The City Counci I,of the City of F a i rhope meat in regu I ar session at the
City Hall, Monday, February 12, 1961 at 7:30 P.M. with the following
members, present_ Mayor Schneider, Councilmen: Boone, Gaston, Nelson,
Poser and Schermer.:
The minutes of the previous regular meeting were read and approved as
read.
The f o I lowing bids were received on Refuse Col Iectort.

Motti'on by Councilman Poser seconded by Councilman Schermer that the bids
be taken under advisement and a committee appointed to report to the: Council
at the next regular meeting. Motion carried.

Motion by Councilman Boone seconded by Councilman Nelson that the City
accept Iowi bid of Gaston, Motor Co., Inc. Upon bei ng, putt to vote the
following; vote was recorded: Fors Counci Imen Boone and Nelson. Against::
Counc i Imen Poser and Schermer. Counc i Iman Gaston not voting. Mayor
Schnei der then voted for the: motion -,to break the: tie and the motion was
carried,
Admiral Duffill presented petition to the -Council for financial support
for the Deep South Folk. Festival to be held i n F a i rhope on March l6th,
17th and l8th. C ounc i I man Schermer, and: the City Attorney were appointed
to make a study and report to the next meeting of the Council.
Mr. Lamar Mangham .representing Price Booadcast i n; requested the Counci I to
place: a: ones -half page ad in the Baldwin County Vacationer. Motion by
C ounc i 1 man Poser seconded by C ounc i I man Gaston that the City place one-
half:" page ad as requested. Upon. being put to vote the following vot* was
recorded: For: Counci Imen Poser and: Gaston,, Against: Councilmen Boone.
Schermer and Neal son. Motion defeated.
Motion by Councilman Boone seconded by Councilman Nelson that the City
purchase three 2 way transmitter receiver radios: from General, Electric
at a cost of 0541 .00 each. Motion carried.
Motion by Councilman Boone seconded by Councilman Gaston that the City
authorize ByrdL. Moore and: Co. to prepare plans and advertise for bids
on Labor on Ly, to erect 200 feet of new wharf and remove: all r i n i ng;
piling from the old damaged section.. of the wharf. Motion carried.
Motion by Councilman Gaston seconded by Councilman Nelson that the City
solicit bids for f ire hose as. per spec i:f icat i ons submitted, by the Volunteer
Fire Department. Motion carried:.
Councilman Boone introduced the following Ordinance which warsseconded by
Councilman Gaston, read to the meeting and held, for passage at the next
regular meeting of the City Council.

ORDINANCE NO.
AN ORDINANCE REGULATING THE DISTRIBUTION OF HANDBILLS AND
PROVIDING PENALTIES FOR VIOLATIONS HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FAIRHOPE, ALABAMA, That:
SECTION 1. Throwing Handbills Broadcast in Public Places
Prohibited. It shall be unlawful for any person to deposit,
place, throw, scatter or cast any handbill in or upon any
public place within this City; and it shall be also unlawful
for any person to hand out or distribute or sell any handbill
in any public place; Provided, however, that it shall not be
unlawful for any person to hand out or distribute without
charge to the receiver thereof; any handbill in any public
place to any person willing to accept such handbill.
SECTION 2. Placing in Vehicles --Handbills. It shall be
unlawful for any person to distribute, deposit, place, throw,
scatter or cast any handbill in or upon any automobile or
other vehicle. The provisions of this section shall not be
deemed to prohibit the handling, transmitting or distributing
of any handbill to the owner or other occupant of any auto-
mobile or other vehicle, who is willing to accept the same.
SECTION 3. Distribution on Uninhabited or Vacant Private
Premises of Handbills. It shall be unlawful for any person to
distribute, deposit, place, throw, scatter or cast any handbill
in or upon any private premises which are temporarily or con-
tinuously uninhabited or vacant.
SECTION 4. Prohibiting Distribution Where Properly Posted.
It shall be unlawful for any person to distribute, deposit,
place, throw, scatter or cast any handbill upon any premises if
requested by anyone thereon not to do so, or if there is placed
on said premises in a conspicuous position near the entrance
thereof, a sign bearing the words: "No Trespassing," "No
Peddlers or Agents", "No Advertisement", or any similar notice,
indicating in any manner that the occupants of said premises do
not desire to be molested or to have their right of privacy
disturbed, or to have any such handbills left upon such premises.

