The regular meeting of the Council
of the Town of Fairhope was
held
Monday, May 13, 1935 when the the following
members were present
Howard
Ruge, Mayor; M. 0. Berglin, C. A. Gaston,
W. 0. Keeble, T J.
Klumpp
and J. 0. Stimpson, Councilmen.
The minutes of the meeting of April
22 and adjourned meeting
of April
24 and May 6, 1935 were approved as
read.

Motion by Councilman Gaston seconded by Councilman Berglin that the
authorization given to the mayvtat the regular meeting April 22nd, be
extended and the amount of warrants be increased to $1,800.00, carried.
Motion was made by Councilman Gaston seconded by Councilman Stimpabn
that the Town of Fairhope enter their protest against Federal Tax on
Deisel fuel Oil and a letter�e sent to the Congressman and Senator and to
the Chairman of Ways & Wdans Committee. Motion carried.
The following resolution was introduced by C. A. Gaston and seconded

may-,M--0. Berglin, placed upon its passage and unanimously adopted:
N Z_---•-�- 1&,REAS John W. Ettel and Fred D. Dot are giving and -- , y g g granting to
t& Town of Fairhope certain rights and easments necessary and proper in the
contruction, maintenance and operation of its water and sewerage plant
now being constructed under PWA Project No. 6762; and
WHEREAS, said John W. Ettel and Fred D. Doty desire assurance that
the said water and sewerage plant will be maintained and operated in com-
liance with the requirements of the sanitary laws of the 8tape of Alabama
and under the rules and regulations now or hereafter promulgated or enforced
by ourunder the authority and jurisdiction of the Public Health Department
of the State of Alabama;
NOW THEREFORE,BB IT RESOLVED: That the Mayor of the Town of Fairhope
t be and he is hereby authorized and directed to execute and deliver an
agreement to the said John W. Ettel and Fred D. Doty in substantially the
following form:
"SLATE OF ALABAMA
BALDWIN COUNTY
KNOW ALL MEN BY THESE PRESENTS, that John W. Ettel and
Fred D. Doty having given and granted to the Town of Fairhope
the right and easement to construct, maintain and operate a
waterworks and sewerage system, or parts of the same, over, on,
adross or adjacent to his property in the Town of Fairhope, the
said Town of Fairhope does hereby CONTRACT and AGREE that the
said waterworks and sewerage system shall be maintained and
operated in full compliance with the requirements of the Sani-
tary Latins of the State of Alabama and 6f the rules or regulations
now or hereafter promulgated or enforced by or under the auth-
ority and jurisdiction of the Public Health Department of the
State of Alabama.
IN WITNESS WHEREOF the Town of Fairhope has caused these
presents to be executed b�, its Mayor, duly authorized thereto by
resolution of the Town Council of the Town of Fairhope, this
the fay of May, 1935.

Motion made by Councilman Neeble seg�nded by Councilman Klumpp
that the Mayor be authorized to issue warrant for $1500.00
to be used to finance watLreservice connections on new main.,
