CQUNTx OF BALDWIN
The Town Council of the Town of Fairhope met in
regular session at the Town Hall Tuesday October
24, 1944 at 7:30 P.M. with the following members
present: Howard Ruge, Mayor, Councilmen: J. H.
Bennett, C. A. Gaston, W. 0. Keeble and J. 0.
Stimpson. Councilman H. P. Kamper being absent.
The minutes of the previous regular meeting were
approved as read.
Councilman C. A. Gaston offered the following re-
solution and moved its adoption seconded by '
Councilman J. 0. Stimpson.
WHEREAS, The assessment of and on all property
and subjects of taxation liable for taxes in the
Town of Fairhope for the year 1944 having been made
by R. C. Yohn the person designated by the Town
Council of the Town of Fairhope, Alabama, to assess
such taxes, and having been returned to the Council,
all in accordance with the laws of the State of
Alabama and of the Town of Fairhope;
THEREFORE, BE IT RESOLVED, that the Town Council
of the Town of Fairhope will sit between the hours of
7:30 o'clock P.M. and 9:30 o'clock P.M. on the 28 day
of November, 1944, to hear and determine any and all
objections to such assessment of town taxes.
BE IT FURTHER RESOLVED, That the Mayor of the
Town of Fairhope and the Clerk of the Town of Fairhope
be and they are hereby directed to cause notice of
such assessment of taxes and of the time and place for
hearing and determining objections thereto to be given
by publication in the Fairhope Courier in its issues
of November 2 and November 9th, 1944. Motion carried.

Motion by Councilman J. 0. Stimpson seconded by Council-
man J. H. Bennett that the application of Mrs. W. N.
Allen for permit to build be allowed. Motion carried.
Moved by Councilman C. A. Gaston seconded by Council-
man J. Q. Stimpson that the Mayor be directed to pay
Layne Central Company the amount of $7980.00 as payment
in full for the new well and equipment as per contract.
Lotion carried.
It was duly moved and seconded the meeting adjourn.

BE IT RESOLVED that the Mayor and.Treasurer,are

authorized and directed to deposit with the Probate
Court of Baldwin County the amount of the award in
the condemnation proceedings of the Town of Fairhope
VS D. P. Bester Jr.. et al for condemnation of a part
of lot A of Seacliff, such award being in the sum of
$566.66, such deposit to be charged to the special
5 mill tax fund.
And it appearing that such award in the opinion
of the Council is grossly excessive.
BE IT FURTHER RESOLVED that the Mayor is further
authorized and directed to cause an appeal be taken
from such award, and that he execute all necessary
and proper papers to effect such appeal and to
prosecute the same.
Moved by Councilman C. A. Gaston seconded by Councilman
H. P. Kamper that the following resolution be adopted.
BE IT RESOLVED by the Town Council of the Town of
Fairhope, that there be and is hereby levied for General
purposes, for the year of 1944, a tax of one-half of
one percentum of the value of all property and subject
to taxation as assessed for State Taxation during the
preceeding year in the Town of Fairhope. .
BE IT FURTIMR RESOLVED that there be and is here-
by levied for the year 1944 for the purpose of acquiring,
installing and maintaining street lights and fire fight-
ing equipment and for the purpose of constructing, ac-
quiring, maintaining and improving public build}ngs,
parks and other public property *.special tax of one-
half of one percentum of the value of ,all property and
subjects of taxation in the Town of-Fairhope as assessed
for State taxation during the preceeding year, as '
authorized by the result of election held August 201, 1940.
