gaston, Nelson
and Schermer. Councilman Poser being absent.
The minutes of the previous regular meeting were read and approved as
read.

Council and placed on file: for further consideration.
Mr. C ov i ngton and Mr. Howe requested the Counc i I to open B I us.. I sl and: Avenue.
A -letter from Mrs. Sly/e and Mrs. Porter pertaining to the sale of lot and
private pier on the beach was prresented,and taken under advisement.
Ooel Gttffim requested the Council to Locate street in Votarnte area as
, per pbat on file. The Council agreed to stake the street„ Mr. Griffin to
char might -of -way to his property.

Mr. Willett, representing Dixie Laboratories, Inc., presented estimate
for permanent protection with Speed -Crete of new piling on proposed
extension and T for the Fairhope Pier. Estimate taken under advisement.
Motion -by Councilman Nelson seconded by Councilman Boone that the follow-
ing be appointed to the Board of Managers of the School of Organic Educations
Mr. Joe Schneider for three years, Mrs. Helen Dyson for two years and Mr.
Marvin Berglin for one year. Motion carried.
Motion by Councilman Gaston seconded by Councilman Nelson that the following
Resolution be adppted: Motion carried.
BE IT RESOLVED- BY THE C ITY COUNC IL OF THE CITY OF FAIRHOPE that the
Merchants National Bank of Mobi I'e- as Trustee for. the Water and Sewer Revenue
Bonds, be authorized to invest moneys in the Water and Sewer Surplus Fund
tin Government Bonds which mature on or, before July i, 1963.
motion by Councilman Gaston seconded by Councilman Nelson that the Police
Department be allowed #1.00.00 per year per man to cover uniform expense.
Motion carried.
Bids having been received for small amount of street work on Center Street,
Counci Iman Nelson moved that the bid of Joe Schneider and Son, Inc. be
accepted, Motion seconded by Councilman Gaston. Upon being put to vote
the fol I owi ng vote was rrecordladi.Vot i ng For: C ounci I men Boone, Gaston and
Nelson. Councilman Schermer- not voting. Motion carried.
Motion by Councilman Gaston seconded by Councilman Nelson that the following
Resolution be adopteds
BE IT RESOLVED BY THE CITY COUNC IL OF THE CITY OF FAIRHOPE, ALABAMA,
that,
WHEREAS the Marietta Johnson School of Organic Education Folk Dance
Team is attending the National Folk Dance Festival at Washington, D. C. and,
WHEREAS the City of Fairhope will derive much valuable advertising
from the Schools attendance at this festival,
NO# THEREFORE BE IT RESOLVED that the City pay to the School the sum
of #200,00 to send this dance team to this festival.

men Boone, Gaston and Nelson. Voting Against: None, Councilman Schermer not
voting. motion carried.

ORDINANCE- # 279 ,
Ordinance Fixing Recorder's Court Costs
BE IT MDAINED by the City Council of the City of Fairhope,
Alabama:
SECTION 1. That all fines imposed by the Recorder shall be
paid in lawful money of the United States of America.
SECTION 2. That all fines, penalties, forfeitures an re-
coveries for violation of any law or ordinance of the City shall
be for the use and benefit of the City unless otherwise expressly
provided.
SECTION 3. That upon each conviction in the Recorder's Court
of the City for a violation of any ordinance of the City there
shall be taxed against defendant as court costs the sum of Six
Dollars and Seventy-five Cents ($6.75); provided that in any case
where the fine imposed by the court does not exceed Six Dollars
and Seventy-five Cents ($6.75), the cost taxed shall be equal to
but not greater than the fine imposed; provided further that in
all cases which are nol-prossed before conviction, the court may,
in the discretion of the Judge, tax no cost, or any sum not in ex-
cess of $6.75. All costs taxed as hereinabove provided, shall be
collected by the Clerk and paid into the City Treasury, and said
costs shall be in addition to any officer's fees provided by law.
The costs in every case tried before the Recorder
shall be entered on a trial docket and in no case shall any person
be entitled to any fees unless such fees are clearly set down, item
by item, on the docket and it is the duty of the Recorded to see that
this Section in enforced.
SECTION 4. That no part of the costs nor any of the fees due
any officer in any case or proceeding for a violation of the City
laws shall be taxed against or be paid by the City.
SECTION 5. That, whenever any person is tried on the complaint
of another and is acquitted, the Recorder may, if he is satisfied
that the complaint is frivolous or malicious, tax the party making
the same with all, or any part of the costs, at his discretion, and

the same shall be collected as other costs.
All laws or ordinances in conflict herein are hereby
repealed, and this ordinance shall go into effect 15 days after
its publication.
