COUNTY OF BALDWIN
The Town Council of the Town of Fairhope met in
regular session at the Town Hall` Tuesday October
8, 1946 at 7:30 P.M. with the following members
present: Mayor, Howard Ruge, Councilmen: J. H.
Bennett, C. A. Gaston, H. P. Kamper, W. 0. Keeble
and J. 0. Stimpson.
The minutes of the previous regular meeting .:ere

Councilman H. P. Kamper moved that the following
resolution be adopted, seconded by Councilman
C. A. Gaston.
BE IT RESOLVL that ?i. C. Yohn be and he is
designated to make up the assessment roll of all
property and subjects of taxation in the Town of
Fairhope, for the taxes to become due December 1,
1946. Resolution a.dcpted by the Coiincil.
Moved by Councilman C. A. Gaston, seconded by
Councilman H. P. Kamper that the following
resolution be adopted.
BE I,T RESOLVED by the Town Council of the
Town of rairhoQe, there be and is hereby levied
for general purposes, for the year of 1946, a
tax of one-half of one percentum of the value of
all property and subject to taxation as assessed.
for State Taxation during the preceeding year in
the Town of Fairhope.

BRIT ORDAINBU BY THE TOWN COUNCIL OF THE TOWN OF FAIRHOPE_
Section ItThat the Mayor be and he is hereby elected, and.
designated as City Manager of the Town. of Fairhope and aball have
and exercise all powers and authority and do and perform all acts
and duties prescribed by law to the City Manager under the local
act passed by the Legislature of Alabama at its I945 session rel-
ative to the City Manager of the To of Fairhope.
Section 2tThe term for which the Mayor shell serve as City
Manager shall commence October Ist.,I946 and shall terminate Sept-
ember 30th.9,I947.The Council has under said act and hereby reserves
the right at any timeto repeal this ordinance and terminate such
service with or without cause.T'he Mayor shall receive as compens-
ation for his services as-C.ity Manager in addition to his salary
as Mayor the sum of 275.00 per month,payable on the last day of
each monthfifty dollars of such salary shall be paid out of the
general fund,.ome hundred sixty-five dollars out of the electric
plant funds and sixty dollars out of the water and sewerage funds.
Section 3tThe Mayor's services as superintendent of the light
plant and sewerage and water systems under the local act of 1939
shall connue termed.

Councilman Stimpson moved that the rules which might otherwise
prevent the ordinance being put upon its final passage be sue-
pended.Councilman Keeble seconded the mation.The motion being c
carried the roll was called with the following results

Stimpson.Mayor Ruge not voting.

The Mayor declared the rules suspended whereupon Councilman
Kamper moved the adopjiion of the ordinance such motion having
been seconded by Councilman Gaston,the Mayor put the motion.
Voting AyetCouncilmen Bennett,Gaston,Kamper,Keeble and
Stimpson.Mayor Ruge not voting.
Voting NaytNones
The mayor declared the Ordinance duly adopted and signed the
same.

SCHEDULE OF GAS RATES FOR
NATURAL GAS AND SERVICE FUR-
NISHED FROM THE GAS DISTRIBU-
TION SYSTEM OF THE TOWN OF
FAIRHOPE , ALA.BAMA
BE IT ORDA-MD by the Town Council of the Town
of Fairhope that the following schedule of rates for gas
and service furnished from the gas distribution system of
the Town of Fairhope be and the same hereby is adopted:

The minimum charge each month shall be $6.00 regardless of
the quantity of gas consumed.
Industrial Consumers
The rates for industrial consumers shall be subject to negotiation
between the consumer and the town and shall be subject to the
limitations contained in the gas supply contract between
United Gas Pipe Line Company and the town.
Consumer's Deposits
Each domestic consumer shall keep on deposit with the town
5.00 as security for the payment -of bills rendered to such
consumer. Each commercial consumer shall keep on deposit
with the town as security for the payment of bills rendered
to such consumer a deposit sufficient to cover the average
monthly bills of such consumer, which shall in no event be
less than $10.00. Each industrial consumer shall keep on
deposit with the town as security for the payment of bills
rendered to such consumer a deposit sufficient to pay the
average monthly bills of such consumer, which shall in no
event be less than $15.00.
Deposits larger tha'K that albuve provided may be required of
domestic consumers wherever it is necessary in the judg-
ment of the management to assure pay-
ment of bills for service

Due Dates of Bills and Discontin-
uance of Service for Nonpayment
.All bills for gas and service shall be rendered monthly and
the minimum charge for each such consumer shall be payable
for each monthly period in advance. Each such bill shall be
in the amount of the minimum charge for the ensuing monthly
period following the date of such bill, plus any excess for
gas furnished and service rendered during the preceding
monthly period. Each such bill shall become delinquent
ten days after the date thereof. If any such bill shall
not be paid within ten days after it becomes delinquent;
service shall thereupon be discontinued to the consumer
whose bill is so delinquent and the town shall apply toward
payment of such delinquent bill any sum remaining of the
deposit made by such consumer so delinquent. If it becomes
necessary to send an employee to the premises of such con-
sumer for the purpose of discontinuing such service because of
such delinquency, a charge of 500 will be added to the delin-
quent bill, and if such service shall be discontinued then
such bill plus an additional charge :of $1.00 for the recon-
nection must be paid before the service is restored.

Councilman moved that the rules be suspended
and unanimous consent be given for immediate consideration of
and action on said ordinance, which motion was seconded by
Councilman , and upon the motion being put
to vote the following vote was recorded: Ayes: Mayor Ruge
and Councilmen Gaston, -Bennett, Kamper, Stimpson and Keeble;
Nays: None. The mayor thereupon declared that the motion for
unanimous consent for immediate consideration of and action on
Ld ordinance had been unanimously carried. Councilman
thereupon moved that the said ordinance be
finally adopted, which motion was seconded by Councilman
and upon said motion being put to vote
the following vote was recorded: Ayes: Mayor Ruge and
Councilmen Gaston, Bennett, Kamper, Stimpson and Keeble;
Nays: None. The mayor thereupon announced that the motion for

adoption of said ordinance had been unanimously carried, and

he signed said ordinance in approval thereof.
Councilman introduced the following
resolution which was read to the meeting:
BE IT RESOLVED that Ordinance No. es
of the Town of Fairhope adopted on this to
for the purpose of fixing a schedule of rates
for the gas distribution system of said town
shall be published one time in The Fairhope
Courier, a newspaper published in and having
general circulation in said town.
Upon motion duly made by Councilman and
seconded by Councilman , he said resolution
was unanimously adopted by the following vote: Ayes: Mayor
Ruge and Councilmen Gaston, Bennett, Kamper, Stimpson`"and
Keeble; Nays: None.
There being no further business to come before the
meeting the same was on motion duly adjourned.
