BALDWIN COUNTY.
The Town Council of the Town of Fairhope, County of Bald-
win, Alabama, met in regular session at Town Hall at ; D o t clock
P. M., on the llth day of March, 1935, when and where the following
members were present, to -wit: Howard Ruge, Mayor; Messrs, C. A.
Gaston, W. 0�� le, T. J. Klumpp, J. 0. St impson and M. 0. B erglin,
Councilmen; the same constituting the full membership of the Town
Council:
The following Ordinance No. h 3 u and entitled
"An Ordinance to authorize, empower and direct the
Mayor, Howard Rugs, and J. B. Converse & Co., Inc.,
Town Engineers, to advertise for bids for the con-
struction of street improvement work heretofore
authorized and determined to be done in the Town
of Fairhope under PWA Docket 5162, as will appear
by ordinances heretofore adopted by this Council",,

BE IT ORDAINED BY THE TOWN COUNCIL OF THE TUJX OF FAIRHOPE,
ALAS A, AS FOLLOWS:
Section 1, That Uovrard Rugs, Mayor, and J. B. Converse &
Co,, Ina., Torun Engineers, of the Torre of "Fairhope, Alabama, be and
they hereby are. authorized and directed to advertise for bids for
the construction of the street improvements heretofore authorized
and determined under and by ordinances heretofore adopted by this
Torm Council, said construction to be done in accordance with the
requirements of the Federal Government under PWA Docket No,,,5162.
BE IT FURTHER ORDLINIM $Y THE TO= COUNCIL that the said
notice be in substantially the following form:
"NOTICE TO COisiRACTORS
Sealed proposals will be received by the ToVM Council of ,
Fairhope, Alabama,,, at the office° of the Toot Clerk until 11:00

Plans and specifications may be inspected at the office
of the Town. Clerk and` procured upon deposit of $5,00, which
will not be, refunded. '
Vage rates and. contract performance shall conform with
PWA requirements_. The designated employment agency is Nation-
al Reemployment Office, Wirhope,, Ala.,
Without- exception, no bid will be considered unless accom-
panied by the bidderts.Certificate of CompliOnee, U. S. Govern-»
meat -Form PWA 61, Revised Itarch 1934, to the effect that the
bidder is complying .with. and will continue to comply with each
applicable Code of Fair Competition, or, in the absence of such
Code or,Codes, with the Presidentts Reemployment Agreement,
Copies .o ' this Certificate -will be included with the Instruo ►
tions to .Bidders.
Certified aback or bidders bond for not less than 5% of
the amount of bid must accompany each propoa'al. Performance
and ,Labor bonds will be required.
A Qualification questionnaire must be filed unless eon-
traetor has qualified within the past three months

BE IT FURTHER ORDAINED` that said notice be published for

It was moved by 7 and seconded by
CO �� �,-✓ , that all rules of the Town Council of the Town
of Fairhope, Alabama, which might prevent, unless suspended, the
final passage and adoption of said ordinance at this meeting, be and
the same are hereby suspended for the purpose of permitting the fin-
al passage and adoption of said ordinance at this meeting.
The question being upon the adoption of said motion and
the suspension of such rules, the roll was called with the following
results:
AYES: Howard Ruge, Mayor; C. A. Gaston, W. 0. Keeble, T. J. Klumpp,
J. 0. Stimpson arm-:- -_Bsegida, Councilmen.
NAYS: None.
The mayor declared said motion carried and such rules sus-
pended.
Councilman C G� �� then moved that said. or-
dinanee be now placed upon its final passage. Councilman
seconded the motion.
The question being put upon the placing of said ordinance
upon its final passage, the roll was called with the following re--
sults:
AYES: Howard Ruge, Mayor; C. A. Gaston, N. 0. Keeble, T. J. Klumpp,

NAYS: None,
The mayor declared the motion carried. Councilmen
thereupon moved that the said ordinance be finally pass-
ed and adopted as introduced and read. Councilman
seconded the motion.
The question being put upon the final passage and adoption
of said ordinance, the roll was called with the following results:
AYES: Howard Rage, Mayor; C. A. Gaston, W. 0. Keeble, T. J. Klumpp,
J. 0. Stimpson and -N-i. -0. , Councilmen.
NAYS: None*
The mayor thereupon declared said motion carried and the

held on the 11th day -of march, 1935, and as the same appears of
record in the minutes of said meeting.

The minutes of the regular meeting February 25th and special meeting

Tank Foundation for the Town of Oairhope, bein
items two, three, six and eight respectively, v-(rC:
under P W A Docket 110. '626Z,desire s- to and ha
sub -contracted said items to Dyson and Co. sub-
ject to the approval of the Town Council and of
the P W A Engineer,
NOW THEREFORE BE IT RESOLVED that the Town Coune-
ail of the Town of r'airhope does hereby consent
and approve such sub -contract of said 8. B. McCrary
Company, Inc., with Dyson and Company.
BE IT FURTHER RESOLVED that the mayor is author-
ized to execute and deliver necessary and proper
consent and approval under this resolution.
It was moved by Uouncilman Stimpson and seconded by Councilman
Klumpp,that salary of J. L Keller be raised $10.00 per month as
compensation for overtime during Construction period. Motion carried
unanimously.
It was moved by Councilman
and seconded by Councilman to meet that the meeting
