COUNTY OF BALDWIN
The Town Council of the Town of Fairhope met in
regular session at the Town Hall Tuesday January
22, 1946 at 7:30 P.M. with the following members
present: Howard Ruge, Mayor, Councilmen: J. H.
Bennett, C. A."Gaston, H. P. Kamper, W. 0. Keeble
and J. 0. Stimpson.
The minutes of -the previous regular meeting were
approved as read.
The following ordinance was introduced by,Councilman
C. A. Gaston, read in full by the Clerk and considered
by the Council, said ordinance being as follows:
ORDINANCE N0. 174
AN ORDINANCE
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
FAIRHOPE:
SECTION 1: It shall be unlawful and be a crime
'against the Town of Fairhope under this Ordinance,
for any person to do any act or acts, or to omit to
do or to refrain from doing any act or acts within
the Town of Fairhope or within the police jurisdiction
thereof, the.doing of which or the omission to do or.
the refraining from doing of which is a misdemeanor
under the laws of the State of Alabama.
SECTION 2: Any person who is convicted under
Section 1, hereof, shall be punished by fine, not to
exceed $100.00 or by imprisonment at hard labor upon
the streets or public works or in the workhouse or
house of correction of the Town of Fairhope, not
exceeding six months, ono -or both; and in the event
any fine or cost are not presently paid, the Recorder
of the Town shall sentence the offender, or person,
thus in default to work out the fine and costs at
hard labor upon the street or public works, or in the
workhouse or house of correction of the Town, and the
person so sentenced to hard labor shall be allowed
.one dollar for each days service so performed, etc.
SECTION 3: This ordinance shall become operative
upon its adoption and approval.
Duly adopted by the Town Council of the Town of
Fairhope, Alabama, at a regular meeting thereof held
on the 22 day of January, 1946..

Moved by Councilman C. A. Gaston seconded by
Councilman J. 0. Stimpson that the Mayor be
authorized to purchase by Quit Claim Deed from J. A.
Patterson all his right and title to Lot A Seacliff,
together with such abstract as he may have for $110.00.
Motion carried.
It was duly moved and seconded that the meeting
adjourn. Motion carried.

BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
FAIRHOPE, as follows:
SECTION 1. That from and after the adoption of
this ordinance, no commercial, manufacturing or indust-
rial building or building used in connection therewith
shall be erected on property adjacent to Section Street
nearer than thirty five (35) feet from the center line
of said Section Street; and no residential building or
building used in connection therewith shall be erected
on property adjacent to said Section Street nearer than
sixty five (65) feet from the center line of said street.
The section line is the center line of said Section
Street.
SECTION 2. No permit shall issue for. the erection
of any building on property adjacent to said street
between the said streets and avenues unless and untill
proper plans and specifications have been presented to
this Council showing the location of the building to
be erected; provided however, that the Council may by
a two-thirds vote, in instances deemed proper by the
Council, waiver the requirements of this ordinance.
SECTION 3. It shall be unlawful for any person,
firm, corporation or association to erect any building
on property adjacent to the said street between the
said streets and avenues without first obtaining a
permit therefor and upon conviction shall be fined not
less than $1.00 nor more than $100.00 and sentenced for
not more than 90 days.
SECTION 4. Any person w1io whall erect any
building in violation with this ordinance shall remove
the same upon notice by the Mayor requiring such removal.
This ordinance shall be effective,from and after
its passage and approval.

none, such ordinance being in words and figures as
follows:
