Berglin, Sam Dyson, C.A. Gaston, H.P. Kamper and J.0. Stimpson, the same constituting the full membership of the Town Council The minutes cif the previous regular and special meeting were approved as read. Berglin and seconded by Council- man H.P. Kamper that the following resolutions be adopted. Motion carried. BY IT MWOLVED by the Town Council of the Town of Fairhope that a doubt exists as to the validity and extent of the municipality's claim against the General Exchange Insurance Corporation on mun- icipal license taxes for the years 1934 to 19389 inclusive, and that it is to the best interest of the municipality to compromise and settle the claim with the General Exchange Insurance Corpor- ation at and for the the sum of One hundred and 52/100 ($100.52 ) dollars. BE IT FURTHER RESOLVED that the municipal clerk be, and he is hereby authorized and directed to settle and compromise any and all claims of the Town of Fairhope against said General Exhha.nge Insurance Corporation for license taxes for the years 1934 to 1938, inclusive, at and for the sum of One hundred & 52/100 dollars, and to receive payment of said sums for and in behalf of the city and to execute all releases or other documents nec- essary to effect the said compromise and settlement. BE IT FURTHER RESOLVED that a copy of this resolution be spread upon and be made a part of the minutes of the Town Council. Adopted this the loth At st: Cle day of 0 c tobe r, 1938 Approved: .,�jZ ,7 � Mayor BE IT RESOLVED by the Town of Fairhope, Alabama, that a doubt exists as to the validity and extent of its claim against the Home Insurance, Company and the Paul Revere -Insurance Company for the license tax 3tears 1934 to 19389 inclusive, for mun- icipal license taxes on business whereby said companies insur- ed financed automobiles located in the Town of Fairhope and belonging to residents of said municipality, and that it is to the best interest of the municipality to compromise its claims against said companies at and for the sum of Seventy-five & 56/100 ($75.56) Dollars for the tax years 1934 to 1938, inclusive. BE IT YIRTHER RESOLVED that the Town Clerk be, and he is hereby _ authorized and directed to settle and compromise any and all claims of the Town of Fairhope against said Home Insurance Company and Paul Revere Insurance Company for license taxes for t. the years 1934 to 1938, inclusive, at and for the sum of Seventy- _ . five & 56/100 (75.56) Dollarsp and to z,eive payment of said sums for and in behalf of the municipality and to execute all releases or other documents necessary to effect the said com- promise and settlement. BE IT RESOLVED by the Town Council of the Town of Fairhope: FIRST: That there be and is hereby levied fnr the tax year 1938 for general purposes an advaloriem tax of 5 mills, that is 50je on each $100.00 of taxable property, in the Town of Fairhope. SECOND: That there be and hs hereby levied in pursuance of a special electi6n held July 29 th,1935, an advaloriem tax of 5 mills, that is 50,e on each ,#lOOeO0 of taxable property in the Town of Fairhope, for the tax year 1938 for street -lights, fire -fighting equipment and improvement and maintenance of municipal property. THIRD: That E.S. Tunstall be and he is hereby designated and emplayed to make assessment of all taxable property in the Town of Fairhope liable for F nicipal advaloriem taxes for the year of 1938 and that he beid therefor the sum of fifty dollars payable upon presentati ofbill therefor after such assessments are made and approved; that said assessment be made and returned as provided by law. Stimpson that the Mayor and Town Clerk be authorized to employ Smith, Dukes and Buoklaw to make the annual audit. St4was moved by M.O. Berglin and seconded by Councilman C.A. Gaston that the application of Henry Rathje be rejected as his specifications were in violation of the fire ordinance to move his frame building to another location on the same lot. Motion carried. It was moved by Councilman M.O. Berglin and seconded by Council- man J.O. Stimpson that the petition of the Fairhope Single Tax Corporation be granted to construct a four foot sidewalk on the East side of Section Street between the sidewalk now on the south side of Fairhope Avenue and that in front of the Rockwell build- ing-. The Fairhope Single Tax Corporation to pay the full cost of the work and the Town of Fairhope administration be ask for bids on the same. Notion carried. i It was moved by Councilman Sam Dyson and seconded by Council- man J.O. Stimpson that Harry Stradling's application for a permit to locate and remodel a building as per sketch and specification, be allowed. Motion carried. It was moved by Councilman C.A. Gaston and seconded by Council- man Sam Dyson that request of Raymond Wood for a ninty days leave of absence be granted. Motion carried. Motion was made and duly seconded that the meeting adjourn.
