H. Bennett, C. A. Gaston, H. P. Kamper, W. 0. Keeble and J. 0. Stimpson. The minutes of the previous regular meeting were approved as read. Elec. 3.93 W & S 2.00 Motion by Councilman J. 0. Stimpson seconded by Councilman H. P. Kamper that the proposal of W. F. Hawie be approved subject to.the Fairhope Single Tax Corporation action on request of transfer of property. Motion carried. C. A. Gaston offered the following ordinance and moved its adoption: 0 P 0. , -1 7 3 BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF FAIRHOPE, as follows: SECTION 1. That from and. after the adoption of this ordinance, no commercial, manufacturing or industrial building or building used in connection therewith shall be erected on property adjacent to Section street nearer than thirty five (35) feet from the center line of said Section street; and no residential building or building used in connection therewith shall be erected on property adjacent to said Section street nearer than sixty five (65)'feet from the center line of said street. The section line is the center line of said section street. SECTION 2. No permit shall issue for the erection of any building on property adjacent to said street between the said streets and avenue unless and until proper plans and specifications have been presented to this Council showing the location of the building to be erected; provided however, that the Council may by a two-thirds vote, in instances deemed proper by the Council, waiver the requirements of this ordinance. SECTION 3. It shall be unlawful for any person, firm, corporation or -association to erect any building on property adjacent to the said street between the said streets and avenues without first obtaining a permit therefor and upon conviction shall be fined not less than $1.00 nor more than $100.00 and sentenced for not more than 90 days. SECTION 4. Any person who shall erect any building in violation with this ordinance shall remove the same upon notice by the Mayor requiring such removal. This ordinance shall be effective from and after its passage and approval. J. 0. Stimpson seconded the motion of C. A. Gaston and moved that said ordinance be carried over to the next regular meeting, January 8, 1946, at which time the Council will hear any objections to the same, for final consideration and that notice of the intention to adopt said ordinance bye give by publication in the Fairhope Courier, a newspaper published in Fairhope in its issue of December 20, which said motion was unanimously adopted. Motion by Councilman J. H. Bennett seconded by 6ouncil- man C. A. Gaston that the proposal of Riviera Utilities be accepted and the Mayor be authorized to sign the contract in behalf of the Town of Fairhope. Motion carried.