SECTION 5. Distribution on Inhabited Private Premises --
Handbills. No person shall distribute, deposit, place, throw,
scatter or cast any handbill in or upon any private premises
which are inhabited, except by handing or transmitting any
such handbill directly to the owner, occupant, or any other
person then present in or upon such private premises; Provided,
however, that in case of inhabited private premises which are
not posted as provided in this ordinance, any person, unless
requested by anyone upon such premises not to do so, may place
or deposit any such handbill in or upon such inhabited private
premises, if such handbill is so placed or deposited as to
secure or prevent such handbill from being blown or drifted
about such premises or elsewhere, except that mailboxes may
not be so used when so prohibited by Federal postal laws or
regulations.
SECTION 6. Name and Address of Printer, etc., and Dis-
tributor of Handbills. It shall be unlawful for any person to
distribute, deposit, scatter, hand out or circulate any handbill
in any place, under any circumstances, which does not have
printed on the cover, front or back thereof, the name and
address of the following:
(a) The person who printed, wrote, compiled or manu-
factured the same:
(b) The person who caused the same to be distributed;
Provided, however, that in the case of a fictitious person or
club, in addition to such fictitious name, the true names and
addresses of the owners, managers or agents of the person
sponsoring said handbill shall also appear thereon.
SECTION 7. Exemptions. The provisions of this ordinance
shall not be deemed to apply to the distribution of mail by the
United States, nor to newspapers of general circulation.
SECTION 8. Certain Existing Ordinances Not Affected. This
ordinance shall not be deemed to repeal, amend or modify any
ordinance ever ordained, either prohibiting, regulating or

licensing canvassers, hawkers, peddlers, transient merchants,
or any person using the public streets or places for any
private business or enterprise, or for commercial sales, not
covered herein.
SECTION 9. Severabil.ity. If any provision of this ordi-
nance, or its application to any person or circumstances, shall
be held invalid, the remainder of the ordinance, or the appli-
cation of the provision to other persons or circumstances, shall
not be affected.
SECTION 10. Penalty. Any person who shall violate any pro-
vision of this ordinance, upon conviction thereof, shall be

punished by a fine or penalty of not more than 7A-
DOLLARS, or by imprisonment for
not exceeding_ days.
SECTION 11. That this ordinance shall take effect and be
in force thirty (30) days from and after its passage and publi-
cation, as provided by law,

request of 51% of the property owners on Blue Island Avenue that Byrd
L. Moore and Co.. be authorized to prepare. assessment ordinance in accord-
ance with the, C it y Attorney* s. letter covering the clearing of right-of-
way from Gayfer Street to Fairhope Avenue. Motion carried,.
Motion by Councilman Schermer seconded by Counc i I man Poser that the f..ol l ow-

SECTION 13). District Boundaries- Property located on the Southwest
corner of Oak and North Church Streets,, Lots 1, 2 & 3, block. 8, Division.
3, F-.S. T. C. [ands, be rezoned from R-2 to B-2.
Upon being put to vote the following vote was recorded For: Counci Iment
Boone., Gaston, Nelson,. Poser and Schermer. Pgainst: None. Motion carried.
Motion by Councilman Schermer seconded by Councilman Poser that the follow-
i ng. Resolution. be adopted:
BE IT RESOLVED that the Mayor and City Council of the City of Fa i rhope,
Alabama, hereby .request the State Highway Department to reopen work on.
four lane highway from Spanish Fort to Fa i rhope by the most feastb I e route.
Motion unanimously carried.
Motion by Councilman Boone seconded by Councilman Gaston that the City
accept tow bid of Truck Equipment Company of Birmingham for Roto Pac
Refuse Collecting: unit. Motion carried,
M'ot i on by Councilman Boone seconded by Councilman Gastorr that the City
solicit bids omr 25,000 Ib. gross vehicle weight truck chassis with
specifications to properly operate the re -fuse collecting unit. Motion.
carried.,
Motion by Councilman Poser seconded: by Councilman Schermer than: the follow-
ing Resolution be adopted:

more commonly known as a C ommun i ty Center.
